lims:id="384869"><Label>(b)</Label><Text>any place not belonging to Her Majesty where any munitions of war or any sketches, plans, models or documents relating thereto are being made, repaired, obtained or stored under contract with, or with any person on behalf of, Her Majesty or otherwise on behalf of Her Majesty, and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="384870" lims:id="384870"><Label>(c)</Label><Text>any place that is for the time being declared by order of the Governor in Council to be a prohibited place on the ground that information lims:id="384878">Communicating or receiving</MarginalNote><Label>(3)</Label><Text>In this Act,</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="384879" lims:id="384879"><Label>(a)</Label><Text>expressions referring to communicating or receiving include any communicating or receiving, whether in whole or in part, and whether the sketch, plan, model, article, note, document or information itself or the substance, effect or description thereof only is communicated or received;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="384880" lims:id="384880"><Label>(b)</Label><Text>expressions referring to obtaining or retaining any sketch, plan, model, article, note or document include the copying of, or causing to be copied, the whole or any part of any sketch, plan, model, article, note or document; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="384881" lims:id="384881"><Label>(c)</Label><Text>expressions referring to the communication of any sketch, plan, model, article, note or document include the transfer or transmission of the sketch, plan, model, article, note or document.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="384882" lims:id="384882"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="384883" lims:id="384883">Facilitation</MarginalNote><Label>(4)</Label><Text>For greater certainty, subsection 83.01(2) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> applies for the purposes of the definitions <DefinitionRef>terrorist activity</DefinitionRef> and <DefinitionRef>terrorist group</DefinitionRef> in subsection lims:id="384886"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="384887" lims:id="384887">Prejudice to the safety or interest of the State</MarginalNote><Label>3</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="384888" lims:id="384888"><Label>(1)</Label><Text>For the purposes of this Act, a purpose is prejudicial to the safety or interests of the State if a person</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="384889" lims:id="384889"><Label>(a)</Label><Text>commits, in Canada, an offence against the laws of Canada or a province that is punishable by a maximum term of imprisonment of two years or more in order to advance a political, religious or ideological purpose, objective or cause or to benefit a foreign entity or terrorist group;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="384890" lims:id="384890"><Label>(b)</Label><Text>commits, inside or outside Canada, a terrorist activity;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="384891" lims:id="384891"><Label>(c)</Label><Text>causes or aggravates an urgent and critical situation in Canada that</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="384892" lims:id="384892"><Label>(i)</Label><Text>endangers the lives, health or safety of Canadians, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="384893" lims:id="384893"><Label>(ii)</Label><Text>threatens the ability of the Government of Canada to preserve the sovereignty, security or territorial integrity of Canada;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="384894" lims:id="384894"><Label>(d)</Label><Text>interferes with a service, facility, system or computer program, whether public or private, or its operation, in a manner that has significant adverse impact on the health, safety, security or economic or financial well-being of the people of Canada or the functioning of any government in Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="384895" lims:id="384895"><Label>(e)</Label><Text>endangers, outside Canada, any person by reason of that person’s relationship with Canada or a province or the fact that the person is doing business with or on behalf of the Government of Canada or of a province;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="384896" lims:id="384896"><Label>(f)</Label><Text>damages property outside Canada because a person or entity with an interest in the property or occupying the property has a relationship with Canada or a province or is doing business with or on behalf of the Government of Canada or of a province;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="384897" lims:id="384897"><Label>(g)</Label><Text>impairs or threatens the military capability of the Canadian Forces, or any part of the Canadian Forces;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="384898" lims:id="384898"><Label>(h)</Label><Text>interferes with the design, development or production of any weapon or defence equipment of, or intended for, the Canadian Forces, including any hardware, software or system that is part of or associated with any such weapon or defence equipment;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="384899" lims:id="384899"><Label>(i)</Label><Text>impairs or threatens the capabilities of the Government of Canada in relation to security and intelligence;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="384900" lims:id="384900"><Label>(j)</Label><Text>adversely affects the stability of the