Ltd. pursuant to the said Act; and</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="636719" lims:id="636719" format-ref="indent-1-1" language-align="yes" list-item="no"><Text>IN THE MATTER OF subsection 20(4) of the said Act; and</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="636720" lims:id="636720" format-ref="indent-1-1" language-align="yes" list-item="no"><Text>IN THE MATTER OF Condition 7 of SCHEDULE III to and subsection 21(2) of the said Act;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="636721" lims:id="636721" format-ref="indent-1-1" language-align="yes" list-item="no"><Text>Agency File No. 5013.</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="636722" lims:id="636722" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Whereas a Certificate of Public Convenience and Necessity dated the 13th day of April, 1978, is declared to have been issued pursuant to the <XRefExternal reference-type="act" link="N-26">Northern Pipeline Act</XRefExternal> to Foothills Pipe Lines (North B.C.) Ltd. [hereinafter called “Foothills (North B.C.)”] in respect of the pipeline defined in the said Act for that portion of the route in the north-eastern area of the Province of British Columbia as more particularly set forth in ANNEX I of SCHEDULE I to the said Act;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="636723" lims:id="636723" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>And Whereas Foothills Pipe Lines (Yukon) Ltd., The Alberta Gas Trunk Line (Canada) Limited, Westcoast Transmission Company Limited, Alberta Natural Gas Company Ltd. and The Alberta Gas Trunk Line Company Limited, at a public hearing, before the National Energy Board, commencing on the 12th day of April, 1976, in the City of Ottawa, in the Province of Ontario, continued in the Town of Inuvik, in the Northwest Territories, in the City of Whitehorse, in the Yukon Territory, and in the City of Yellowknife, in the Northwest Territories, respectively, and adjourned on the 12th day of May, 1977, in the City of Ottawa, in the Province of Ontario, adduced <Language xml:lang="la">inter alia</Language> certain evidence, gave certain undertakings and made certain commitments in respect of the ‘Alaska Highway Pipeline Project’;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="636724" lims:id="636724" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>And Whereas subsection 21(2) of the said Act provides that every such undertaking is deemed to be</Text><QuotedText><SectionPiece><Paragraph><Label>“(a)</Label><Text>an undertaking of every company insofar as the undertaking relates to the company and to the portion of the route indicated in the Agreement in respect of such company; and</Text></Paragraph><Paragraph><Label>(b)</Label><Text>a term or condition set out in Schedule III.;”</Text></Paragraph></SectionPiece></QuotedText></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="636725" lims:id="636725" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>And Whereas pursuant to the provisions of subsection 20(4) of the said Act the Designated Officer may, with the approval of the Governor in Council, rescind, amend or add to the terms and conditions set out in Schedule III to the said Act.</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="636726" lims:id="636726" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Now Therefore the Designated Officer, Northern Pipeline Agency, pursuant to the provisions of subsection 20(4) of the <XRefExternal reference-type="act" link="N-26">Northern Pipeline Act</XRefExternal>, hereby</Text><Provision lims:inforce-start-date="2006-03-22" lims:fid="636727" lims:id="636727" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(a)</Label><Text>rescinds Condition 7 of Schedule III to the Act, insofar as it applies to Foothills (North B.C.);</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="636728" lims:id="636728" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(b)</Label><Text>rescinds those undertakings in respect of social and economic matters and environmental, fisheries and agricultural concerns deemed, pursuant to the provisions of subsection 21(2) of the Act, to be terms or conditions set out in Schedule III to the Act, insofar as they apply to Foothills (North B.C.), except that undertaking referred to in item 7, under the heading “Compensation”, contained in “APPENDIX 5-2”, on page 9 of 41, Volume 3 of the <XRefExternal reference-type="other">REASONS FOR DECISION, NORTHERN PIPELINES</XRefExternal>, dated June, 1977, of the National Energy Board; and</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="636729" lims:id="636729" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(c)</Label><Text>adds to the terms and conditions set out in Schedule III to the Act the terms and conditions annexed hereto and titled <XRefExternal reference-type="regulation" link="SI-81-22">Northern Pipeline Socio-Economic and Environmental Terms and Conditions for Northern British Columbia</XRefExternal> to be applicable to Foothills (North B.C.).</Text></Provision></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="636730" lims:id="636730" format-ref="indent-0-0" keep-with-next="yes" language-align="yes" list-item="no"><Text>Dated at the City of Calgary, in the Province of Alberta, this 29th day of August, 1980.</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="636731" lims:id="636731" format-ref="right-align" keep-with-previous="yes" language-align="yes" list-item="no"><SignatureBlock justification="right" width="15pc"><SignatureTitle justification="right" topmarginspacing="8">NORTHERN PIPELINE AGENCY</SignatureTitle><SignatureName justification="right">W.A. lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636736" lims:id="636736"><Label>2</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="636737" lims:id="636737"><Label>(1)</Label><Text>In these terms and conditions,</Text><Definition lims:inforce-start-date="2006-03-22" lims:fid="636738" lims:id="636738" generate-in-text="no"><Text><DefinedTermEn>Act</DefinedTermEn> means the <XRefExternal reference-type="act" link="N-26">Northern Pipeline Act</XRefExternal>; (<DefinedTermFr>Loi</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="636739" lims:id="636739" generate-in-text="no"><Text><DefinedTermEn>agricultural land</DefinedTermEn> means any land that is</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636740" lims:id="636740"><Label>(a)</Label><Text>cleared and used for pasture,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636741" lims:id="636741"><Label>(b)</Label><Text>under cultivation, or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636742" lims:id="636742"><Label>(c)</Label><Text>part of an agricultural land reserve; (<DefinedTermFr>terre agricole</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="636743" lims:id="636743" generate-in-text="no"><Text><DefinedTermEn>agricultural land reserve</DefinedTermEn> means a reserve of land established under section 8 of the <XRefExternal reference-type="act">Agricultural Land Commission Act</XRefExternal> (British Columbia); (<DefinedTermFr>réserve de terres agricoles</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="636744" lims:id="636744" generate-in-text="no"><Text><DefinedTermEn>big game animals</DefinedTermEn> means <DefinitionRef>big game</DefinitionRef> as defined in the <XRefExternal reference-type="act">Wildlife Act</XRefExternal> (British Columbia); (<DefinedTermFr>gros gibier</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="636745" lims:id="636745" generate-in-text="no"><Text><DefinedTermEn>borrow pit</DefinedTermEn> means a site used for the extraction of granular material and fill and the excavation resulting from such extraction; (<DefinedTermFr>ballastière</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="636746" lims:id="636746" generate-in-text="no"><Text><DefinedTermEn>construction</DefinedTermEn> means, in respect of the building of the pipeline or any portion thereof, those field activities carried out by Foothills from the commencement of the clearing for the pipeline or any portion thereof until leave to open the pipeline or portion thereof, as the case may be, is granted by the Board but does not include clearing for survey lines by Foothills; (<DefinedTermFr>construction</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="636747" lims:id="636747" generate-in-text="no"><Text><DefinedTermEn>environmental impact</DefinedTermEn> means any change in the existing physical or biological conditions of the environment resulting from the construction or operation of the pipeline; (<DefinedTermFr>répercussions écologiques</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="636748" lims:id="636748" generate-in-text="no"><Text><DefinedTermEn>facility</DefinedTermEn> means any fixed installation of a temporary or permanent nature installed by Foothills as a part of the pipeline or that is used by Foothills in the construction or operation of the pipeline; (<DefinedTermFr>installations</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="636749" lims:id="636749" generate-in-text="no"><Text><DefinedTermEn>fish</DefinedTermEn> means <DefinitionRef>fish</DefinitionRef> as defined in the <XRefExternal reference-type="act" link="F-14">Fisheries Act</XRefExternal>; (<DefinedTermFr>poisson</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="636750" lims:id="636750" generate-in-text="no"><Text><DefinedTermEn>Foothills</DefinedTermEn> means Foothills Pipe Lines (North B.C.) Ltd.; (<DefinedTermFr>Foothills</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="636751" lims:id="636751" generate-in-text="no"><Text><DefinedTermEn>fuel</DefinedTermEn> means all liquid and gaseous hydrocarbons and petroleum products used in the construction and operation of the pipeline; (<DefinedTermFr>carburants</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="636752" lims:id="636752" generate-in-text="no"><Text><DefinedTermEn>fur-bearing animals</DefinedTermEn> means <DefinitionRef>fur-bearing animals</DefinitionRef> as defined in the <XRefExternal reference-type="act">Wildlife Act</XRefExternal> (British Columbia); (<DefinedTermFr>animaux à fourrure</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="636753" lims:id="636753" generate-in-text="no"><Text><DefinedTermEn>grazing reserve</DefinedTermEn> means a grazing reserve established under the <XRefExternal reference-type="act">Land Act</XRefExternal> (British Columbia) for the purpose of grazing livestock; (<DefinedTermFr>pâturage</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="636754" lims:id="636754" generate-in-text="no"><Text><DefinedTermEn>hazardous material</DefinedTermEn> means any chemical, explosive, toxic material or other substance that, if spilled, misused or allowed to escape, may cause significant damage to the environment; (<DefinedTermFr>produits dangereux</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="636755" lims:id="636755" generate-in-text="no"><Text><DefinedTermEn>Indian</DefinedTermEn> means a person who, pursuant to the <XRefExternal reference-type="act" link="I-5">Indian Act</XRefExternal>, is registered as an Indian or is entitled to be registered as an Indian; (<DefinedTermFr>Indien</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="636756" lims:id="636756" generate-in-text="no"><Text><DefinedTermEn>inspection</DefinedTermEn> means observation and measurement by Foothills to verify that</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636757" lims:id="636757"><Label>(a)</Label><Text>the construction and operation of the pipeline accord with the designs and specifications of the pipeline, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636758" lims:id="636758"><Label>(b)</Label><Text>these terms and conditions are complied with; (<DefinedTermFr>inspection</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="636759" lims:id="636759" generate-in-text="no"><Text><DefinedTermEn>monitoring</DefinedTermEn> means data gathering, data analysis and interpretation and data presentation to determine magnitudes and characteristics of environmental change; (<DefinedTermFr>contrôle</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="636760" lims:id="636760" generate-in-text="no"><Text><DefinedTermEn>operation</DefinedTermEn> means any field activity by Foothills relating to the pipeline or any portion of the pipeline for which leave to open has been granted; (<DefinedTermFr>exploitation</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="636761" lims:id="636761" generate-in-text="no"><Text><DefinedTermEn>Province</DefinedTermEn> means