Order Designating the Province of Quebec for the Purposes of the Definition “applicable guidelines” in Subsection 2(1) of the Divorce Act

Whereas the Province of Quebec, pursuant to subsection 2(5)Footnote a of the Divorce ActFootnote b, has established comprehensive guidelines for the determination of child support that deal with the matters referred to in section 26.1Footnote c of the Divorce ActFootnote b;

Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Justice, pursuant to subsection 2(5)Footnote a of the Divorce ActFootnote b, hereby makes the annexed Order Designating the Province of Quebec for the Purposes of the Definition “applicable guidelines” in Subsection 2(1) of the Divorce Act.

Designation

 The Province of Quebec is hereby designated for the purposes of the definition applicable guidelines in subsection 2(1) of the Divorce Act.

Guidelines

 For the purposes of subsection 2(5) of the Divorce Act, the following legislative texts are the laws that constitute the comprehensive guidelines for the Province of Quebec:

  • (a) An Act to amend the Civil Code of Québec and the Code of Civil Procedure as regards the determination of child support payments, S.Q. 1996, c. 68;

  • (b) the Regulation respecting the determination of child support payments, made by Order 484-97 of April 9, 1997;

  • (c) Title Three of Book Two of the Civil Code of Quebec, S.Q. 1991, c. 64; and

  • (d) Chapter VI.1 of Title IV of Book V of the Code of Civil Procedure, R.S.Q., c. C-25.

Coming into Force

 This Order comes into force on May 1, 1997.