Canadian economy, the financial system or any financial market in Canada without reasonable economic or financial justification;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="384901" lims:id="384901"><Label>(k)</Label><Text>impairs or threatens the capability of a government in Canada, or of the Bank of Canada, to protect against, or respond to, economic or financial threats or instability;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="384902" lims:id="384902"><Label>(l)</Label><Text>impairs or threatens the capability of the Government of Canada to conduct diplomatic or consular relations, or conduct and manage international negotiations;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="384903" lims:id="384903"><Label>(m)</Label><Text>contrary to a treaty to which Canada is a party, develops or uses anything that is intended or has the capability to cause death or serious bodily injury to a significant number of people by means of</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="384904" lims:id="384904"><Label>(i)</Label><Text>toxic or poisonous chemicals or their precursors,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="384905" lims:id="384905"><Label>(ii)</Label><Text>a microbial or other biological agent, or a toxin, including a disease organism,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="384906" lims:id="384906"><Label>(iii)</Label><Text>radiation or radioactivity, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="384907" lims:id="384907"><Label>(iv)</Label><Text>an explosion; or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="384908" lims:id="384908"><Label>(n)</Label><Text>does or omits to do anything that is directed towards or in preparation of the undertaking of an activity mentioned in any of paragraphs (a) to (m).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="384909" lims:id="384909"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="384910" lims:id="384910">Harm to Canadian interests</MarginalNote><Label>(2)</Label><Text>For the purposes of this Act, harm is caused to Canadian interests if a foreign entity or terrorist group does anything referred to in any of paragraphs (1)(a) to (n).</Text></Subsection><HistoricalNote><HistoricalNoteSubItem O-5, s. 3; 2001, c. 41, s. 27</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2013-07-15" lims:fid="384913" lims:id="384913" level="1"><TitleText>Offences</TitleText></Heading><Heading lims:inforce-start-date="2013-07-15" lims:fid="384914" lims:id="384914" level="2"><TitleText>Miscellaneous Offences</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="384915" lims:id="384915"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="384916" lims:id="384916">Wrongful communication, etc., of information</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="384917" lims:id="384917"><Label>(1)</Label><Text>Every person is guilty of an offence under this Act who, having in his possession or control any secret official code word, password, sketch, plan, model, article, note, document or information that relates to or is used in a prohibited place or anything in a prohibited place, or that has been made or obtained in contravention of this Act, or that has been entrusted in confidence to him by any person holding office under Her Majesty, or that he has obtained or to which he has had access while subject to the Code of Service Discipline within the meaning of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal> or owing to his position as a person who holds or has held office under Her Majesty, or as a person who holds or has held a contract made on behalf of Her Majesty, or a contract the performance of which in whole or in part is carried out in a prohibited place, or as a person who is or has been employed under a person who holds or has held such an office or contract,</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="384918" lims:id="384918"><Label>(a)</Label><Text>communicates the code word, password, sketch, plan, model, article, note, document or information to any person, other than a person to whom he is authorized to communicate with, or a person to whom it is in the interest of the State his duty to communicate it;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="384919" lims:id="384919"><Label>(b)</Label><Text>uses the information in his possession for the benefit of any foreign power or in any other manner prejudicial to the safety or interests of the State;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="384920" lims:id="384920"><Label>(c)</Label><Text>retains the sketch, plan, model, article, note, or document in his possession or control when he has no right to retain it or when it is contrary to his duty to retain it or fails to comply with all directions issued by lawful authority with regard to the return or disposal thereof; or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="384921" lims:id="384921"><Label>(d)</Label><Text>fails to take reasonable care of, or so conducts himself as to endanger the safety of, the secret official code word, password, sketch, plan, model, article, note, document or information.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="384922" lims:id="384922"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="384923" lims:id="384923">Communication of sketch, plan, model, etc.</MarginalNote><Label>(2)</Label><Text>Every person is guilty of an offence under this Act who, having in his possession or control any sketch, plan, model, article, note, document or information that relates to munitions of war, communicates it, directly or indirectly, to any foreign power, or in any other manner prejudicial to the safety or interests of the State.