Zoning Regulations Respecting Quesnel Airport

Whereas, pursuant to section 4.5Footnote * of the Aeronautics Act, a copy of the proposed Zoning regulations respecting Quesnel Airport, substantially in the form set out in the schedule hereto, was published in the Canada Gazette Part I on March 22, 1986 and a reasonable opportunity was thereby afforded to interested persons to make representations to the Minister of Transport with respect thereto.

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to section 4.4Footnote * of the Aeronautics Act, is pleased hereby to make the annexed Zoning regulations respecting Quesnel Airport.

Short Title

 These Regulations may be cited as the Quesnel Airport Zoning Regulations.

Interpretation

  •  (1) In these Regulations,

    airport

    airport means the Quesnel Airport at Quesnel, in the Cariboo Regional District and in the Cariboo Land District, in the Province of British Columbia; (aéroport)

    airport reference point

    airport reference point means the point described in Part I of the schedule; (point de repère de l’aéroport)

    approach surface

    approach surface means an imaginary inclined plane that extends upward and outward from each end of a strip, which approach surface is more particularly described in Part II of the schedule; (surface d’approche)

    Minister

    Minister means the Minister of Transport; (ministre)

    outer surface

    outer surface means an imaginary surface located above and in the immediate vicinity of the airport, which outer surface is more particularly described in Part III of the schedule; (surface extérieure)

    strip

    strip means the rectangular portion of the landing area of the airport, including the runway, prepared for the take-off and landing of aircraft in a particular direction, which strip is more particularly described in Part IV of the schedule; (bande)

    transitional surface

    transitional surface means an imaginary inclined plane that extends upward and outward from the lateral limits of the strip and its approach surfaces, which transitional surface is more particularly described in Part V of the schedule. (surface de transition)

  • (2) For the purposes of these Regulations, the assigned elevation of the airport reference point is 543 m above sea level.

Application

 These Regulations apply to all the lands, including public road allowances, adjacent to or in the vicinity of the airport, which lands are more particularly described in Part VI of the schedule.

General

 No person shall erect or construct, on any land to which these Regulations apply, any building, structure or object or any addition to any existing building, structure or object, the highest point of which will exceed in elevation at the location of that point

  • (a) the approach surfaces;

  • (b) the outer surface; or

  • (c) the transitional surfaces.

Natural Growth

 Where an object of natural growth on any land to which these Regulations apply exceeds in elevation any of the surfaces referred to in paragraphs 4(a) to (c), the Minister may direct the owner or occupier of the land on which that object is growing to remove the growth or the excessive portion thereof.

Disposal of Waste

 No owner or occupier of any land to which these Regulations apply shall permit that land or any part of it to be used for the disposal of any waste that is edible by or attractive to birds.

SCHEDULE(Sections 2 and 3)

PART IDescription of the Airport Reference Point

The airport reference point that is marked by a brass monument set in concrete being a point distant 100 m measured southwesterly and perpendicular to the centreline of the runway designated 13-31 from the midpoint of said centreline and having UTM coordinates of 5,875,022.10 north, 532,852.11 east.

PART IIDescription of the Approach Surfaces

The approach surfaces, shown on Department of Transport Quesnel Airport Zoning Plan No. (Z) B.C. 1662, dated February 29, 1984, are surfaces abutting each end of the strip associated with the runway designated 13-31 and are more particularly described as inclined planes having a ratio of 1.25 m measured vertically to 50 m measured horizontally rising to imaginary horizontal lines drawn at right angles to the projected centre line of the strip and distant 3 000 m measured horizontally from each end of the strip; the outer ends of the imaginary horizontal lines being 375 m from the projected centre line; said imaginary horizontal lines being 75 m above the elevation at the ends of the strip.

PART IIIDescription of the Outer Surface

The outer surface, shown on Department of Transport Quesnel Airport Zoning Plan No. (Z) B.C. 1662, dated February 29, 1984, is an imaginary surface located at a common plane established at a constant elevation of 45 m above the assigned elevation of the airport reference point, except where that common plane is less than 9 m above the surface of the ground, in which case the imaginary surface is located at 9 m above the surface of the ground.

PART IVDescription of the Strip

The strip associated with runway 13-31, shown on Department of Transport Quesnel Airport Zoning Plan No. (Z) B.C. 1662, dated February 29, 1984, is 150 m in width, 75 m being on each side of the centre line of the runway, and 1 798.855 m in length.

PART VDescription of Each Transitional Surface

Each transitional surface, shown on Department of Transport Quesnel Airport Zoning Plan No. (Z) B.C. 1662, dated February 29, 1984, is a surface consisting of an inclined plane rising at a ratio of 1 m measured vertically to 7 m measured horizontally at right angles to the centre line and centre line produced of the strip extending upward and outward from the lateral limits of the strip and its approach surfaces to an intersection with the outer surface.

PART VIDescription of the Outer Limits of Lands

The boundary of the outer limits of lands, shown on Department of Transport Quesnel Airport Zoning Plan No. (Z) B.C. 1662, dated February 29, 1984, is described as follows:

All that land in the Cariboo District in the Province of British Columbia contained within the following described boundary.

COMMENCING at the Southeast corner of Parcel B, Plan 18650, District Lot 78, Cariboo District.

THENCE, northerly along a portion of the easterly boundary of said Parcel B, Plan 18650 to the Southwest corner of Lot 1, Plan 23875 District Lot 7263, Cariboo district;

THENCE, easterly along the southerly boundary of said Lot 1, Plan 23875 to the Southeast corner of said Lot 1, Plan 23875;

THENCE, northerly along the easterly boundary of said Lot 1, Plan 23875 to the Northeast corner of said Lot 1, Plan 23875;

THENCE, northeasterly in a straight line, toward the Northeast corner of the Remainder of the Fractional Southeast 1/4 of District Lot 7283, Cariboo District, to an intersection with the southerly high water mark of the Quesnel River;

THENCE, northeasterly continuing along said straight line, across the said Quesnel River, to an intersection with the northerly high water mark of the said Quesnel River;

THENCE, northeasterly continuing along said straight line to the said northeast corner of the Remainder of the Fractional Southeast 1/4 of District Lot 7283;

THENCE, northerly in a straight line, across Trembley Road, to the Southwest corner of Lot 1, Plan 18428, District Lot 5051, Cariboo District;

THENCE, northerly along the western boundary of said Lot 1, Plan 18428 to the Northwest 1/4 of said District Lot 5051;

THENCE, northerly in a straight line, across the Quesnel Canyon road, to the most southerly limit of the westerly boundary of the Remainder of the Northwest 1/4 of said District Lot 5051;
