<?xml version="1.0"?><Regulation lims:pit-date="2026-06-22" hasPreviousVersion="true" lims:lastAmendedDate="2026-06-22" lims:current-date="2026-07-21" lims:inforce-start-date="2006-03-22" lims:fid="558527" lims:id="558527" regulation-type="SOR" xml:lang="en" xmlns:lims="http://justice.gc.ca/lims"><Identification lims:inforce-start-date="2006-03-22" lims:fid="558528" lims:id="558528"><InstrumentNumber>C.R.C., c. 603</InstrumentNumber><ConsolidationDate lims:inforce-start-date="2006-03-22"><Date><YYYY>2026</YYYY><MM>7</MM><DD>22</DD></Date></ConsolidationDate><EnablingAuthority lims:inforce-start-date="2006-03-22" lims:fid="558530" lims:id="558530"><XRefExternal reference-type="act" link="E-19">EXPORT AND IMPORT PERMITS ACT</XRefExternal></EnablingAuthority><ShortTitle lims:inforce-start-date="2006-03-22" lims:fid="558531" lims:id="558531">Import Certificate Regulations</ShortTitle><LongTitle lims:inforce-start-date="2006-03-22" lims:fid="558532" lims:id="558532">Regulations Respecting Import Certificates</LongTitle></Identification><Body lims:inforce-start-date="2006-03-22" lims:fid="558533" lims:id="558533"><Heading lims:inforce-start-date="2006-03-22" lims:fid="558534" lims:id="558534" level="1"><TitleText>Short Title</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="558535" lims:id="558535"><Label>1</Label><Text>These Regulations may be cited as the <XRefExternal reference-type="regulation" link="C.R.C.,_c._603">Import Certificate Regulations</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="558536" lims:id="558536" level="1"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2026-06-22" lims:fid="558537" lims:id="558537"><Label>2</Label><Subsection lims:inforce-start-date="2026-06-22" lims:enacted-date="2026-06-22" lims:fid="558538" lims:id="1592917"><Label>(1)</Label><Text>These Regulations apply to any import certificate that is issued by the Minister concerning goods for which such a certificate is required by the country of export before it will allow their export to Canada.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="558539" lims:id="558539"><Label>(2)</Label><Text>Where an applicant has applied for an import certificate, it shall be deemed, for the purpose of these Regulations and the <XRefExternal reference-type="act" link="E-19">Export and Import Permits Act</XRefExternal>, that the import certificate is required by the exporting country he has named in his application before it will allow the export of the goods to Canada.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2026-06-22" lims:enacted-date="2026-06-22" lims:fid="1592916" lims:id="1592916" lims:enactId="1590360">SOR/2026-151, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="558540" lims:id="558540" level="1"><TitleText>Application for Certificates</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="558541" lims:id="558541"><Label>3</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="558542" lims:id="558542"><Label>(1)</Label><Text>An application for an import certificate shall be made only by a resident of Canada, that is to say, if the applicant is a natural person, he shall be a person who ordinarily resides in Canada and, if the applicant is a corporation, it shall be a corporation having its head office in Canada or operating a branch office in Canada.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="558543" lims:id="558543"><Label>(2)</Label><Text>No person shall apply for an import certificate unless he intends to import the goods into Canada.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2026-06-22" lims:fid="558544" lims:id="558544"><Label>4</Label><Subsection lims:inforce-start-date="2026-06-22" lims:enacted-date="2026-06-22" lims:fid="558545" lims:id="1592923"><Label>(1)</Label><Text>An application for an import certificate shall be made on a form published by the Department of Foreign Affairs, Trade and Development.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="558546" lims:id="558546"><Label>(2)</Label><Text>An applicant shall furnish all information required in the application form and, without restricting the generality of the foregoing, shall, in particular,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="558547" lims:id="558547"><Label>(a)</Label><Text>describe the goods concerned in sufficient detail as to disclose their true identity and, in so doing, avoid the use of trade names, technical names or general terms that do not adequately describe the goods; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="558548" lims:id="558548"><Label>(b)</Label><Text>truthfully certify that he intends to import those goods into Canada and that he will not cause or assist in their disposal or diversion to any other person during transit.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2026-06-22" lims:enacted-date="2026-06-22" lims:fid="558549" lims:id="1592924"><Label>(3)</Label><Text>An applicant shall furnish such other information, in addition to that given in the application form, as may be required by the Minister.</Text></Subsection><Subsection lims:inforce-start-date="2026-06-22" lims:enacted-date="2026-06-22" lims:fid="558550" lims:id="1592925"><Label>(4)</Label><Text>The completed application form, together with the information required under subsection (3), if any, shall be sent to the Minister.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2026-06-22" lims:enacted-date="2026-06-22" lims:fid="1592919" lims:id="1592919" lims:enactId="1590351">SOR/2026-151, s. 1</HistoricalNoteSubItem><HistoricalNoteSubItem lims:inforce-start-date="2026-06-22" lims:enacted-date="2026-06-22" lims:fid="1592922" lims:id="1592922" lims:enactId="1590360">SOR/2026-151, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="558551" lims:id="558551" level="1"><TitleText>Issue of Certificates</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2026-06-22" lims:fid="558552" lims:id="558552"><Label>5</Label><Subsection lims:inforce-start-date="2026-06-22" lims:enacted-date="2026-06-22" lims:fid="558553" lims:id="1592931"><Label>(1)</Label><Text>An application for an import certificate becomes an import certificate when it is signed by the Minister, and that certificate shall not be altered by anyone other than the Minister.