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="384924" lims:id="384924"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="384925" lims:id="384925">Receiving code word, sketch, etc.</MarginalNote><Label>(3)</Label><Text>Every person who receives any secret official code word, password, sketch, plan, model, article, note, document or information, knowing, or having reasonable ground to believe, at the time he receives it, that the code word, password, sketch, plan, model, article, note, document or information is communicated to him in contravention of this Act, is guilty of an offence under this Act, unless he proves that the communication to him of the code word, password, sketch, plan, model, article, note, document or information was contrary to his desire.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="384926" lims:id="384926"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="384927" lims:id="384927">Retaining or allowing possession of document, etc.</MarginalNote><Label>(4)</Label><Text>Every person is guilty of an offence under this Act who</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="384928" lims:id="384928"><Label>(a)</Label><Text>retains for any purpose prejudicial to the safety or interests of the State any official document, whether or not completed or issued for use, when he has no right to retain it, or when it is contrary to his duty to retain it, or fails to comply with any directions issued by any Government department or any person authorized by any Government department with regard to the return or disposal thereof; or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="384929" lims:id="384929"><Label>(b)</Label><Text>allows any other person to have possession of any official document issued for his use alone, or communicates any secret official code word or password so issued, or, without lawful authority or excuse, has in his possession any official document or secret official code word or password issued for the use of a person other than himself, or on obtaining possession of any official document by finding or otherwise, neglects or fails to restore it to the person or authority by whom or for whose use it was issued, or to a police constable.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="384931" lims:id="384931">R.S., c. O-3, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="384932" lims:id="384932"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="384933" lims:id="384933">Unauthorized use of uniforms; falsification of reports, forgery, personation and false documents</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="384934" lims:id="384934"><Label>(1)</Label><Text>Every person is guilty of an offence under this Act who, for the purpose of gaining admission, or of assisting any other person to gain admission, to a prohibited place, or for any other purpose prejudicial to the safety or interests of the State,</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="384935" lims:id="384935"><Label>(a)</Label><Text>uses or wears, without lawful authority, any military, police or other official uniform or any uniform so nearly resembling such a uniform as to be calculated to deceive, or falsely represents himself to be a person who is or has been entitled to use or wear any such uniform;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="384936" lims:id="384936"><Label>(b)</Label><Text>orally or in writing in any declaration or application, or in any document signed by him or on his behalf, knowingly makes or connives at the making of any false statement or omission;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="384937" lims:id="384937"><Label>(c)</Label><Text>forges, alters or tampers with any passport or any military, police or official pass, permit, certificate, licence or other document of a similar character, in this section referred to as an official document, or uses or has in his possession any such forged, altered or irregular official document;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="384938" lims:id="384938"><Label>(d)</Label><Text>personates or falsely represents himself to be a person holding, or to be in the employment of a person holding, office under Her Majesty, or to be or not to be a person to whom an official document or secret official code word or password has been duly issued or communicated, or with intent to obtain an official document, secret official code word or password, whether for himself or any other person, knowingly makes any false statement; or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="384939" lims:id="384939"><Label>(e)</Label><Text>uses, or has in his possession or under his control, without the authority of the Government department or the authority concerned, any die, seal or stamp of or belonging to, or used, made or provided by, any Government department, or by any diplomatic or military authority appointed by or acting under the authority of Her Majesty, or any die, seal or stamp so nearly resembling any such die, seal or stamp as to be calculated to deceive, or counterfeits any such die, seal or stamp, or uses, or has in his possession or under his control, any such counterfeited die, seal or stamp.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="384940" lims:id="384940"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="384941" lims:id="384941">Unlawful dealing with dies, seals, etc.