lims:inforce-start-date="2003-01-01" lims:fid="61711" lims:id="61711"><Label>(a)</Label><Text>to promote health and safety in the workplace in Canada and the physical and mental health of working people in Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="61712" lims:id="61712"><Label>(b)</Label><Text>to facilitate</Text><Subparagraph lims:inforce-start-date="2003-01-01" lims:fid="61713" lims:id="61713"><Label>(i)</Label><Text>consultation and cooperation among federal, provincial and territorial jurisdictions, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2003-01-01" lims:fid="61714" lims:id="61714"><Label>(ii)</Label><Text>participation by labour and management</Text></Subparagraph><ContinuedParagraph lims:inforce-start-date="2003-01-01" lims:fid="61715" lims:id="61715"><Text>in the establishment and maintenance of high standards of occupational health and safety appropriate to the Canadian situation;</Text></ContinuedParagraph></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="61716" lims:id="61716"><Label>(c)</Label><Text>to assist in the development and maintenance of policies and programs aimed at the reduction or elimination of occupational hazards; and</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="61717" lims:id="61717"><Label>(d)</Label><Text>to serve as a national centre for statistics and other information lims:inforce-start-date="2003-01-01" lims:fid="61721" lims:id="61721">Activities and powers of Centre</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2003-01-01" lims:fid="61722" lims:id="61722"><Label>(1)</Label><Text>The Centre may, in furtherance of its objects,</Text><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="61723" lims:id="61723"><Label>(a)</Label><Text>promote, assist, initiate and evaluate research;</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="61724" lims:id="61724"><Label>(b)</Label><Text>establish and operate systems and facilities for collecting, recording, processing, analysing, evaluating and disseminating statistics and other information;</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="61725" lims:id="61725"><Label>(c)</Label><Text>publish and otherwise disseminate scientific, technological and other information;</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="61726" lims:id="61726"><Label>(d)</Label><Text>provide advice, information and service relating to existing or anticipated occupational health and safety problems to workers, trade unions, employers and government, to national, provincial and international organizations and to the public;</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="61727" lims:id="61727"><Label>(e)</Label><Text>support and facilitate the training of personnel in and for the field of occupational health and safety;</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="61728" lims:id="61728"><Label>(f)</Label><Text>sponsor and support public meetings, conferences and seminars;</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="61729" lims:id="61729"><Label>(g)</Label><Text>expend, for the purposes of this Act, any money appropriated by Parliament for the work of the Centre or received by the Centre through the conduct of its operations;</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="61730" lims:id="61730"><Label>(h)</Label><Text>give recognition to public or private organizations or individuals for outstanding contributions in the field of occupational health and safety; and</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="61731" lims:id="61731"><Label>(i)</Label><Text>do such other things as are conducive to the carrying out of its objects.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="61732" lims:id="61732"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="61733" lims:id="61733">Centre to consider briefs and other representations</MarginalNote><Label>(2)</Label><Text>The Centre shall consider briefs and other written representations submitted to it on matters relating to occupational health and safety and may arrange public forums relating thereto.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="61734" lims:id="61734"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="61735" lims:id="61735">Donations</MarginalNote><Label>(3)</Label><Text>The Centre may acquire money, securities or other property by gift, bequest or otherwise and, notwithstanding anything in this Act, may expend, administer or dispose of the money, securities or other property subject to the terms, if any, on which the money, securities or other property is given, bequeathed or otherwise made available to the Centre.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="61736" lims:id="61736"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="61737" lims:id="61737">Ancillary powers</MarginalNote><Label>(4)</Label><Text>For the purposes of carrying out its activities under subsections (1) to (3), the Centre has the capacity, rights, powers and privileges of a natural person.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2012-06-29" lims:fid="61740" lims:id="61740" level="1"><TitleText>Members of the Council</TitleText></Heading><Section lims:inforce-start-date="2003-01-01" lims:lastAmendedDate="2003-01-01" lims:fid="61741" lims:id="61741"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="61742" lims:id="61742">Chairman</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2003-01-01" lims:fid="61743" lims:id="61743"><Label>(1)</Label><Text>The Chairman shall be appointed to hold office during good behaviour for a term not exceeding five years, but may be removed by the Governor in Council for cause.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="61744" lims:id="61744"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="61745" lims:id="61745">Duties of Chairman</MarginalNote><Label>(2)</Label><Text>The Chairman shall preside at meetings of the Council and may perform such other duties as are assigned to the Chairman by the Council.