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="558554" lims:id="558554"><Label>(2)</Label><Text>The import certificate and a copy thereof shall be sent to the applicant.</Text></Subsection><Subsection lims:inforce-start-date="2026-06-22" lims:enacted-date="2026-06-22" lims:fid="558555" lims:id="1592932"><Label>(3)</Label><Text>In any proceedings under the <XRefExternal reference-type="act" link="E-19">Export and Import Permits Act</XRefExternal>, a document, purporting to be certified by the Minister to be a true copy of an import certificate, is <Language xml:lang="la">prima facie</Language> evidence of the original document of which it purports to be a copy and that the same was issued at the time stated in the certificate and is signed, certified, attested or executed by the persons by whom and in the manner in which the same purports to be signed, certified, attested or executed as shown or appearing from such certified copy.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2026-06-22" lims:enacted-date="2026-06-22" lims:fid="1592927" lims:id="1592927" lims:enactId="1590356">SOR/2026-151, s. 2</HistoricalNoteSubItem><HistoricalNoteSubItem lims:inforce-start-date="2026-06-22" lims:enacted-date="2026-06-22" lims:fid="1592930" lims:id="1592930" lims:enactId="1590360">SOR/2026-151, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="558556" lims:id="558556" level="1"><TitleText>Prohibitions</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2026-06-22" lims:fid="558557" lims:id="558557"><Label>6</Label><Text lims:inforce-start-date="2026-06-22" lims:enacted-date="2026-06-22" lims:fid="1590393" lims:id="1592934">Unless otherwise authorized by the Minister, no person shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="558558" lims:id="558558"><Label>(a)</Label><Text>with respect to goods for which an import certificate has been issued and prior to their being received by the person to whom the certificate was issued, cause or assist in the disposal or diversion of such goods to any person other than the person to whom the certificate was issued;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="558559" lims:id="558559"><Label>(b)</Label><Text>use an import certificate in any manner other than in accordance with the information and certifications appearing in the import certificate; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="558560" lims:id="558560"><Label>(c)</Label><Text>being the person to whom an import certificate was issued, refuse or otherwise fail to make any report or provide any information required by or under these Regulations.</Text></Paragraph><HistoricalNote>SOR/2026-151, s. 3</HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="558561" lims:id="558561" level="1"><TitleText>Duration</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="558562" lims:id="558562"><Label>7</Label><Text>An import certificate is not valid beyond the expiry date specified therein.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="558563" lims:id="558563" level="1"><TitleText>Reports</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2026-06-22" lims:fid="558564" lims:id="558564"><Label>8</Label><Text lims:inforce-start-date="2026-06-22" lims:enacted-date="2026-06-22" lims:fid="1590408" lims:id="1592937">The following reports shall, where applicable, be made, in writing, to the Minister by a person to whom an import certificate has been issued:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="558565" lims:id="558565"><Label>(a)</Label><Text>an immediate report, with full particulars, of any information he receives that the certificate or any part of the goods to which it relates has been or will be dealt with by the exporter or any other person otherwise than in accordance with the terms of the certificate or the requirements of these Regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="558566" lims:id="558566"><Label>(b)</Label><Text>a report of the arrival of the goods in Canada, together with a true copy of the customs entry document covering them and bearing the stamp of the collector of customs at the Canadian port of entry;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="558567" lims:id="558567"><Label>(c)</Label><Text>a report of any proposal to export the goods from Canada; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="558568" lims:id="558568"><Label>(d)</Label><Text>if the goods have not arrived in Canada before the expiry date of the certificate, a report of that fact together with such information as he may have as to the reasons for the delay and the whereabouts of the goods.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2026-06-22" lims:enacted-date="2026-06-22" lims:fid="1592936" lims:id="1592936" lims:enactId="1590360">SOR/2026-151, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="558569" lims:id="558569" level="1"><TitleText>Delivery Verification Certificates</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2026-06-22" lims:fid="558570" lims:id="558570"><Label>9</Label><Subsection lims:inforce-start-date="2026-06-22" lims:enacted-date="2026-06-22" lims:fid="558571" lims:id="1592940"><Label>(1)</Label><Text>Delivery verification certificates of the delivery in Canada of goods imported into Canada may be granted by the Minister to any person who requests such certificate in order to comply with or assist his exporter in complying with the requirements of the country of export of the goods.</Text></Subsection><Subsection lims:inforce-start-date="2026-06-22" lims:enacted-date="2026-06-22" lims:fid="558572" lims:id="1592941"><Label>(2)</Label><Text>Delivery verification certificates shall not be issued unless a report of the arrival of the goods in Canada, together with a true copy of the customs entry documents covering them and bearing the stamp of the collector of customs at the Canadian port of entry, has been made, in writing, to the Minister.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2026-06-22" lims:enacted-date="2026-06-22" lims:fid="1592939" lims:id="1592939" lims:enactId="1590360">SOR/2026-151, s. 4</HistoricalNoteSubItem></HistoricalNote></Section></Body><RecentAmendments><Amendment><AmendmentCitation>SOR/2026-151</AmendmentCitation><AmendmentDate>2026-06-22</AmendmentDate></Amendment></RecentAmendments></Regulation>