</MarginalNote><Label>(2)</Label><Text>Every person who, without lawful authority or excuse, manufactures or sells, or has in his possession for sale, any die, seal or stamp referred to in subsection (1) is guilty of an offence under this Act.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="384943" lims:id="384943">R.S., c. O-5, s. 7; 2001, c. 41, s. 29</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2013-07-15" lims:fid="384952" lims:id="384952" level="2"><TitleText>Special Operational Information and Persons Permanently Bound to Secrecy</TitleText></Heading><Section lims:inforce-start-date="2017-10-06" lims:lastAmendedDate="2024-08-19" lims:fid="384953" lims:id="384953"><MarginalNote lims:inforce-start-date="2017-10-06" lims:fid="384954" lims:id="384954">Definitions</MarginalNote><Label>8</Label><Subsection lims:inforce-start-date="2017-10-06" lims:fid="384955" lims:id="384955"><Label>(1)</Label><Text>The following definitions apply in this section and sections 9 to 15.</Text><Definition lims:inforce-start-date="2017-10-06" lims:fid="384956" lims:id="384956"><Text><DefinedTermEn>department</DefinedTermEn> means a department named in Schedule I to the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal>, a division or branch of the federal public administration set out in column I of Schedule I.1 to that Act and a corporation named in Schedule II to that Act. (<DefinedTermFr>ministère</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-10-06" lims:fid="384957" lims:id="384957"><Text><DefinedTermEn>government contractor</DefinedTermEn> means a person who has entered into a contract or arrangement with Her Majesty in right of Canada, a department, board or agency of the Government of Canada or a Crown corporation as defined in subsection 83(1) of the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal>, and includes an employee of the person, a subcontractor of the person and an employee of the subcontractor. (<DefinedTermFr>partie à un contrat administratif</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-10-06" lims:fid="384958" lims:id="384958"><Text><DefinedTermEn>person permanently bound to secrecy</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2024-08-19" lims:enacted-date="2024-06-20" lims:fid="384959" lims:id="1487745"><Label>(a)</Label><Text>a current or former member or employee of a department, division, branch or office of the federal public administration, or any of its parts, set out in Schedule 1;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="384960" lims:id="1192285"><Label>(a.1)</Label><Text>a current or former member of the National Security and Intelligence Review Agency;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-08-19" lims:enacted-date="2024-06-20" lims:fid="1192286" lims:id="1487748"><Label>(a.2)</Label><Text>a current or former member of the National Security and Intelligence Committee of Parliamentarians;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-08-19" lims:enacted-date="2024-06-20" lims:fid="1487749" lims:id="1487749"><Label>(a.3)</Label><Text>a current or former officer or non-commissioned member of a Canadian Forces unit or other element, or any of its parts, set out in Schedule 2 or a current or former officer or non-commissioned member who occupies or occupied a position in the Canadian Forces set out in that Schedule;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-08-19" lims:enacted-date="2024-06-20" lims:fid="1487750" lims:id="1487750"><Label>(a.4)</Label><Text>a person who is or was appointed, attached, assigned or seconded to a Canadian Forces unit or other element, or any of its parts, set out in Schedule 2 or to a position in the Canadian Forces set out in that Schedule; or</Text></Paragraph><Paragraph lims:inforce-start-date="2017-10-06" lims:fid="384961" lims:id="384961"><Label>(b)</Label><Text>a person who has been personally served with a notice issued under subsection 10(1) in respect of the person or who has been informed, in accordance with regulations made under subsection 11(2), of the issuance of such a notice in respect of the person. (<DefinedTermFr>personne astreinte au secret à perpétuité</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2017-10-06" lims:fid="384962" lims:id="384962"><Text><DefinedTermEn>special operational information</DefinedTermEn> means information that the Government of Canada is taking measures to safeguard that reveals, or from which may be inferred,</Text><Paragraph lims:inforce-start-date="2017-10-06" lims:fid="384963" lims:id="384963"><Label>(a)</Label><Text>the identity of a person, agency, group, body or entity that was, is or is intended to be, has been approached to be, or has offered or agreed to be, a confidential source of information, intelligence or assistance to the Government of Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-10-06" lims:fid="384964" lims:id="384964"><Label>(b)</Label><Text>the nature or content of plans of the Government of Canada for military operations in respect of a potential, imminent or present armed conflict;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-10-06" lims:fid="384965" lims:id="384965"><Label>(c)</Label><Text>the means that the Government of Canada used, uses or intends to use, or is capable of using, to covertly collect or obtain, or to decipher, assess, analyse, process, handle, report, communicate or otherwise deal with information or intelligence, including any vulnerabilities or limitations of those means;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-10-06" lims:fid="384966" lims:id="384966"><Label>(d)</Label><Text>whether