lims:id="1365515">Definitions</MarginalNote><Label>2</Label><Text>The following definitions apply in this Act.</Text><Definition lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365516" lims:id="1365516"><Text><DefinedTermEn>common-law partner</DefinedTermEn>, in relation to an individual, means a person who is cohabiting with the individual in a conjugal relationship, having so cohabited for a period of at least one year. (<DefinedTermFr>conjoint de fait</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365517" lims:id="1365517"><Text><DefinedTermEn>control</DefinedTermEn> has the meaning assigned by the regulations. (<DefinedTermFr>contrôle</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365518" lims:id="1365518"><Text><DefinedTermEn>dwelling unit</DefinedTermEn> means a residential unit that contains private kitchen facilities, a private bath and a private living area. (<DefinedTermFr>local d’habitation</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365519" lims:id="1365519"><Text><DefinedTermEn>Minister</DefinedTermEn> means the federal minister designated under section <XRefInternal>3</XRefInternal>. (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365520" lims:id="1365520"><Text><DefinedTermEn>non-Canadian</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365521" lims:id="1365521"><Label>(a)</Label><Text>an individual who is neither a Canadian citizen nor a person registered as an Indian under the <XRefExternal reference-type="act" link="I-5">Indian Act</XRefExternal> nor a permanent resident;</Text></Paragraph><Paragraph lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365522" lims:id="1365522"><Label>(b)</Label><Text>a corporation that is incorporated otherwise than under the laws of Canada or a province;</Text></Paragraph><Paragraph lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365523" lims:id="1365523"><Label>(c)</Label><Text>a corporation incorporated under the laws of Canada or a province whose shares are not listed on a stock exchange in Canada for which a designation under section 262 of the <XRefExternal reference-type="act" link="I-3.3">Income Tax Act</XRefExternal> is in effect and that is controlled by a person referred to in paragraph (a) or (b); and</Text></Paragraph><Paragraph lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365524" lims:id="1365524"><Label>(d)</Label><Text>a prescribed person or entity. (<DefinedTermFr>non-Canadien</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365525" lims:id="1365525"><Text><DefinedTermEn>permanent resident</DefinedTermEn> has the same meaning as in subsection 2(1) of the <XRefExternal reference-type="act" link="I-2.5">Immigration and Refugee Protection Act</XRefExternal>. (<DefinedTermFr>résident permanent</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365526" lims:id="1365526"><Text><DefinedTermEn>prescribed</DefinedTermEn> means prescribed by regulation. (<DefinitionEnOnly>Version anglaise seulement</DefinitionEnOnly>)</Text></Definition><Definition lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365527" lims:id="1365527"><Text><DefinedTermEn>residential property</DefinedTermEn> means any real property or immovable, other than a prescribed real property or immovable, that is situated in Canada and that is</Text><Paragraph lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365528" lims:id="1365528"><Label>(a)</Label><Text>a detached house or similar building, containing not more than three dwelling units, together with that proportion of the appurtenances to the building and the land subjacent or immediately contiguous to the building that is reasonably necessary for its use and enjoyment as a place of residence for individuals;</Text></Paragraph><Paragraph lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365529" lims:id="1365529"><Label>(b)</Label><Text>a part of a building that is a semi-detached house, rowhouse unit, residential condominium unit or other similar premises that is, or is intended to be, a separate parcel or other division of real property or immovable owned, or intended to be owned, apart from any other unit in the building, together with that proportion of any common areas and other appurtenances to the building and the land subjacent or immediately contiguous to the building that is attributable to the house, unit or premises and that is reasonably necessary for its use and enjoyment as a place of residence for individuals; or</Text></Paragraph><Paragraph lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365530" lims:id="1365530"><Label>(c)</Label><Text>any prescribed real property or immovable. (<DefinedTermFr>immeuble résidentiel</DefinedTermFr>)</Text></Paragraph></Definition></Section><Section lims:enacted-date="2022-06-23" lims:fid="1365532" lims:id="1365532">Designation of Minister</MarginalNote><Label>3</Label><Text>The Governor in Council may, by order, designate any federal minister to be the Minister for the purposes of this Act.</Text></Section><Section lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:lastAmendedDate="2023-01-01" lims:fid="1365533" lims:id="1365533"><MarginalNote lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365534" lims:id="1365534">Prohibition</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365535" lims:id="1365535"><Label>(1)</Label><Text>Despite section 34 of the <XRefExternal reference-type="act" link="C-29">Citizenship Act</XRefExternal>, it is prohibited for a non-Canadian to purchase, directly or indirectly, any residential property.</Text></Subsection><Subsection lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365536" lims:id="1365536"><MarginalNote lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365537" lims:id="1365537">Exception — persons</MarginalNote><Label>(2)</Label><Text>Subsection (1) does not apply to</Text><Paragraph lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365538" lims:id="1365538"><Label>(a)</Label><Text>a temporary resident within the meaning of the <XRefExternal reference-type="act" link="I-2.5">Immigration and Refugee Protection Act</XRefExternal> who satisfies prescribed conditions;</Text></Paragraph><Paragraph lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365539" lims:id="1365539"><Label>(b)</Label><Text>a protected person within the meaning of subsection 95(2) of that Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365540" lims:id="1365540"><Label>(c)</Label><Text>an individual who is a non-Canadian and who purchases residential property in Canada with their spouse or common-law partner if the spouse or common law-partner is a Canadian citizen, person registered as an Indian under the <XRefExternal reference-type="act" link="I-5">Indian Act</XRefExternal>, permanent resident or person referred to in paragraph (a) or (b); or</Text></Paragraph><Paragraph lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365541" lims:id="1365541"><Label>(d)</Label><Text>a person of a prescribed class of persons.