the Province of British Columbia; (<DefinedTermFr>province</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="636762" lims:id="636762" generate-in-text="no"><Text><DefinedTermEn>rare and endangered species</DefinedTermEn> means those animal or plant species that occupy areas or exist in numbers so small that, in the opinion of the designated officer, their existence would likely be threatened by the construction or operation of the pipeline; (<DefinedTermFr>espèces rares et menacées</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="636763" lims:id="636763" generate-in-text="no"><Text><DefinedTermEn>waste</DefinedTermEn> means discarded or abandoned liquid or solid matter including human waste, garbage, oil drums, petroleum products, ashes and equipment; (<DefinedTermFr>déchets</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="636764" lims:id="636764" generate-in-text="no"><Text><DefinedTermEn>waterbodies</DefinedTermEn> means lakes and ponds and permanent and intermittent rivers and streams and their beds; (<DefinedTermFr>masses d’eau</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="636765" lims:id="636765" generate-in-text="no"><Text><DefinedTermEn>wildlife</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636766" lims:id="636766"><Label>(a)</Label><Text>big game animals and fur-bearing animals that are native to the Province,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636767" lims:id="636767"><Label>(b)</Label><Text>migratory game birds as defined in the <XRefExternal reference-type="act">Migratory Birds Convention Act</XRefExternal>,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636768" lims:id="636768"><Label>(c)</Label><Text>all <Language xml:lang="la">Galliformes</Language> native to the Province,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636769" lims:id="636769"><Label>(d)</Label><Text>all species of the orders <Language xml:lang="la">Falconiformes</Language> and <Language xml:lang="la">Strigiformes</Language>, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636770" lims:id="636770"><Label>(e)</Label><Text>rare and endangered species of birds, mammals, reptiles and amphibians. (<DefinedTermFr>faune</DefinedTermFr>)</Text></Paragraph></Definition></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="636771" lims:id="636771"><Label>(2)</Label><Text>All other words and expressions have the meaning assigned to them in the Act.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="636772" lims:id="636772" level="1"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636773" lims:id="636773"><Label>3</Label><Text>These terms and conditions are added to the terms and conditions set out in Schedule III to the Act and shall apply to Foothills but, unless the context otherwise requires, shall only apply to the construction and operation of that portion of the pipeline that extends from Watson Lake in a southeasterly direction across the northeastern part of the Province to a point on the boundary between the Provinces of British Columbia and Alberta near Boundary Lake.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="636774" lims:id="636774" level="1"><TitleText>General</TitleText></Heading><Heading lims:inforce-start-date="2006-03-22" lims:fid="636775" lims:id="636775" level="2"><TitleText>Compliance with the Law</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636776" lims:id="636776"><Label>4</Label><Text>Foothills shall, in the construction and operation of the pipeline, comply with the laws of Canada and the laws of the Province.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636777" lims:id="636777"><Label>5</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="636778" lims:id="636778"><Label>(1)</Label><Text>Subject to subsection (2), Foothills shall, when entering into any contract with a contractor for the construction or operation of the pipeline, require as a condition of such a contract that the contractor or any subcontractor of that contractor observe and comply with these terms and conditions.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="636779" lims:id="636779"><Label>(2)</Label><Text>Where an application is made by Foothills to the designated officer to exempt Foothills from the requirement referred to in subsection (1) in respect of the observing of or compliance with any provision of Part I, the designated officer may exempt Foothills from that requirement in respect of that provision.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="636780" lims:id="636780"><Label>(3)</Label><Text>Foothills shall be responsible for any breach of these terms and conditions by a contractor referred to in subsection (1) or any subcontractor of that contractor as if the breach had been committed by Foothills.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="636781" lims:id="636781" level="2"><TitleText>Access to Right-of-Way of Pipeline</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636782" lims:id="636782"><Label>6</Label><Text>Employees or agents of the government of the Province shall, for the purpose of carrying out their duties in respect of the pipeline, be allowed reasonable access to any part of the right-of-way of the pipeline or any other area where the pipeline is being constructed.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="636783" lims:id="636783" level="2"><TitleText>Assistance to the Designated Officer</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636784" lims:id="636784"><Label>7</Label><Text>When requested by the designated officer, Foothills shall give him any reasonable assistance that he may require to carry out his duties in respect of the pipeline and shall furnish him with such information in respect of the construction or operation of the pipeline as he may request.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="636785" lims:id="636785" level="2"><TitleText>Indemnification</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636786" lims:id="636786"><Label>8</Label><Text>Foothills shall, at all times, save harmless and indemnify and keep Her Majesty indemnified against and be responsible for all claims, demands, actions, suits, costs or other legal proceedings made or brought against Her Majesty by reason of or arising out of</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636787" lims:id="636787"><Label>(a)</Label><Text>the construction or operation of the pipeline;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636788" lims:id="636788"><Label>(b)</Label><Text>the escape, ignition or explosion, for any cause, of gas or related hydrocarbons from or in the pipeline on the lands of Her Majesty;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636789" lims:id="636789"><Label>(c)</Label><Text>any act or omission on the part of Foothills, its contractors and their subcontractors and its or their officers, servants, agents or employees in respect of or in relation to the pipeline on the lands of Her Majesty, including the construction or operation of the pipeline; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636790" lims:id="636790"><Label>(d)</Label><Text>any act or omission on the part of any officer, servant, agent or employee of Her Majesty in respect of or in relation to the pipeline on the lands of Her Majesty, not including such acts or omissions as would in law constitute gross negligence.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636791" lims:id="636791"><Label>9</Label><Text>Foothills shall, at all times, pay to Her Majesty the amount of any loss or damage that has been suffered or sustained by Her Majesty by reason of or arising out of the matters set out in section 8.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="636792" lims:id="636792" level="2"><TitleText>Emergency Measures</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636793" lims:id="636793"><Label>10</Label><Text>Foothills shall establish emergency procedures satisfactory to the designated officer to deal with any emergency arising from the construction or operation of the pipeline that may adversely affect the environment or persons who reside in the vicinity of the pipeline.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636794" lims:id="636794"><Label>11</Label><Text>Foothills shall, to the satisfaction of the designated officer, designate and train persons working on the pipeline to carry out the emergency procedures referred to in section 10.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636795" lims:id="636795"><Label>12</Label><Text>Foothills shall take such measures as are necessary to maintain equipment and supplies intended for use in dealing with emergencies in proper working order.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636796" lims:id="636796"><Label>13</Label><Text>Where any emergency arises in the course of the construction or operation of the pipeline, Foothills shall forthwith advise the designated officer and the agency or ministry of the government of the Province specified by the designated officer of the emergency and the measures it has taken or intends to take to deal with it.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636797" lims:id="636797"><Label>14</Label><Text>Where the emergency referred to in section 10 is a forest fire, Foothills shall make available to the Province personnel to assist in fighting the fire and any equipment or aircraft suitable for fire suppression owned or controlled by Foothills that is in the vicinity of the pipeline.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="636798" lims:id="636798" level="1"><Label>PART I</Label><TitleText>Socio-Economic Terms and Conditions</TitleText></Heading><Heading lims:inforce-start-date="2006-03-22" lims:fid="636799" lims:id="636799" level="2"><TitleText>Undertakings</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636800" lims:id="636800"><Label>15</Label><Text>Where Foothills gives an undertaking to any government, District, Council, community, organization or group referred to in section 19 during consultations required by that section and the undertaking is accepted by that government, District, Council, community, organization or group, Foothills shall, unless otherwise directed by the designated officer within 30 days of the giving of the undertaking, comply with that undertaking.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="636801" lims:id="636801" level="2"><TitleText>Plans</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636802" lims:id="636802"><Label>16</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="636803" lims:id="636803"><Label>(1)</Label><Text>Subject to subsection (2), where, pursuant to this Part, Foothills is required to submit a plan in respect of any matter to the designated officer for approval, that plan, when approved, constitutes Foothills’ plan for that matter and Foothills shall comply therewith.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="636804" lims:id="636804"><Label>(2)</Label><Text>The designated officer may, on giving Foothills reasonable notice in writing, modify or vary any provision set out in a plan referred to in subsection (1) and Foothills shall comply with the plan as so modified or varied.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="636805" lims:id="636805" level="2"><TitleText>Plan Schedule</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636806" lims:id="636806"><Label>17</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="636807" lims:id="636807"><Label>(1)</Label><Text>Foothills shall, within 30 days of the coming into force of this Part or at such later date as may be fixed by the designated officer, submit to the designated officer a plan schedule that sets out the date on which each plan referred to in subsection 16(1) is to be submitted to the designated officer.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="636808" lims:id="636808"><Label>(2)</Label><Text>The plan schedule referred to in subsection (1), when approved by the designated officer, constitutes Foothills’ plan schedule and Foothills shall comply therewith.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="636809" lims:id="636809"><Label>(3)</Label><Text>The designated officer may, at the request of Foothills, modify or vary the plan schedule referred to in subsection (2).