a place, person, agency, group, body or entity was, is or is intended to be the object of a covert investigation, or a covert collection of information or intelligence, by the Government of Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-10-06" lims:fid="384967" lims:id="384967"><Label>(e)</Label><Text>the identity of any person who is, has been or is intended to be covertly engaged in an information- or intelligence-collection activity or program of the Government of Canada that is covert in nature;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-08-19" lims:enacted-date="2024-06-20" lims:fid="1487746" lims:id="1487746"><Label>(e.1)</Label><Text>the military vulnerabilities or advantages of the Canadian Forces, including the operational or technical vulnerabilities and advantages of any ally or adversary;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-08-19" lims:enacted-date="2024-06-20" lims:fid="384968" lims:id="1487747"><Label>(f)</Label><Text>the means that the Government of Canada used, uses or intends to use, or is capable of using, to protect or exploit any information or intelligence referred to in any of paragraphs (a) to (e.1), including, but not limited to, encryption and cryptographic systems, and any vulnerabilities or limitations of those means; or</Text></Paragraph><Paragraph lims:inforce-start-date="2017-10-06" lims:fid="384969" lims:id="384969"><Label>(g)</Label><Text>information or intelligence similar in nature to information or intelligence referred to in any of paragraphs (a) to (f) that is in relation to, or received from, a foreign entity or terrorist group. (<DefinedTermFr>renseignements opérationnels spéciaux</DefinedTermFr>)</Text></Paragraph></Definition></Subsection><Subsection lims:inforce-start-date="2017-10-06" lims:fid="384970" lims:id="384970"><MarginalNote lims:inforce-start-date="2017-10-06" lims:fid="384971" lims:id="384971">Deputy head</MarginalNote><Label>(2)</Label><Text>For the purposes of subsections 10(1) and 15(5), the deputy head is</Text><Paragraph lims:inforce-start-date="2017-10-06" lims:fid="384972" lims:id="384972"><Label>(a)</Label><Text>for an individual employed in or attached or seconded to a department, the deputy head of the department;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-10-06" lims:fid="384973" lims:id="384973"><Label>(b)</Label><Text>for an officer or a non-commissioned member of the Canadian Forces, the Chief of the Defence Staff;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-10-06" lims:fid="384974" lims:id="384974"><Label>(c)</Label><Text>for a person who is a member of the exempt staff of a Minister responsible for a department, the deputy head of the department;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-10-06" lims:fid="384975" lims:id="384975"><Label>(d)</Label><Text>for a government contractor in relation to a contract with</Text><Subparagraph lims:inforce-start-date="2017-10-06" lims:fid="384976" lims:id="384976"><Label>(i)</Label><Text>the Department of Public Works and Government Services, the deputy head of that department or any other deputy head authorized for the purpose by the Minister of Public Works and Government Services,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-10-06" lims:fid="384977" lims:id="384977"><Label>(ii)</Label><Text>any other department, the deputy head of that department, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-10-06" lims:fid="384978" lims:id="384978"><Label>(iii)</Label><Text>a Crown Corporation within the meaning of subsection 83(1) of the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal>, the deputy head of the department of the minister responsible for the Crown Corporation; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2017-10-06" lims:fid="384979" lims:id="384979"><Label>(e)</Label><Text>for any other person, the Clerk of the Privy Council or a person authorized for the purpose by the Clerk of the Privy Council.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2017-10-06" lims:fid="384981" lims:id="384981">R.S., 1985, c. and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="384990" lims:id="384990"><Label>(b)</Label><Text>it is in the interest of national security to designate the person.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="384991" lims:id="384991"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="384992" lims:id="384992">Contents</MarginalNote><Label>(2)</Label><Text>The notice must</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="384993" lims:id="384993"><Label>(a)</Label><Text>specify the name of the person in respect of whom it is issued;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="384994" lims:id="384994"><Label>(b)</Label><Text>specify the office held, position occupied or duties performed by the person or the contract or arrangement in respect of which the person is a government contractor, as the case may be, that led to the designation; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="384995" lims:id="384995"><Label>(c)</Label><Text>state that the person named in the notice is a person permanently bound to secrecy for the purposes of sections 13 and 14.