AERONAUTICS ACT

Regulations Respecting Zoning at Ottawa International Airport

Short Title

 These Regulations may be cited as the Ottawa International Airport Zoning Regulations.

Interpretation

 In these Regulations,

airport

airport means Ottawa International Airport, Ottawa, in the Province of Ontario; (aéroport)

airport reference point

airport reference point means the point described in Part I of the schedule; (point de repère de l’aéroport)

approach surface

approach surface means an imaginary inclined plane the lower end of which is a horizontal line at right angles to the centre line of a strip and passing through a point at the strip end on the centre line of the strip; (surface d’approche)

horizontal surface

horizontal surface means an imaginary horizontal plane located 150 feet above the assigned elevation of the airport reference point; (surface horizontale)

Minister

Minister means the Minister of Transport; (ministre)

strip

strip means a rectangular portion of the land area of the airport, being 2,000 feet in width including the runway, especially prepared for the take-off and landing of aircraft in a particular direction; (bande)

transitional surface

transitional surface means an imaginary inclined plane extending upward and outward from the outer lateral limits of a strip and its approach surface to an intersection with the horizontal surface or other transitional surfaces. (surface de transition)

 For the purposes of these Regulations, the airport reference point is deemed to be 348 feet above sea level.

Application

 These Regulations apply to all lands, including public road allowances, adjacent to or in the vicinity of the airport, as more particularly described in Part II of the schedule.

General

 No person shall erect or construct, on any land to which these Regulations apply, any building, structure or object or any addition to any existing building, structure or object, the highest point of which will exceed in elevation at the location of the highest point any of the surfaces hereinafter set out that project immediately over and above the surface of the land at that location, namely,

  • (a) a horizontal surface, the outer limits of which may be described as follows:

    COMMENCING at the Southeasterly corner of Lot 27, in Concession 4 Rideau Front, in the Township of Gloucester; THENCE, Westerly along the southern boundary of Lot 27 to the Southwesterly corner of the said Lot; THENCE, Southerly in a straight line across the allowance for road between Concessions 4 and 3 Rideau Front to the Southeasterly corner of Lot 27, in Concession 3 Rideau Front; THENCE, Westerly along the southern boundary of said Lot 27, in said Concession 3 Rideau Front, to the Southwesterly corner of the said Lot; THENCE, Westerly in a straight line across the allowance for road between Concession 3 Rideau Front and the Gore Concession to the Southeasterly corner of Lot 27, in the Gore Concession; THENCE, Westerly along the southern boundary of said Lot 27, in the said Gore Concession to the Southwesterly corner of the said Lot; THENCE, Southerly along the eastern boundary of Lot 27, in Concession 2 Rideau Front, to the Southeasterly corner of the said Lot; THENCE, Westerly along the southern boundary of Lot 27, in Concession 2 Rideau Front, to the Southwestern corner of the said Lot; THENCE, Northerly along the western boundaries of Lots 27 and 26, in Concession 2 Rideau Front, to the Northwesterly corner of Lot 26, in the said Concession; THENCE, Northerly in a straight line across the allowance for road between Lots 26 and 25, in said Concession 2 Rideau Front, to the Southwesterly corner of Lot 25, in the said Concession; THENCE, Northerly along the western boundaries of Lots 25, 24, 23, 22 and 21, in the said Concession 2 Rideau Front, to the Northwesterly corner of Lot 21, in the said Concession; THENCE, Northerly in a straight line across the allowance for road between Lots 21 and 20, in said Concession 2 Rideau Front, to the Southwesterly corner of Lot 20, in the said Concession; THENCE, Northerly along the western boundaries of Lots 20, 19, 18, 17 and 16, in the said Concession 2 Rideau Front, to the intersection thereof with the production Easterly of the southern boundary of Lot 16, in Concession 1 Rideau Front; THENCE, Westerly along that production and along the southern boundary of said Lot 16, in said Concession 1 Rideau Front, and along the production Westerly thereof to the natural high water mark of the West bank of the Rideau River; THENCE, in a general Northerly direction along the said natural high water mark to the intersection thereof with the southern boundary of Lot 16, in Concession 1 Rideau Front, in the Township of Nepean; THENCE, Westerly along the southern boundary of the last said Lot 16 to the intersection thereof with a line drawn parallel with the Westerly limit of the allowance for road between Concession 1 and Concession “A” Rideau Front and perpendicularly distant 1,500 feet measured Westerly therefrom; THENCE, Northerly along the said parallel line to the intersection thereof with the Northern boundary of Lot 20, in the said Concession 1 Rideau Front; THENCE, Easterly along the Northern boundary of Lot 20, in the said Concession 1 Rideau Front, and along the production Easterly thereof to its intersection with the western boundary of Lot 21, in Concession “A” Rideau Front; THENCE, Northerly along the western boundaries of Lots 21, 22, 23, 24 and 25, in the said Concession “A” Rideau Front, to the Northwesterly corner of Lot 25, in the said Concession; THENCE, Northerly in a straight line across the allowance for road between Lots 25 and 26, in said Concession “A” Rideau Front, to the Southwesterly corner of Lot 26, in the said Concession; THENCE, Northerly along the western boundaries of Lots 26, 27, 28, 29 and 30, in the said Concession “A” Rideau Front, to the Northwesterly corner of Lot 30, in the said Concession; THENCE, Northerly in a straight line across the allowance for road between Lots 30 and 31, in Concession “A” Rideau Front, to the Southwesterly corner of Lot 31, in the said Concession; THENCE, Northerly along the western boundaries of Lots 31 and 32, in Concession “A” Rideau Front, to the Northwesterly corner of said Lot 32, in the said Concession; THENCE, Easterly along the Northern boundary of Lot 32, in said Concession “A” Rideau Front, to the Northeasterly corner of the said Lot; THENCE, Easterly along the production Easterly of the Northern boundary of said Lot 32 to the intersection thereof with the western boundary of Lot 33, in Concession “B” Rideau Front, in the Township of Nepean; THENCE, Northerly along the western boundary of said Lot 33, in said Concession “B” Rideau Front, to the Northwesterly corner of said Lot 33, in Concession “B” Rideau Front; THENCE, Easterly along the Northern boundary of said Lot 33, to the intersection thereof with the natural high water mark of the West bank of the Rideau River; THENCE, in a general Southerly direction along the said natural high water mark to the intersection thereof with the production Westerly of the Northern boundary of Lot “A”, in Concession 2 Rideau Front, in the Township of Gloucester; THENCE, Easterly along that production and along the Northern boundary of said Lot “A”, in said Concession 2 Rideau Front, to the Northeasterly corner of the said Lot; THENCE, Easterly in a straight line across the allowance for road between Concession 2 Rideau Front and Concession 3 Rideau Front, to the Northwesterly corner of Lot “A”, in Concession 3 Rideau Front; THENCE, Easterly along the Northern boundary of said Lot “A”, in Concession 3 Rideau Front, to the intersection of said Northern boundary with the western limit of Bank Street; THENCE, Southerly along the said western limit of Bank Street to the intersection thereof with the southern boundary of Lot 1, in Concession 3 Rideau Front; THENCE, Easterly along the said southern boundary of the said Lot 1 to the Southeasterly corner of the said Lot; THENCE, Southerly along the eastern boundaries of Lots 2, 3, 4 and 5, in said Concession 3 Rideau Front, to the intersection thereof with the production Westerly of the Northern boundary of Lot 6, in Concession 4 Rideau Front; THENCE, Easterly along that production and along the Northern boundary of said Lot 6, in said Concession 4 Rideau Front, to the Northeasterly corner of the said Lot; THENCE, Southerly along the western limit of the original allowance for road between Concessions 4 and 5 Rideau Front, to the point of commencement. SAVING AND EXCEPTING thereout and therefrom all of the Rideau River lying within the limits of the above described parcel,