</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="636810" lims:id="636810" level="2"><TitleText>Information, Consultation and Liaison</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636811" lims:id="636811"><Label>18</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="636812" lims:id="636812"><Label>(1)</Label><Text>Foothills shall provide information in respect of the planning and construction of the pipeline to:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636813" lims:id="636813"><Label>(a)</Label><Text>the Government of Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636814" lims:id="636814"><Label>(b)</Label><Text>the government of the Province;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636815" lims:id="636815"><Label>(c)</Label><Text>the Peace River — Liard Regional District;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636816" lims:id="636816"><Label>(d)</Label><Text>the Northern British Columbia Advisory Council;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636817" lims:id="636817"><Label>(e)</Label><Text>communities situated in the vicinity of the pipeline;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636818" lims:id="636818"><Label>(f)</Label><Text>Indian, Metis and non-status Indian organizations in the Province; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636819" lims:id="636819"><Label>(g)</Label><Text>any special interest group in the Province requesting such information except a special interest group that does not have, in the opinion of Foothills or the designated officer, a <Language xml:lang="la">bona fide</Language> need for the information.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="636820" lims:id="636820"><Label>(2)</Label><Text>The information referred to in subsection (1) shall be provided in a form and manner satisfactory to the designated officer and shall include information in respect of</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636821" lims:id="636821"><Label>(a)</Label><Text>the route alignment and construction schedules of the pipeline;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636822" lims:id="636822"><Label>(b)</Label><Text>the anticipated impact of the pipeline on the communities situated in the vicinity of the pipeline;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636823" lims:id="636823"><Label>(c)</Label><Text>the potential opportunities resulting from the construction of the pipeline for the residents in the vicinity of the pipeline;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636824" lims:id="636824"><Label>(d)</Label><Text>the proposed use of any land or waterbody;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636825" lims:id="636825"><Label>(e)</Label><Text>any significant adverse environmental impact resulting from the construction of the pipeline;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636826" lims:id="636826"><Label>(f)</Label><Text>the opportunities for businesses in the Province to participate in the supply of goods and services for the pipeline;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636827" lims:id="636827"><Label>(g)</Label><Text>the opportunities referred to in sections 33 and 34;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636828" lims:id="636828"><Label>(h)</Label><Text>the plans made by Foothills for the provision of permanent and temporary housing for workers engaged in the construction and operation of the pipeline; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636829" lims:id="636829"><Label>(i)</Label><Text>any other matter specified by the designated officer.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636830" lims:id="636830"><Label>19</Label><Text>Foothills shall liaise and consult with the Government of Canada, the government of the Province, the Peace River — Liard Regional District, the Northern British Columbia Advisory Council, communities in the vicinity of the pipeline, Indian, Metis and non-status Indian organizations in the Province and any special interest group in the Province, on the request of that group, to facilitate the objects of the Act.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636831" lims:id="636831"><Label>20</Label><Text>Foothills shall facilitate public access to the information referred to in section 18 and shall ensure that those communities situated in the vicinity of the pipeline have access to the information.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636832" lims:id="636832"><Label>21</Label><Text>Foothills shall consult with the government of the Province, the Board of the Peace River — Liard Regional District, communities situated in the vicinity of the pipeline, Indian, Metis and non-status Indian organizations in the Province and any special interest group in the Province, on the request of that group, to ascertain their requirement for information.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636833" lims:id="636833"><Label>22</Label><Text>Where a public meeting, workshop or seminar is convened in a community in the vicinity of the pipeline for the purpose of disseminating information in respect of the pipeline, Foothills shall, when directed by the designated officer, make available informed persons to assist in the dissemination of such information.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636834" lims:id="636834"><Label>23</Label><Text>Foothills shall, in the planning and construction of the pipeline, consult with the government of the Province to ensure that the concerns of the Province are taken into account.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636835" lims:id="636835"><Label>24</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="636836" lims:id="636836"><Label>(1)</Label><Text>Where Foothills receives a direction from the designated officer to consult with the government of the Province, the Municipal Council of Fort Nelson, the Municipal Council of Fort St. John, the Board of the Peace River — Liard Regional District, Indian, Metis and non-status Indian organizations in the Province or with any community situated in the vicinity of the pipeline in respect of any matter in connection with the construction or operation of the pipeline, Foothills shall, within 30 days of receiving such direction, consult with that government, Council, Board, organization or community.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="636837" lims:id="636837"><Label>(2)</Label><Text>Foothills shall report to the designated officer the significant results of any consultation pursuant to subsection (1).</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636838" lims:id="636838"><Label>25</Label><Text>Where Foothills, at any time, consults with any contractor or labour organization in respect of any matter critical to construction progress, Foothills shall report the significant results of such consultation to the designated officer.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636839" lims:id="636839"><Label>26</Label><Text>Where Foothills proposes to consult with any Municipal or Regional District government in the Province in respect of any matter critical to construction progress, Foothills shall inform the Agency of the proposed consultation.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636840" lims:id="636840"><Label>27</Label><Text>Foothills shall identify and make available, for each community situated in the vicinity of the pipeline, a person to assist Foothills in</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636841" lims:id="636841"><Label>(a)</Label><Text>disseminating the information referred to in section 18;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636842" lims:id="636842"><Label>(b)</Label><Text>arranging consultations with the community; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636843" lims:id="636843"><Label>(c)</Label><Text>performing any liaison function with that community.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636844" lims:id="636844"><Label>28</Label><Text>Foothills shall, following consultation with the government of the Province, the Municipal Council of Fort Nelson, the Municipal Council of Fort St. John, the Board of the Peace River — Liard Regional District and Indian, Metis and non-status Indian organizations in the Province, submit to the designated officer for his approval a plan, to be known as the information, consultation and liaison plan, that sets out the manner in which Foothills intends to carry out the provisions in sections 18 to 21, 23 and 25 to 27.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="636845" lims:id="636845" level="2"><TitleText>Pipeline Labour</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636846" lims:id="636846"><Label>29</Label><Text>Foothills shall, in the preparation and implementation of the detailed manpower plan referred to in paragraph 9(a) of Schedule III to the Act, consult with the government of the Province and labour organizations in the Province in respect of the plan and the recruitment and training of employees to be used in the construction and operation of the pipeline.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636847" lims:id="636847"><Label>30</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="636848" lims:id="636848"><Label>(1)</Label><Text>Foothills shall, in consultation with the Government of Canada and the government of the Province, take such measures as are satisfactory to the designated officer to discourage the migration of persons seeking work on the pipeline into any area in the vicinity of the pipeline.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="636849" lims:id="636849"><Label>(2)</Label><Text>Foothills shall, for the purpose of discouraging the migrating of persons referred to in subsection (1),</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636850" lims:id="636850"><Label>(a)</Label><Text>establish a procedure whereby the hiring of persons for the construction or operation of the pipeline who do not reside in the area through which the pipeline passes takes place at locations outside that area; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636851" lims:id="636851"><Label>(b)</Label><Text>cause to be conducted an advertising program in the Province notifying potential employees of Foothills of the locations referred to in paragraph (a).</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="636852" lims:id="636852" level="2"><TitleText>Orientation of Employees</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636853" lims:id="636853"><Label>31</Label><Text>Foothills shall, in respect of those persons who commence work on the construction of the pipeline, carry out an orientation program that includes environmental information to assist such persons to become familiar with the area through which the pipeline passes and their working conditions and to become aware of the potential to damage the environment.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636854" lims:id="636854"><Label>32</Label><Text>Foothills shall, following consultation with the government of the Province, submit to the designated officer for his approval a plan, to be known as the orientation plan, that sets out the manner in which Foothills intends to carry out the orientation program referred to in section 31.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="636855" lims:id="636855" level="2"><TitleText>Opportunity Measures</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636856" lims:id="636856"><Label>33</Label><Text>Foothills shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636857" lims:id="636857"><Label>(a)</Label><Text>ensure that women and the Indian, Metis and non-status Indian people have access to training and employment opportunities in respect of the construction or operation of the pipeline; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636858" lims:id="636858"><Label>(b)</Label><Text>provide appropriate support measures to meet any special needs of women and of the Indian, Metis and non-status Indian people to enable them to take maximum advantage of the opportunities referred to in paragraph (a).</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636859" lims:id="636859"><Label>34</Label><Text>Foothills shall ensure that Indian, Metis and non-status Indian people of the Province have a fair and competitive opportunity to participate in the supply of goods and services for the pipeline.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636860" lims:id="636860"><Label>35</Label><Text>Foothills shall, following consultation with Indian, Metis and non-status Indian organizations in the Province and, when directed by the designated officer, any women’s organizations in the Province, submit to the designated officer for his approval a plan, to be known as the opportunity measures plan, that sets out the manner in which Foothills intends to carry out the provisions of sections 33 and 34.