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="384996" lims:id="384996"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="384997" lims:id="384997">Exceptions</MarginalNote><Label>(3)</Label><Text>The following persons may not be designated as persons permanently bound to secrecy, but they continue as such if they were persons permanently bound to secrecy before becoming persons referred to in this subsection:</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="384998" lims:id="384998"><Label>(a)</Label><Text>the Governor General;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="384999" lims:id="384999"><Label>(b)</Label><Text>the lieutenant governor of a province;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="385000" lims:id="385000"><Label>(c)</Label><Text>a judge receiving a salary under the <XRefExternal reference-type="act" link="J-1">Judges Act</XRefExternal>; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="385001" lims:id="385001"><Label>(d)</Label><Text>a military judge within the meaning of subsection 2(1) of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="385003" lims:id="385003">R.S., 1985, c. and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="385040" lims:id="385040"><Label>(b)</Label><Text>the public interest in the disclosure outweighs the public interest in non-disclosure.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="385041" lims:id="385041"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="385042" lims:id="385042">Paragraph (2)(a) to be considered first</MarginalNote><Label>(3)</Label><Text>In determining whether a person acts in the public interest, a judge or court shall determine whether the condition in paragraph (2)(a) is satisfied before considering paragraph (2)(b).</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="385043" lims:id="385043"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="385044" lims:id="385044">Factors to be considered</MarginalNote><Label>(4)</Label><Text>In deciding whether the public interest in the disclosure outweighs the public interest in non-disclosure, a judge or court must consider</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="385045" lims:id="385045"><Label>(a)</Label><Text>whether the extent of the disclosure is no more than is reasonably necessary to disclose the alleged offence or prevent the commission or continuation of the alleged offence, as the case may be;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="385046" lims:id="385046"><Label>(b)</Label><Text>the seriousness of the alleged offence;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="385047" lims:id="385047"><Label>(c)</Label><Text>whether the person resorted to other reasonably accessible alternatives before making the disclosure and, in doing so, whether the person complied with any relevant guidelines, policies or laws that applied to the person;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="385048" lims:id="385048"><Label>(d)</Label><Text>whether the person had reasonable grounds to believe that the disclosure would be in the public interest;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="385049" lims:id="385049"><Label>(e)</Label><Text>the public interest intended to be served by the disclosure;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="385050" lims:id="385050"><Label>(f)</Label><Text>the extent of the harm or risk of harm created by the disclosure; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="385051" lims:id="385051"><Label>(g)</Label><Text>the existence of exigent circumstances justifying the disclosure.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="385052" lims:id="385052"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="385053" lims:id="385053">Prior disclosure to authorities necessary</MarginalNote><Label>(5)</Label><Text>A judge or court may decide whether the public interest in the disclosure outweighs the public interest in non-disclosure only if the person has complied with the following:</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="385054" lims:id="385054"><Label>(a)</Label><Text>the person has, before communicating or confirming the information, brought his or her concern to, and provided all relevant information in his or her possession to, his or her deputy head or, if not reasonably practical in the circumstances, the Deputy Attorney General of Canada; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="385055" lims:id="1192287"><Label>(b)</Label><Text>the person has, if he or she has not received a response from the deputy head or the Deputy Attorney General of Canada, as the case may be, within a reasonable time, brought his or her concern to and provided all relevant information in the person’s possession to the National Security and Intelligence Review Agency, if the person’s concern relates to an alleged offence that has been, is being or is about to be committed by another person in the purported performance of that person’s duties and functions of service for, or on behalf of, the Government of Canada and he or she has not received a response from that Agency within a reasonable time.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="385058" lims:id="385058"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="385059" lims:id="385059">Exigent circumstances</MarginalNote><Label>(6)</Label><Text>Subsection (5) does not apply if the communication or confirmation of the information was necessary to avoid grievous bodily harm or death.