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="61746" lims:id="61746"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="61747" lims:id="61747">Acting Chairman</MarginalNote><Label>(3)</Label><Text>The Council may authorize one of the governors to act as Chairman if the Chairman is absent or incapacitated or the office of Chairman is vacant, but no person so authorized may act as Chairman for a period exceeding ninety days without the approval of the Governor in Council.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="61748" lims:id="61748"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="61749" lims:id="61749">Eligibility of Chairman for re-appointment</MarginalNote><Label>(4)</Label><Text>A person who has served two consecutive terms as Chairman is eligible to be re-appointed to the Council but is not, during the twelve months following the completion of the second term as Chairman, eligible to be re-appointed Chairman.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2003-01-01" lims:fid="61751" lims:id="61751">1977-78, c. 29, s. 6</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2003-01-01" lims:lastAmendedDate="2003-01-01" lims:fid="61752" lims:id="61752"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="61753" lims:id="61753">Other governors</MarginalNote><Label>8</Label><Subsection lims:inforce-start-date="2003-01-01" lims:fid="61754" lims:id="61754"><Label>(1)</Label><Text>Each of the governors other than the Chairman shall be appointed to hold office during pleasure for such term not exceeding four years as will ensure as far as possible the expiration in any one year of the terms of appointment of fewer than half of the governors so appointed.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="61755" lims:id="61755"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="61756" lims:id="61756">Temporary substitute governor</MarginalNote><Label>(2)</Label><Text>In the event of the absence or incapacity of a governor other than the Chairman, the Council may, on such terms and conditions as it may prescribe and after such consultation as is appropriate in the circumstances, appoint a temporary substitute governor, but no temporary substitute governor may serve for a period exceeding ninety days without the approval of the Governor in Council.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="61757" lims:id="61757"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="61758" lims:id="61758">Eligibility of governor for re-appointment</MarginalNote><Label>(3)</Label><Text>A person who has served two consecutive terms as a governor appointed under subsection (1) is not, during the twelve months following the completion of the second term, eligible to be re-appointed to the Council, except as Chairman.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2003-01-01" lims:fid="61767" lims:id="61767">Appointment of President</MarginalNote><Label>10</Label><Subsection lims:inforce-start-date="2003-01-01" lims:fid="61768" lims:id="61768"><Label>(1)</Label><Text>The President of the Centre shall be appointed by the Governor in Council after consultation with the Council, for a term not exceeding five years.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="61769" lims:id="61769"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="61770" lims:id="61770">Tenure of President</MarginalNote><Label>(2)</Label><Text>Every President holds office during good behaviour, but may be removed by the Governor in Council for cause.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="61771" lims:id="61771"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="61772" lims:id="61772">Where appointee is a governor</MarginalNote><Label>(3)</Label><Text>Where the person appointed President is a governor, he ceases to be a governor on assuming the office of lims:id="61777"><Label>(1)</Label><Text>The President is the chief executive officer of the Centre, has supervision over and direction of the work and staff of the Centre, is the chairman of the executive board and shall perform such duties as are assigned to the President by the Council.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="61778" lims:id="61778"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="61779" lims:id="61779">President to be full-time</MarginalNote><Label>(2)</Label><Text>The President shall devote the whole of his time to the performance of the duties of the President under this Act.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2003-01-01" lims:fid="61781" lims:id="61782"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="61783" lims:id="61783">Acting President</MarginalNote><Label>12</Label><Text>The Council may authorize an officer of the Centre to act as President if the President is absent or incapacitated or the office of President is vacant, but no person so authorized may act as President for a period exceeding sixty days without board established</MarginalNote><Label>14</Label><Subsection lims:inforce-start-date="2012-03-16" lims:fid="61793" lims:id="61793"><Label>(1)</Label><Text>There is hereby established an executive board of the Centre consisting of the President and at least six governors annually elected from the Council by the governors so that, at any time,</Text><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="61794" lims:id="61794"><Label>(a)</Label><Text>the number of members of the executive board who were appointed to the Council under paragraph 4(c) is equal to the number of members of the executive board who were appointed to the Council under paragraph 4(d); and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="61795" lims:id="61795"><Label>(b)</Label><Text>the aggregate of the number of members of the executive board appointed to the Council under paragraph 4(c) or (d) is not less than 50% of the total number of