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="636861" lims:id="636861" level="2"><TitleText>Business Opportunities</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636862" lims:id="636862"><Label>36</Label><Text>Foothills shall provide businesses in the Province with a fair and competitive opportunity to supply goods and services for the pipeline.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636863" lims:id="636863"><Label>37</Label><Text>Foothills shall cooperate with the government of the Province in that government’s program in assisting businesses in the Province that are seeking to supply goods and services for the pipeline.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636864" lims:id="636864"><Label>38</Label><Text>Foothills shall, following consultation with the government of the Province, submit to the designated officer for his approval a plan, to be known as the business opportunities plan, that sets out the manner in which Foothills intends to carry out the provisions of sections 36 and 37.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="636865" lims:id="636865" level="2"><TitleText>Transportation and Logistics</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636866" lims:id="636866"><Label>39</Label><Text>Foothills shall, if directed by the designated officer, participate with the Government of Canada or the government of the Province, as the case may be, in any transportation study conducted by that government to assess the quality and capacity of existing transportation facilities in the Province.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636867" lims:id="636867"><Label>40</Label><Text>Foothills shall, during the construction of the pipeline, endeavour in its use of transportation facilities not to disrupt transportation services in the Province.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636868" lims:id="636868"><Label>41</Label><Text>Foothills shall bear the cost of any additional transportation infrastructure provided, at the request of Foothills, by the Government of Canada or the government of the Province for the construction of the pipeline and, where practical, shall ensure that such infrastructure is built, maintained and disposed of to provide maximum long-term benefit to those communities affected by the additional transportation infrastructure.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636869" lims:id="636869"><Label>42</Label><Text>Foothills shall, following consultation with the government of the Province, the Board of the Peace River — Liard Regional District and the communities referred to in section 41, submit to the designated officer for his approval a plan, to be known as the transportation and logistics plan, that sets out the manner in which Foothills intends to carry out the provisions of sections 40 and 41.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="636870" lims:id="636870" level="2"><TitleText>Health</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636871" lims:id="636871"><Label>43</Label><Text>Foothills shall, in consultation with the government of the Province, ensure that proper facilities are provided and arrangements are made for adequate care and treatment of any ill or injured person employed in the construction or operation of the pipeline.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636872" lims:id="636872"><Label>44</Label><Text>Foothills shall ensure that the health of all persons employed on or in connection with the construction or operation of the pipeline is safeguarded by the implementation of generally accepted public health standards.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636873" lims:id="636873"><Label>45</Label><Text>Foothills shall submit to the designated officer for his approval a plan, to be known as the health plan, that sets out the manner in which Foothills intends to carry out the provisions of sections 43 and 44.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="636874" lims:id="636874" level="2"><TitleText>Security</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636875" lims:id="636875"><Label>46</Label><Text>Foothills, in consultation with the Government of Canada, the government of the Province and the Royal Canadian Mounted Police, shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636876" lims:id="636876"><Label>(a)</Label><Text>maintain security of the pipeline;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636877" lims:id="636877"><Label>(b)</Label><Text>provide physical security in respect of each campsite or worksite established by Foothills and the buildings and property of Foothills; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636878" lims:id="636878"><Label>(c)</Label><Text>provide, at reasonable cost, all goods and services requested by the Royal Canadian Mounted Police, the Sheriffs’ Services of the Province, and any other peace officers that are required by them to carry out their duties in connection with the pipeline, including</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="636879" lims:id="636879"><Label>(i)</Label><Text>transportation to remote or isolated locations if the means of transportation are not available to the Royal Canadian Mounted Police, the Sheriffs’ Services or the peace officer making the request,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="636880" lims:id="636880"><Label>(ii)</Label><Text>accommodation, including accommodation for prisoners, office space and storage facilities for police supplies and equipment,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="636881" lims:id="636881"><Label>(iii)</Label><Text>such access and use of communications equipment and facilities of Foothills as the Royal Canadian Mounted Police, the Sheriffs’ Services or any other peace officers may require, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="636882" lims:id="636882"><Label>(iv)</Label><Text>such goods or services as are necessary for the maintenance of reasonable living standards, having regard to local conditions.</Text></Subparagraph></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636883" lims:id="636883"><Label>47</Label><Text>For the purpose of promoting effective law enforcement in the vicinity of the pipeline, Foothills, in consultation with the Royal Canadian Mounted Police and the government of the Province, shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636884" lims:id="636884"><Label>(a)</Label><Text>provide the Royal Canadian Mounted Police and the Sheriffs’ Services of the Province with immediate access to the pipeline and to persons employed in the construction or operation of the pipeline;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636885" lims:id="636885"><Label>(b)</Label><Text>establish methods, including appropriate identification practices, to facilitate the recovery of equipment or supplies belonging to Foothills that have been lost or stolen;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636886" lims:id="636886"><Label>(c)</Label><Text>prohibit access to any campsite established by Foothills by any unauthorized person;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636887" lims:id="636887"><Label>(d)</Label><Text>designate a person to whom all policing matters are to be referred; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636888" lims:id="636888"><Label>(e)</Label><Text>provide sufficient information to enable the Royal Canadian Mounted Police to establish</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="636889" lims:id="636889"><Label>(i)</Label><Text>the nature and extent of the policing required on the pipeline,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="636890" lims:id="636890"><Label>(ii)</Label><Text>a working arrangement between Foothills’ security personnel and the Royal Canadian Mounted Police, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="636891" lims:id="636891"><Label>(iii)</Label><Text>a system of reporting on policing matters.</Text></Subparagraph></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636892" lims:id="636892"><Label>48</Label><Text>Foothills shall not permit the possession by any person employed in the construction of the pipeline of a firearm or game-hunting device</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636893" lims:id="636893"><Label>(a)</Label><Text>on any portion of the pipeline right-of-way where construction activity has commenced, or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636894" lims:id="636894"><Label>(b)</Label><Text>at any time in a campsite established by Foothills or on any property, vehicle or aircraft of Foothills</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="636895" lims:id="636895"><Text>unless authorized, in writing, by the designated officer.</Text></ContinuedSectionSubsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="636896" lims:id="636896" level="2"><TitleText>Housing and Work Camps</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636897" lims:id="636897"><Label>49</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="636898" lims:id="636898"><Label>(1)</Label><Text>Foothills shall, following consultation with</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636899" lims:id="636899"><Label>(a)</Label><Text>the government of the Province,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636900" lims:id="636900"><Label>(b)</Label><Text>the Municipal Council of Fort St. John,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636901" lims:id="636901"><Label>(c)</Label><Text>the Municipal Council of Fort Nelson,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636902" lims:id="636902"><Label>(d)</Label><Text>the Board of the Peace River — Liard Regional District, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636903" lims:id="636903"><Label>(e)</Label><Text>Canada Mortgage and Housing Corporation,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="636904" lims:id="636904"><Text>submit to the designated officer for his approval a plan, to be known as the housing plan, that sets out the manner in which Foothills intends to provide housing for its permanent employees and those temporary employees not accommodated in work camps established by Foothills.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="636905" lims:id="636905"><Label>(2)</Label><Text>Foothills shall not discriminate on the basis of</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636906" lims:id="636906"><Label>(a)</Label><Text>the place of residence of the employee, or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636907" lims:id="636907"><Label>(b)</Label><Text>race, national or ethnic origin, colour, religion, age or sex</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="636908" lims:id="636908"><Text>when providing any housing benefit.</Text></ContinuedSectionSubsection></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636909" lims:id="636909"><Label>50</Label><Text>Foothills shall establish, to the satisfaction of the designated officer, work camps that are, insofar as practicable, self-sufficient.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="636910" lims:id="636910" level="2"><TitleText>Telecommunications</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636911" lims:id="636911"><Label>51</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="636912" lims:id="636912"><Label>(1)</Label><Text>Foothills shall ensure that, where practical,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636913" lims:id="636913"><Label>(a)</Label><Text>the use by Foothills of telecommunication services for the pipeline does not adversely affect the telecommunication services in the Province; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636914" lims:id="636914"><Label>(b)</Label><Text>any telecommunication infrastructure Foothills requires for the construction of the pipeline is built and maintained in such a manner as to improve the existing telecommunication services.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="636915" lims:id="636915"><Label>(2)</Label><Text>Foothills shall submit to the designated officer for his approval a plan, to be known as the telecommunications plan, that sets out the manner in which Foothills intends to carry out the provisions of subsection (1).