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="385061" lims:id="385061">R.S., 1985, c. terrorist group information that the Government of Canada or of a province is taking measures to safeguard if</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="385066" lims:id="385066"><Label>(a)</Label><Text>the person believes, or is reckless as to whether, the information is information that the Government of Canada or of a province is taking measures to safeguard; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="385067" lims:id="385067"><Label>(b)</Label><Text>the person intends, by communicating the information, to increase the capacity of a foreign entity or a terrorist group to harm Canadian interests or is reckless as to whether the communication of the information is likely to increase the capacity of a foreign entity or a terrorist group to harm Canadian interests.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="385068" lims:id="385068"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="385069" lims:id="385069">Communicating safeguarded information</MarginalNote><Label>(2)</Label><Text>Every person commits an offence who, intentionally and without lawful authority, communicates to a foreign entity or to a terrorist group information that the Government of Canada or of a province is taking measures to safeguard if</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="385070" lims:id="385070"><Label>(a)</Label><Text>the person believes, or is reckless as to whether, the information is information that the Government of Canada or of a province is taking measures to safeguard; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="385071" lims:id="385071"><Label>(b)</Label><Text>harm to lims:id="385096"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="385097" lims:id="385097">Punishment</MarginalNote><Label>(2)</Label><Text>Every person who commits an offence under subsection (1) is guilty of an indictable offence and is liable to imprisonment for a term of not more than 10 years.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" information, including a formula, pattern, compilation, program, method, technique, process, negotiation position or strategy or any information contained or embodied in a product, device or mechanism that</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="385104" lims:id="385104"><Label>(a)</Label><Text>is or may be used in a trade or business;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="385105" lims:id="385105"><Label>(b)</Label><Text>is not generally known in that trade or business;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="385106" lims:id="385106"><Label>(c)</Label><Text>has economic value from not being generally known; and</Text></Paragraph><Paragraph lims:id="1487775"><Label>(ii)</Label><Text>is a person described in any of clauses (i)(A) to (E), the intimidation, threat or violence is in relation to the victim’s child, relative or <DefinitionRef>intimate partner</DefinitionRef>, as defined in section 2 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, and the child, relative or partner is in or governmental process</DefinedTermEn> includes</Text><Paragraph lims:inforce-start-date="2024-08-19" lims:enacted-date="2024-06-20" lims:fid="1487842" lims:id="1487842"><Label>(a)</Label><Text>any proceeding of a legislative body;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-08-19" lims:enacted-date="2024-06-20" lims:fid="1487843" lims:id="1487843"><Label>(b)</Label><Text>the development of a legislative proposal;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-08-19" lims:enacted-date="2024-06-20" lims:fid="1487844" lims:id="1487844"><Label>(c)</Label><Text>the development or amendment of any policy or program;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-08-19" lims:enacted-date="2024-06-20" lims:fid="1487845" lims:id="1487845"><Label>(d)</Label><Text>the making of a decision by a public office holder or government body, including the awarding of a contract;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-08-19" lims:enacted-date="2024-06-20" lims:fid="1487846" lims:id="1487846"><Label>(e)</Label><Text>the holding of an election or referendum; and</Text></Paragraph><Paragraph lims:inforce-start-date="2024-08-19" lims:enacted-date="2024-06-20" lims:fid="1487847" lims:id="1487847"><Label>(f)</Label><Text>the nomination of a candidate or the development of an electoral platform by a political party. (<DefinedTermFr>processus politique ou gouvernemental</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2024-08-19" lims:enacted-date="2024-06-20" lims:fid="1487848" lims:id="1487848"><Text><DefinedTermEn>public office holder</DefinedTermEn> means any of the following individuals:</Text><Paragraph lims:inforce-start-date="2024-08-19" lims:enacted-date="2024-06-20" lims:fid="1487849" lims:id="1487849"><Label>(a)</Label><Text>any officer or employee of His Majesty in right of Canada and includes</Text><Subparagraph lims:inforce-start-date="2024-08-19" lims:enacted-date="2024-06-20" lims:fid="1487850" lims:id="1487850"><Label>(i)</Label><Text>a member of the Senate or the House of Commons and any person on the staff of such a member,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2024-08-19" lims:enacted-date="2024-06-20" lims:fid="1487851" lims:id="1487851"><Label>(ii)</Label><Text>a person who is appointed to any office or body by or with the approval of the Governor in Council or a minister of the Crown, other than a judge receiving a salary under the <XRefExternal reference-type="act" link="J-1">Judges Act</XRefExternal> or the lieutenant governor of a province,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2024-08-19" lims:enacted-date="2024-06-20" lims:fid="1487852" lims:id="1487852"><Label>(iii)</Label><Text>an officer, director or employee of any <DefinitionRef>federal board, commission or other tribunal</DefinitionRef>, as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="F-7">Federal