  • (b) the approach surfaces abutting each end of the strips designated as 7-25, 14-32 and extending outward therefrom, the dimensions of which may be described as follows:

    • (i) runway approach 25, being 1,000 feet on each side of the centre line of the strip at the strip end and 1,680 feet on each side of the projected centre line of the strip at the outer end, the said outer end being 136 feet above the elevation at the strip end and measured horizontally 6,800 feet therefrom,

    • (ii) runway approach 14, being 1,000 feet on each side of the centre line of the strip at the strip end and 1,750 feet on each side of the projected centre line of the strip at the outer end, the said outer end being 150 feet above the elevation at the strip end and measured horizontally 7,500 feet therefrom,

    • (iii) runway approach 7, being 1,000 feet on each side of the centre line of the strip at the strip end and 1,650 feet on each side of the projected centre line of the strip at the outer end, the said outer end being 130 feet above the elevation at the strip end and measured horizontally 6,500 feet therefrom, and

    • (iv) runway approach 32, being 1,000 feet on each side of the centre line of the strip at the strip end and 1,655 feet on each side of the projected centre line of the strip at the outer end, the said outer end being 131 feet above the elevation at the strip end and measured horizontally 6,550 feet therefrom, and

  • (c) the several transitional surfaces, each rising at an angle determined on the basis of ratio of one (1) foot vertically for every seven (7) feet horizontally from the outer lateral limits of the strips and their abutting surfaces,

as shown on Plan No. T1603, dated October 2, 1963, of record in the Department of Transport at Ottawa.

Natural Growth

 Where an object of natural growth on any land to which these Regulations apply exceeds in elevation any of the surfaces set out in paragraphs 5(a) to (c), the Minister may make a direction that the owner or occupier of the land on which that object is growing remove the excessive growth thereof.

COMMENCING at the intersection of the centre line of runway 14-32 with the centre line of runway 07-25; THENCE Northwesterly along the centre line of runway 14-32, a distance of 3,200 feet; THENCE Northeasterly, at right angles to the said centre line of runway 14-32, a distance of 1,000 feet to a point, henceforth designated as the airport reference point.