</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="636916" lims:id="636916" level="2"><TitleText>Highways</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636917" lims:id="636917"><Label>52</Label><Text>Foothills shall consult with the government of the Province and the regulatory authorities of the Province having jurisdiction over roads, highways and public utilities in respect of the proposed pipeline construction for the purpose of devising means to avoid any damage to any road, highway or public utility.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="636918" lims:id="636918" level="2"><TitleText>Availability of Natural Gas to Communities of Northern British Columbia</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636919" lims:id="636919"><Label>53</Label><Text>Foothills shall,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636920" lims:id="636920"><Label>(a)</Label><Text>on a full cost-recovery basis, design and construct lateral pipelines and make arrangements for the supply of natural gas to those industrial and commercial users situated in any franchise area in the Province through which the pipeline passes;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636921" lims:id="636921"><Label>(b)</Label><Text>where a community so requests and if directed by the designated officer, assist that community, on a full cost-recovery basis, in the establishment and operation of a community gas distribution system;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636922" lims:id="636922"><Label>(c)</Label><Text>where a commercial or industrial user of natural gas situated in a remote area in the Province through which the pipeline passes, other than a community, requests Foothills, prior to the approval of the designated officer of the final design of the pipeline, to provide valves and fittings at appropriate points to facilitate the future supply of gas to that user, Foothills shall, on a full cost-recovery basis, install such valves and fittings;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636923" lims:id="636923"><Label>(d)</Label><Text>when directed by the designated officer, provide assistance to any community in the Province situated in the area through which the pipeline passes in determining the number of potential users of natural gas in that community and the economic feasibility of installing natural gas facilities in the community;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636924" lims:id="636924"><Label>(e)</Label><Text>provide information and assistance to any community in the Province situated in the area through which the pipeline passes in</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="636925" lims:id="636925"><Label>(i)</Label><Text>the designing of any natural gas distribution system required by that community, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="636926" lims:id="636926"><Label>(ii)</Label><Text>preparing the required application to the appropriate regulatory authority for such system; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636927" lims:id="636927"><Label>(f)</Label><Text>when requested by any community in the Province situated in any area through which the pipeline passes, provide advice to that community to ensure that the conversion of any existing equipment and system to natural gas occurs without undue cost and inconvenience.</Text></Paragraph></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="636928" lims:id="636928" level="2"><TitleText>Social Services</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636929" lims:id="636929"><Label>54</Label><Text>Foothills shall cooperate with the government of the Province to minimize the demands placed by Foothills, the employees of Foothills and the employees of its contractors and their subcontractors on those social services provided by the government to residents in the vicinity of the pipeline in order that the level of such services so provided are not reduced.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636930" lims:id="636930"><Label>55</Label><Text>Foothills, in consultation with the government of the Province, shall provide referral counselling to its employees and to the employees of its contractors and their subcontractors.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="636931" lims:id="636931" level="2"><TitleText>Surveillance, Inspection and Monitoring</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636932" lims:id="636932"><Label>56</Label><Text>Foothills shall ensure the maintenance and availability, for examination at any time by the Agency, of such of its records pertaining to its activities in the Province as may be required by the Agency to determine compliance with this Part.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636933" lims:id="636933"><Label>57</Label><Text>Foothills shall report to the Agency, at such times as may be required by the designated officer, on the measures that have been taken by Foothills in complying with this Part.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636934" lims:id="636934"><Label>58</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="636935" lims:id="636935"><Label>(1)</Label><Text>Foothills, when directed by the designated officer, shall undertake special studies of the socio-economic impact of the pipeline.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="636936" lims:id="636936"><Label>(2)</Label><Text>Every special study referred to in subsection (1) shall be forwarded to the Agency on its completion.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636937" lims:id="636937"><Label>59</Label><Text>Foothills shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636938" lims:id="636938"><Label>(a)</Label><Text>establish procedures and allocate resources for the purpose of assessing the effectiveness of its compliance with this Part; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636939" lims:id="636939"><Label>(b)</Label><Text>on the request of the designated officer, assess the effectiveness of its compliance with this Part and report the assessment to the Agency.</Text></Paragraph></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="636940" lims:id="636940" level="2"><TitleText>Compensation for Damage to Property</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636941" lims:id="636941"><Label>60</Label><Text>Foothills shall be liable for any damage to property directly or indirectly caused by Foothills, a contractor of Foothills or a subcontractor of that contractor in connection with or resulting from its activities in the construction or operation of the pipeline.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636942" lims:id="636942"><Label>61</Label><Text>Where, in the course of construction or operation of the pipeline, any damage is either directly or indirectly caused by Foothills, a contractor of Foothills or a subcontractor of that contractor to any property, other than the property of Foothills, a contractor of Foothills or a subcontractor of that contractor, Foothills shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636943" lims:id="636943"><Label>(a)</Label><Text>immediately take action to prevent further damage;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636944" lims:id="636944"><Label>(b)</Label><Text>immediately inform the owner of the property of the nature of the damage; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636945" lims:id="636945"><Label>(c)</Label><Text>arrange, as soon as possible, for</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="636946" lims:id="636946"><Label>(i)</Label><Text>compensation,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="636947" lims:id="636947"><Label>(ii)</Label><Text>the repair of the damage, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="636948" lims:id="636948"><Label>(iii)</Label><Text>the replacement of the damaged property.</Text></Subparagraph></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636949" lims:id="636949"><Label>62</Label><Text>Foothills shall submit to the designated officer, in a manner determined by him, information in respect of any unresolved matter referred to in paragraph 61(c).</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636950" lims:id="636950"><Label>63</Label><Text>Where</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636951" lims:id="636951"><Label>(a)</Label><Text>Foothills and a claimant against Foothills fail to agree as to liability or compensation for damage for which the claimant alleges Foothills is responsible, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636952" lims:id="636952"><Label>(b)</Label><Text>the claimant referred to in paragraph (a) agrees with Foothills</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="636953" lims:id="636953"><Label>(i)</Label><Text>to enter into an arbitration submission governed by the provisions of the <XRefExternal reference-type="act">Arbitration Act</XRefExternal> (British Columbia), and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="636954" lims:id="636954"><Label>(ii)</Label><Text>that a decision of the arbitrator is binding and conclusive,</Text></Subparagraph></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="636955" lims:id="636955"><Text>Foothills shall enter into such arbitration submission and shall pay all costs of and incidental to any arbitration proceedings pursuant thereto except where the arbitrator determines that the claim is frivolous.</Text></ContinuedSectionSubsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="636956" lims:id="636956" level="2"><TitleText>Protection of Recreation Areas and Native Harvesting and Cultural Areas</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636957" lims:id="636957"><Label>64</Label><Text>Foothills shall, following consultation with</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636958" lims:id="636958"><Label>(a)</Label><Text>the government of the Province,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636959" lims:id="636959"><Label>(b)</Label><Text>the Municipal Council of Fort St. John,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636960" lims:id="636960"><Label>(c)</Label><Text>the Municipal Council of Fort Nelson, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636961" lims:id="636961"><Label>(d)</Label><Text>the Board of the Peace River — Liard Regional District,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="636962" lims:id="636962"><Text>submit to the designated officer for his approval a plan, to be known as the recreation plan, that sets out the manner in which Foothills intends to mitigate the effect of the employees of Foothills and the employees of its contractors and their subcontractors and their dependents on the existing recreational use pattern and recreational activity of the residents, other than the employees of Foothills and the employees of its contractors and their subcontractors and their dependents, of the area through which the pipeline passes and tourists who visit that area.</Text></ContinuedSectionSubsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636963" lims:id="636963"><Label>65</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="636964" lims:id="636964"><Label>(1)</Label><Text>Foothills shall, following consultation with the government of the Province, and Indian, Metis and non-status Indian organizations in the Province, submit to the designated officer, in a manner and form satisfactory to him, an inventory that sets out</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636965" lims:id="636965"><Label>(a)</Label><Text>the hunting, trapping and fishing areas used by Indian, Metis or non-status Indian people in the vicinity of the pipeline, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636966" lims:id="636966"><Label>(b)</Label><Text>any area of cultural importance to Indian, Metis or non-status Indian people in the vicinity of the pipeline, and</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="636967" lims:id="636967"><Text>a resource use analysis of the hunting, trapping and fishing areas.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="636968" lims:id="636968"><Label>(2)</Label><Text>The resource use analysis referred to in subsection (1) shall consist of information in respect of the seasonal use of hunting, trapping and fishing areas and statistics as to the number and types of species hunted, trapped or fished.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636969" lims:id="636969"><Label>66</Label><Text>In locating the pipeline or any portion thereof, Foothills shall, following consultation with the government of the Province and Indian, Metis and non-status Indian organizations in the Province, locate the pipeline in a manner that minimizes, to the satisfaction of the designated officer, interference with the hunting, trapping and fishing areas and areas of cultural importance set out in the inventory referred to in section 65.