Courts Act</XRefExternal>,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2024-08-19" lims:enacted-date="2024-06-20" lims:fid="1487853" lims:id="1487853"><Label>(iv)</Label><Text>a member of the Canadian Forces, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2024-08-19" lims:enacted-date="2024-06-20" lims:fid="1487854" lims:id="1487854"><Label>(v)</Label><Text>a member of the Royal Canadian Mounted Police;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2024-08-19" lims:enacted-date="2024-06-20" lims:fid="1487855" lims:id="1487855"><Label>(b)</Label><Text>members of the legislature of a province or persons on the staff of such members;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-08-19" lims:enacted-date="2024-06-20" lims:fid="1487856" lims:id="1487856"><Label>(c)</Label><Text>employees of the government of a province;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-08-19" lims:enacted-date="2024-06-20" lims:fid="1487857" lims:id="1487857"><Label>(d)</Label><Text>members of a council or other statutory body charged with the administration of the civil or municipal affairs of a city, town, municipality or district, persons on the staff of such members or officers or employees of a city, town, municipality or district;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-08-19" lims:enacted-date="2024-06-20" lims:fid="1487858" lims:id="1487858"><Label>(e)</Label><Text>members of the council of a <DefinitionRef>band</DefinitionRef>, as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="I-5">Indian Act</XRefExternal>, or of the council of an Indian band established by an Act of Parliament, persons on their staff or employees of such a council;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-08-19" lims:enacted-date="2024-06-20" lims:fid="1487859" lims:id="1487859"><Label>(f)</Label><Text>members of an aboriginal government or institution that exercises jurisdiction or authority under a self-government agreement, or under self-government provisions contained in a land claims agreement, given effect by or under an Act of Parliament, persons on the staff of those members or employees of that government or institution;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-08-19" lims:enacted-date="2024-06-20" lims:fid="1487860" lims:id="1487860"><Label>(g)</Label><Text>an officer or employee of an entity that represents the interests of First Nations, the Inuit or the political or governmental processes;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-08-19" lims:enacted-date="2024-06-20" lims:fid="1487865" recognized and affirmed by section 35 of the <XRefExternal reference-type="act" link="const">Constitution Act, 1982</XRefExternal>, or</Text></Subparagraph><Subparagraph other than under subsection 13(1) or 18(1), does anything that is directed towards or done in preparation of the commission of the offence, including</Text><Paragraph information;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="385138" lims:id="385138"><Label>(c)</Label><Text>knowingly communicating to a foreign entity, a terrorist group or a foreign economic entity the person’s willingness to commit the offence;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="385139" lims:id="385139"><Label>(d)</Label><Text>at the direction of, for the benefit of or in association with a foreign entity, a terrorist group or a foreign economic entity, asking a person to commit the offence; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="385140" lims:id="385140"><Label>(e)</Label><Text>possessing any device, apparatus or software useful for lims:inforce-start-date="2002-12-31" lims:fid="385163" lims:id="385163"><Label>(b)</Label><Text>a person who owes allegiance to Her Majesty in right of Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="385164" lims:id="385164"><Label>(c)</Label><Text>a person who is locally engaged and who performs his or her functions in a Canadian mission outside Canada; or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="385165" lims:id="385165"><Label>(d)</Label><Text>a person who, after the time the offence is alleged to have been committed, is present in Canada.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="385166" lims:id="385166"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="385167" lims:id="385167">Jurisdiction</MarginalNote><Label>(2)</Label><Text>If a person is deemed to have committed an act or omission in Canada, proceedings in respect of the offence may, whether or not the person is in Canada, be commenced in any territorial division in Canada, and the person may be tried and punished in respect of the offence in the same manner as if the offence had been committed in that territorial division.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="385168" lims:id="385168"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="385169" lims:id="385169">Appearance of accused at trial</MarginalNote><Label>(3)</Label><Text>For greater certainty, the provisions of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> relating to requirements that a person appear at and be present during proceedings and the exceptions to those requirements apply in respect of proceedings commenced in a territorial division under subsection (2).</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="385170" lims:id="385170"><MarginalNote dealt with in Canada, the person would be able to plead <Emphasis style="italic"><Language xml:lang="fr">autrefois acquit</Language></Emphasis>, <Emphasis style="italic"><Language