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365542" lims:id="1365542"><MarginalNote lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365543" lims:id="1365543">Exception — circumstances</MarginalNote><Label>(3)</Label><Text>Subsection (1) does not apply in prescribed circumstances.</Text></Subsection><Subsection lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365544" lims:id="1365544"><MarginalNote lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365545" lims:id="1365545">Foreign state</MarginalNote><Label>(4)</Label><Text>For greater certainty, nothing in subsection (1) is to be construed as hindering a foreign state from purchasing residential property for diplomatic or consular purposes.</Text></Subsection><Subsection lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365546" lims:id="1365546"><MarginalNote lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365547" lims:id="1365547">Non-application</MarginalNote><Label>(5)</Label><Text>Subsection (1) does not apply if the non-Canadian becomes liable or assumes liability under an agreement of purchase and sale of the residential property before the day on which this Act comes into force.</Text></Subsection></Section><Section lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:lastAmendedDate="2023-01-01" lims:fid="1365548" lims:id="1365548"><MarginalNote lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365549" lims:id="1365549">Validity</MarginalNote><Label>5</Label><Text>The contravention of section <XRefInternal>4</XRefInternal> does not affect the validity of the sale of the residential property to which the contravention relates.</Text></Section><Section lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:lastAmendedDate="2023-01-01" lims:fid="1365550" lims:id="1365550"><MarginalNote lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365551" lims:id="1365551">Offence</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365552" lims:id="1365552"><Label>(1)</Label><Text>Every non-Canadian that contravenes section <XRefInternal>4</XRefInternal> and every person or entity that counsels, induces, aids or abets or attempts to counsel, induce, aid or abet a non-Canadian to purchase, directly or indirectly, any residential property knowing that the non-Canadian is prohibited under this Act from purchasing the residential property is guilty of an offence and liable on summary conviction to a fine of not more than $10,000.</Text></Subsection><Subsection lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365553" lims:id="1365553"><MarginalNote lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365554" lims:id="1365554">Party to offence</MarginalNote><Label>(2)</Label><Text>If a corporation or entity commits an offence, any of the following persons that directed, authorized, assented to, acquiesced in or participated in the commission of the offence is a party to and liable for the offence whether or not the corporation or entity has been prosecuted or convicted:</Text><Paragraph lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365555" lims:id="1365555"><Label>(a)</Label><Text>an officer, director or agent or mandatary of the corporation or entity;</Text></Paragraph><Paragraph lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365556" lims:id="1365556"><Label>(b)</Label><Text>a senior official of the corporation or entity;</Text></Paragraph><Paragraph lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365557" lims:id="1365557"><Label>(c)</Label><Text>any individual authorized to exercise managerial or supervisory functions on behalf of the corporation or entity.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:lastAmendedDate="2023-01-01" lims:fid="1365558" lims:id="1365558"><MarginalNote lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365559" lims:id="1365559">Order</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365560" lims:id="1365560"><Label>(1)</Label><Text>If a non-Canadian is convicted of having contravened section <XRefInternal>4</XRefInternal>, the superior court of the province in which the residential property to which the contravention relates is situated may, on application of the Minister, order the residential property to be sold in the prescribed manner and under prescribed conditions.</Text></Subsection><Subsection lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365561" lims:id="1365561"><MarginalNote lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365562" lims:id="1365562">Terms</MarginalNote><Label>(2)</Label><Text>Subject to the regulations, the superior court may make the order subject to any terms that it considers appropriate.</Text></Subsection></Section><Section lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:lastAmendedDate="2023-01-01" lims:fid="1365563" lims:id="1365563"><MarginalNote lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365564" lims:id="1365564">Regulations</MarginalNote><Label>8</Label><Subsection lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365565" lims:id="1365565"><Label>(1)</Label><Text>The Governor in Council may, on the recommendation of the Minister after consultation with the Minister of Finance, make regulations</Text><Paragraph lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365566" lims:id="1365566"><Label>(a)</Label><Text>defining “control” for the purposes of this Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365567" lims:id="1365567"><Label>(b)</Label><Text>respecting what constitutes a purchase for the purposes of this Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365568" lims:id="1365568"><Label>(c)</Label><Text>respecting the making of orders under section <XRefInternal>7</XRefInternal>; and</Text></Paragraph><Paragraph lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365569" lims:id="1365569"><Label>(d)</Label><Text>prescribing anything that by this Act is to be prescribed.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365570" lims:id="1365570"><MarginalNote lims:inforce-start-date="2023-01-01" lims:enacted-date="2022-06-23" lims:fid="1365571" lims:id="1365571">Paragraph (1)(c)</MarginalNote><Label>(2)</Label><Text>Regulations made under paragraph (1)(c) must provide that no non-Canadian receive from the proceeds that results from a sale of a residential property ordered under section <XRefInternal>7</XRefInternal> more than the purchase price they