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636970" lims:id="636970"><Label>67</Label><Text>In proposing the construction schedule in respect of the pipeline or any portion thereof, Foothills shall, following consultation with the government of the Province and Indian, Metis and non-status Indian organizations in the Province, propose a schedule that minimizes to the satisfaction of the designated officer,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636971" lims:id="636971"><Label>(a)</Label><Text>any conflict with the seasonal use of hunting, trapping and fishing areas, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636972" lims:id="636972"><Label>(b)</Label><Text>the disturbance of areas of cultural importance</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="636973" lims:id="636973"><Text>set out in the inventory referred to in section 65.</Text></ContinuedSectionSubsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636974" lims:id="636974"><Label>68</Label><Text>Foothills shall, following consultation with the government of the Province, submit to the designated officer for his approval a plan, to be known as the traditional resource protection plan, that sets out the manner in which Foothills intends to carry out the provisions of sections 66 and 67.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="636975" lims:id="636975" level="1"><Label>PART II</Label><TitleText>Environmental Terms and Conditions</TitleText></Heading><Heading lims:inforce-start-date="2006-03-22" lims:fid="636976" lims:id="636976" level="2"><TitleText>General</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636977" lims:id="636977"><Label>69</Label><Text>Foothills shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636978" lims:id="636978"><Label>(a)</Label><Text>plan and construct the pipeline efficiently and expeditiously; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636979" lims:id="636979"><Label>(b)</Label><Text>minimize to the extent possible any adverse environmental impact.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636980" lims:id="636980"><Label>70</Label><Text>Where, in this Part, Foothills is required to make plans, take measures and implement procedures in respect of the environment, Foothills shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636981" lims:id="636981"><Label>(a)</Label><Text>incorporate in such plans, measures and procedures those environmental practices ordinarily followed in constructing and operating pipelines in the Province; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636982" lims:id="636982"><Label>(b)</Label><Text>comply with those standards established under the laws of the Province that are applicable to any pipeline constructed and operated under the laws of the Province except where such standards are inconsistent with the Act, any terms and conditions made thereunder or any other law of Canada.</Text></Paragraph></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="636983" lims:id="636983" level="2"><TitleText>Terrain, Landscape and Waterbodies</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636984" lims:id="636984"><Label>71</Label><Text>Foothills shall, in the planning and construction of the pipeline, minimize, to the satisfaction of the designated officer, any adverse environmental impact on land through which the pipeline passes and on waterbodies or groundwater in the vicinity of the pipeline.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636985" lims:id="636985"><Label>72</Label><Text>Where Foothills proposes a location of the pipeline or a portion thereof to the designated officer for approval, Foothills shall, in a manner satisfactory to the designated officer, take into account the effect, if any, of the construction or operation of the pipeline on the existing or potential uses of any land or waterbody through which the pipeline is proposed to pass.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="636986" lims:id="636986" level="2"><TitleText>Permafrost and Frozen Ground</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636987" lims:id="636987"><Label>73</Label><Text>Foothills shall, in the construction and operation of the pipeline, take measures satisfactory to the designated officer to minimize to the satisfaction of the designated officer any change in the existing physical or biological conditions arising from the consequences of thaw settlement.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636988" lims:id="636988"><Label>74</Label><Text>Foothills shall inspect, to the satisfaction of the designated officer, the implementation of the measures referred to in section 73 and shall, when requested by the designated officer, monitor to the satisfaction of the designated officer, the effectiveness of those measures.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="636989" lims:id="636989" level="2"><TitleText>Drainage, Erosion Control and Revegetation</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636990" lims:id="636990"><Label>75</Label><Text>Foothills shall, in the planning and construction of the pipeline, take such measures as are satisfactory to the designated officer to</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636991" lims:id="636991"><Label>(a)</Label><Text>minimize disturbance of erosion-sensitive terrain; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636992" lims:id="636992"><Label>(b)</Label><Text>minimize construction on erosion-sensitive terrain during periods in which erosion is most likely to be initiated.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636993" lims:id="636993"><Label>76</Label><Text>Foothills shall design and implement erosion control measures satisfactory to the designated officer in respect of those areas through which the pipeline passes to minimize any interference with any other use of land or water and to protect the environment.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636994" lims:id="636994"><Label>77</Label><Text>Foothills shall, in the construction and operation of the pipeline, minimize, to the satisfaction of the designated officer, the development of subsurface channels along the pipeline and</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636995" lims:id="636995"><Label>(a)</Label><Text>any change in the natural drainage patterns, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="636996" lims:id="636996"><Label>(b)</Label><Text>any increase in the sediment loading in waterbodies</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="636997" lims:id="636997"><Text>of those areas through which the pipeline passes.</Text></ContinuedSectionSubsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636998" lims:id="636998"><Label>78</Label><Text>Foothills shall implement such measures as are satisfactory to the designated officer to rehabilitate land disturbed by the construction or operation of the pipeline.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="636999" lims:id="636999"><Label>79</Label><Text>Foothills shall take measures to revegetate land, other than agricultural land, to the satisfaction of the designated officer, disturbed by the construction or operation of the pipeline in a manner that complements any other measure Foothills takes to control drainage and erosion.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637000" lims:id="637000"><Label>80</Label><Text>Where land is to be rehabilitated pursuant to section 78 or revegetated pursuant to section 79, Foothills shall rehabilitate or revegetate, as the case may be, the land in a manner consistent with present land use practices employed in that portion of the Province through which the pipeline passes and shall give priority to the following objectives:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637001" lims:id="637001"><Label>(a)</Label><Text>the control of erosion and its impacts,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637002" lims:id="637002"><Label>(b)</Label><Text>the protection or enhancement of important wildlife habitat, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637003" lims:id="637003"><Label>(c)</Label><Text>the restoration of the aesthetic value of the land</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="637004" lims:id="637004"><Text>and such priority shall be given in the order set out in paragraphs (a) to (c).</Text></ContinuedSectionSubsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637005" lims:id="637005"><Label>81</Label><Text>Where Foothills has backfilled any part of the pipeline under construction, Foothills shall, unless otherwise authorized by the designated officer, commence as soon as practicable but, in any event, within one year of the backfilling, the erosion control measures referred to in section 76, the rehabilitation measures referred to in section 78 and the revegetation measures referred to in section 79.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637006" lims:id="637006"><Label>82</Label><Text>Foothills shall,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637007" lims:id="637007"><Label>(a)</Label><Text>where a revegetation measure referred to in section 79 is taken that involves the seeding of land, use only seed mixes acceptable to the government of the Province;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637008" lims:id="637008"><Label>(b)</Label><Text>take such measures as are satisfactory to the designated officer to minimize the entry of noxious weeds into the area through which the pipeline passes on construction equipment used by Foothills; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637009" lims:id="637009"><Label>(c)</Label><Text>take such measures as are satisfactory to the designated officer to control infestations of noxious weeds caused by the construction of the pipeline.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637010" lims:id="637010"><Label>83</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637011" lims:id="637011"><Label>(1)</Label><Text>Foothills shall, from time to time, inspect, in a manner satisfactory to the designated officer, the implementation of the erosion control measures referred to in section 76, the rehabilitation measures referred to in section 78, the revegetation measures referred to in section 79 and the measures relating to noxious weeds referred to in paragraphs 82(b) and (c).</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637012" lims:id="637012"><Label>(2)</Label><Text>Foothills shall, in carrying out the inspection pursuant to subsection (1), evaluate the effectiveness of the measures referred to in that subsection and, when requested by the designated officer, report to the designated officer in a manner satisfactory to him the results and evaluation of such inspection.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637013" lims:id="637013"><Label>(3)</Label><Text>Where, in the opinion of the designated officer, the measures referred to in subsection (1) are ineffective, Foothills shall implement such remedial measures as are satisfactory to the designated officer.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="637014" lims:id="637014" level="2"><TitleText>Water Quality</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637015" lims:id="637015"><Label>84</Label><Text>Foothills shall not leave significant quantities of deleterious substances, as defined in the <XRefExternal reference-type="act" link="F-14">Fisheries Act</XRefExternal> for the purposes of sections 31, 33, 33.1 and 33.2 of that Act, sediment, silt or wood chips resulting from the construction of the pipeline in any area where they are likely to enter into any waterbody.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637016" lims:id="637016"><Label>85</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637017" lims:id="637017"><Label>(1)</Label><Text>Foothills shall take such measures as are satisfactory to the designated officer to minimize the entry into any waterbody of any aqueous run-off or discharge resulting from the construction of the pipeline.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637018" lims:id="637018"><Label>(2)</Label><Text>Where there is any aqueous run-off or discharge referred to in subsection (1) and that run-off or discharge enters a waterbody, Foothills shall take such measures as are satisfactory to the designated officer to protect the quality of the water in the waterbody.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637019" lims:id="637019"><Label>86</Label><Text>Where the construction or operation of the pipeline takes place within a waterbody, Foothills shall take such measures as are satisfactory to the designated officer to protect the quality of the water in that waterbody.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637020" lims:id="637020"><Label>87</Label><Text>Foothills shall, when requested by the designated officer and at such intervals as are satisfactory to him, sample the water receiving aqueous run-off or discharge resulting from the construction or operation of the pipeline and analyze its quality by a method satisfactory to the designated officer.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="637021" lims:id="637021" level="2"><TitleText>Air Quality</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637022" lims:id="637022"><Label>88</Label><Text>Where Foothills submits to the designated officer for his approval proposals for the design and location of a compressor station for the pipeline, Foothills shall include in the submission a description of the measures Foothills intends to implement</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637023" lims:id="637023"><Label>(a)</Label><Text>to control air pollution and to disperse and, where possible, reduce any ice fog resulting from the operation of the pipeline; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637024" lims:id="637024"><Label>(b)</Label><Text>to preserve the aesthetic value of the landscape in the vicinity of the pipeline.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637025" lims:id="637025"><Label>89</Label><Text>Foothills shall, in the operation of a compressor station, take such measures as are satisfactory to the designated officer to minimize any adverse effects of air pollution and ice fog resulting from the operation of the pipeline on</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637026" lims:id="637026"><Label>(a)</Label><Text>the health or recreation of any person;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637027" lims:id="637027"><Label>(b)</Label><Text>transportation; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637028" lims:id="637028"><Label>(c)</Label><Text>wildlife and wildlife habitat.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637029" lims:id="637029"><Label>90</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637030" lims:id="637030"><Label>(1)</Label><Text>Foothills shall, at each compressor station selected by the designated officer,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637031" lims:id="637031"><Label>(a)</Label><Text>sample and analyze air quality in the vicinity of that compressor station,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637032" lims:id="637032"><Label>(b)</Label><Text>sample and analyze gaseous emissions from the compressor station, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637033" lims:id="637033"><Label>(c)</Label><Text>record the quantity and type of fuel consumed at that compressor station</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="637034" lims:id="637034"><Text>by a method and at times approved by the designated officer.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637035" lims:id="637035"><Label>(2)</Label><Text>Foothills shall report to the designated officer, when requested by him, the results of the sampling and analysis and measurements referred to in paragraphs (1)(a) and (b) and the record of the quantity and type of fuel consumed referred to in paragraph (1)(c).</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="637036" lims:id="637036" level="2"><TitleText>Noise</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637037" lims:id="637037"><Label>91</Label><Text>Foothills shall incorporate noise abatement devices in the design of any compressor station it installs for the pipeline.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637038" lims:id="637038"><Label>92</Label><Text>Foothills shall, in the construction and operation of the pipeline, take such noise abatement measures as are satisfactory to the designated officer to minimize the disturbance by noise of</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637039" lims:id="637039"><Label>(a)</Label><Text>persons residing in the vicinity of the pipeline;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637040" lims:id="637040"><Label>(b)</Label><Text>wildlife, referred to in section 94, where continued existence is threatened in the areas of land and waterbodies set out in the list referred to in that section during the periods of time set out in the list in respect of such wildlife; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637041" lims:id="637041"><Label>(c)</Label><Text>livestock in the vicinity of the pipeline.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637042" lims:id="637042"><Label>93</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637043" lims:id="637043"><Label>(1)</Label><Text>Foothills shall, when requested by the designated officer and in a manner satisfactory to him, measure noise levels caused by the operation of pipeline facilities and equipment and shall report, within a reasonable period of time, the noise levels so measured to the designated officer.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637044" lims:id="637044"><Label>(2)</Label><Text>Where, in the opinion of the designated officer, any noise level reported to him pursuant to subsection (1) disturbs persons, wildlife or livestock referred to in section 92, Foothills shall take such remedial measures as are satisfactory to the designated officer.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="637045" lims:id="637045" level="2"><TitleText>Wildlife</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637046" lims:id="637046"><Label>94</Label><Text>Foothills shall, when requested by the designated officer and following consultation with the government of the Province, submit to him for his approval a list setting out those areas of land and waterbodies in which, and the periods of time in respect of those areas and waterbodies during which, the construction or operation of the pipeline may</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637047" lims:id="637047"><Label>(a)</Label><Text>threaten the continued existence of significant wildlife populations; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637048" lims:id="637048"><Label>(b)</Label><Text>result in significant adverse effects on significant wildlife populations.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637049" lims:id="637049"><Label>95</Label><Text>Foothills shall, in a manner satisfactory to the designated officer, prepare construction schedules for the pipeline and propose the location of the pipeline in such a manner that when the construction of the pipeline is being carried out the adverse impact on wildlife in any area and during any periods of time in respect of that area set out in the list referred to in section 94 is minimized.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637050" lims:id="637050"><Label>96</Label><Text>Foothills shall take such measures as are satisfactory to the designated officer to prevent big game animals from being obstructed or entrapped by the construction of the pipeline.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637051" lims:id="637051"><Label>97</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637052" lims:id="637052"><Label>(1)</Label><Text>Where requested by the designated officer, Foothills shall, during the construction and operation of the pipeline, monitor, at such locations and times and for such periods as are satisfactory to the designated officer, the impact resulting from the construction and operation of the pipeline on the habitat, seasonal distribution and movement of significant wildlife populations.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637053" lims:id="637053"><Label>(2)</Label><Text>Foothills shall, in carrying out the monitoring pursuant to subsection (1), evaluate the effectiveness of its measures to mitigate any adverse impact on significant wildlife populations and shall, when requested by the designated officer, report to him the results of the monitoring.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637054" lims:id="637054"><Label>98</Label><Text>Where, in the opinion of the designated officer,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637055" lims:id="637055"><Label>(a)</Label><Text>the proposed location of the pipeline or the construction schedule of the pipeline referred to in section 95 is such that it does not minimize the adverse environmental impact on wildlife, or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637056" lims:id="637056"><Label>(b)</Label><Text>the measures taken pursuant to section 96 are ineffective</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="637057" lims:id="637057"><Text>Foothills shall take such remedial measures as are satisfactory to the designated officer.</Text></ContinuedSectionSubsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637058" lims:id="637058"><Label>99</Label><Text>Foothills shall take such measures as are satisfactory to the designated officer to prevent the construction and operation of the pipeline from unreasonably interfering with hunting, guiding or trapping in the vicinity of the pipeline.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="637059" lims:id="637059" level="2"><TitleText>Fisheries</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637060" lims:id="637060"><Label>100</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637061" lims:id="637061"><Label>(1)</Label><Text>Foothills shall, when requested by the designated officer and following consultation with the government of the Province, submit to him for his approval a list setting out those areas of fish habitat in which, and the periods of time in respect of those areas during which, the construction or operation of the pipeline may threaten the continued existence of significant fish populations.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637062" lims:id="637062"><Label>(2)</Label><Text>The areas referred to in subsection (1) shall include fish spawning and rearing grounds, overwintering areas and migration routes in the waterbodies through which the pipeline passes.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637063" lims:id="637063"><Label>(3)</Label><Text>The periods of time referred to in subsection (1) shall include those periods for the spawning, incubation, emergence and rearing and migration of the fish.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637064" lims:id="637064"><Label>101</Label><Text>Where Foothills prepares construction schedules for the pipeline, Foothills shall prepare the schedules in such a manner that when the construction of the pipeline is carried out any adverse impact on the fish in any fish habitat and during the periods of time in respect of that habitat set out in the list referred to in subsection 100(1) is minimized to the satisfaction of the designated officer.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637065" lims:id="637065"><Label>102</Label><Text>Where the pipeline or any facility is</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637066" lims:id="637066"><Label>(a)</Label><Text>scheduled to be constructed at a time, or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637067" lims:id="637067"><Label>(b)</Label><Text>located at a place</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="637068" lims:id="637068"><Text>that may be disruptive to significant fish populations, Foothills shall take such measures as are satisfactory to the designated officer to avoid or minimize, to the satisfaction of the designated officer, any adverse environmental effects on significant fish populations and fish habitat.</Text></ContinuedSectionSubsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637069" lims:id="637069"><Label>103</Label><Text>Foothills shall implement construction and operation practices to protect, to the satisfaction of the designated officer, significant fish populations and fish habitat against any adverse effect of any siltation, excavation of granular materials, spills of fuel or toxic chemicals, changes in water temperature and chemistry or reduction in dissolved oxygen in the water in any waterbody through which the pipeline passes.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637070" lims:id="637070"><Label>104</Label><Text>Foothills shall not, during the construction of the pipeline, unless permitted by the designated officer,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637071" lims:id="637071"><Label>(a)</Label><Text>obstruct fish migration routes during any period set out in the list referred to in subsection 100(1) by any blockage, diversion or prolonged acceleration of water flow; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637072" lims:id="637072"><Label>(b)</Label><Text>during such period, withdraw water from overwintering areas or from groundwater directly replenishing those areas.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637073" lims:id="637073"><Label>105</Label><Text>Where Foothills places a culvert in a waterbody frequented by fish populations, Foothills shall take such measures as are satisfactory to the designated officer to allow the passage of fish populations through the culvert during any period set out in the list referred to in subsection 100(1).</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637074" lims:id="637074"><Label>106</Label><Text>Foothills shall take measures satisfactory to the designated officer to prevent the construction and operation of the pipeline from unreasonably interfering with any domestic, commercial or sport fishing or adversely affecting any fishing area in any area through which the pipeline passes.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637075" lims:id="637075"><Label>107</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637076" lims:id="637076"><Label>(1)</Label><Text>When requested by the designated officer, Foothills shall, in a manner satisfactory to him, monitor fish movements and fish habitat utilization during the construction of the pipeline.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637077" lims:id="637077"><Label>(2)</Label><Text>Foothills shall, in carrying out the monitoring referred to in subsection (1), evaluate the effectiveness of</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637078" lims:id="637078"><Label>(a)</Label><Text>the construction schedule referred to in section 101,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637079" lims:id="637079"><Label>(b)</Label><Text>the measures referred to in sections 102, 105 and 106, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637080" lims:id="637080"><Label>(c)</Label><Text>the practices referred to in section 103</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="637081" lims:id="637081"><Text>and shall, when requested by the designated officer, report to the designated officer in a manner satisfactory to him the results of the evaluation and of the monitoring referred to in subsection (1).</Text></ContinuedSectionSubsection></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637082" lims:id="637082"><Label>108</Label><Text>Where, in the opinion of the designated officer, the measures or practices referred to in section 102, 103, 105 or 106 are ineffective, Foothills shall take such remedial measures as are satisfactory to the designated officer.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="637083" lims:id="637083" level="2"><TitleText>Special Interest Areas</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637084" lims:id="637084"><Label>109</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637085" lims:id="637085"><Label>(1)</Label><Text>Foothills shall, in consultation with the government of the Province, identify each area of natural or cultural significance in the vicinity of the proposed route of the pipeline and shall propose a location of the pipeline that, insofar as possible, does not pass through that area.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637086" lims:id="637086"><Label>(2)</Label><Text>Where the location referred to in subsection (1) of the pipeline is in an area identified under that subsection and the location of the pipeline has been approved by the designated officer, Foothills shall take such measures as are satisfactory to the designated officer to protect the natural and cultural values of that area.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637087" lims:id="637087"><Label>110</Label><Text>Foothills shall take such measures as are satisfactory to the designated officer to minimize the adverse impact of the construction of the pipeline within 2 km of the limits of any park, wildlife or game sanctuary, ecological reserve, International Biological Program site, historical or archaeological site or research, conservation or recreation site proposed or established under any law of Canada or of the Province.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637088" lims:id="637088"><Label>111</Label><Text>Foothills shall obtain the approval of the designated officer before commencing the construction of any portion of the pipeline within 30 m of a monument, archaeological site or burial ground.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637089" lims:id="637089"><Label>112</Label><Text>Foothills shall establish and conduct an archaeological program satisfactory to the designated officer to</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637090" lims:id="637090"><Label>(a)</Label><Text>identify, investigate and protect or excavate archaeological sites, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637091" lims:id="637091"><Label>(b)</Label><Text>analyze archaeological and associated palaeoecological materials</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="637092" lims:id="637092"><Text>on land used for or disturbed by the construction of the pipeline.</Text></ContinuedSectionSubsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637093" lims:id="637093"><Label>113</Label><Text>Foothills shall, at any time at the request of the designated officer and at the termination of the archaeological program referred to in section 112, submit to the designated officer a report satisfactory to the designated officer of the results of that program.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637094" lims:id="637094"><Label>114</Label><Text>Foothills shall provide, when requested by the designated officer, evidence satisfactory to the designated officer that any archaeological and related materials, field notes, plans and maps, photographs, analyses and other relevant documents collected during the archaeological program referred to in section 112 are retained at a place and under such arrangements as are approved by the government of the Province.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637095" lims:id="637095"><Label>115</Label><Text>Foothills shall immediately report any discovery of a historical or archaeological site to the designated officer and shall not disturb the site without his prior approval.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637096" lims:id="637096"><Label>116</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637097" lims:id="637097"><Label>(1)</Label><Text>In constructing the pipeline, Foothills shall avoid, where practicable, disturbance of geodetic or legal survey monuments.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637098" lims:id="637098"><Label>(2)</Label><Text>Where a geodetic monument is disturbed in the course of the construction of the pipeline, Foothills shall report such disturbance forthwith to the designated officer.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637099" lims:id="637099"><Label>(3)</Label><Text>Where a geodetic monument is disturbed, Foothills shall, at its expense and in accordance with the instructions of the Dominion Geodesist, cause the monument to be restored or re-established.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="637100" lims:id="637100" level="2"><TitleText>Agricultural Land</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637101" lims:id="637101"><Label>117</Label><Text>Foothills shall, when constructing the pipeline on land comprising part of an agricultural land reserve or grazing reserve, take into account the provisions set out in the document entitled “Terms and Conditions for Linear Development in Agricultural Land Reserves and Grazing Reserves” issued by the Ministry of Agriculture of the government of the Province.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637102" lims:id="637102"><Label>118</Label><Text>Where topsoil on agricultural land is disturbed or removed during construction of the pipeline, Foothills shall take such measures as are satisfactory to the landowner or tenant as soon as possible after the disturbance or removal to stabilize the surface or replace such topsoil of such agricultural land and to return it, as far as is practicable, to its previous level of productivity.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637103" lims:id="637103"><Label>119</Label><Text>Where, as a consequence of the construction of the pipeline, a fence or gate is damaged or destroyed by Foothills, Foothills shall, in consultation with the owner of the land on which the fence or gate is situated or the tenant thereof, repair or replace that fence or gate.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637104" lims:id="637104"><Label>120</Label><Text>Where Foothills requires access to the pipeline for the purpose of maintenance through land that is fenced, Foothills shall, in consultation with the landowner or tenant, construct and maintain a gate in the fence for such access.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637105" lims:id="637105"><Label>121</Label><Text>Where Foothills has stabilized the surface of agricultural land and returned it as far as is practicable to its previous level of productivity pursuant to section 118, Foothills shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637106" lims:id="637106"><Label>(a)</Label><Text>inspect to the satisfaction of the landowner or tenant agricultural land that may have been or may be affected by the pipeline;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637107" lims:id="637107"><Label>(b)</Label><Text>report within a reasonable period of time to the designated officer any evidence of any adverse environmental impact on agricultural land; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637108" lims:id="637108"><Label>(c)</Label><Text>take such remedial measures as directed by the designated officer in respect of any agricultural land discovered by the inspection to be affected by the pipeline.</Text></Paragraph></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="637109" lims:id="637109" level="2"><TitleText>Clearing</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637110" lims:id="637110"><Label>122</Label><Text>Foothills shall minimize to the satisfaction of the designated officer any adverse environmental impact of vegetation-clearing operations by Foothills including such impact on erosion-sensitive terrain.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637111" lims:id="637111"><Label>123</Label><Text>Foothills shall, in respect of the construction of the pipeline,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637112" lims:id="637112"><Label>(a)</Label><Text>clear vegetation from only those areas essential for the construction;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637113" lims:id="637113"><Label>(b)</Label><Text>cut, stack and dispose of any merchantable timber cleared by Foothills in such manner as is satisfactory to the designated officer;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637114" lims:id="637114"><Label>(c)</Label><Text>leave a buffer strip of undisturbed vegetation satisfactory to the designated officer</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="637115" lims:id="637115"><Label>(i)</Label><Text>between any area cleared by Foothills of vegetation and an adjacent waterbody, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="637116" lims:id="637116"><Label>(ii)</Label><Text>between any area cleared of vegetation and an adjacent road;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637117" lims:id="637117"><Label>(d)</Label><Text>promptly remove any debris entering or likely to enter any waterbody as a result of the clearing of vegetation by Foothills; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637118" lims:id="637118"><Label>(e)</Label><Text>take measures satisfactory to the designated officer to minimize windthrow in buffer strips.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637119" lims:id="637119"><Label>124</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637120" lims:id="637120"><Label>(1)</Label><Text>Foothills shall, when clearing any area for construction, take measures to minimize to the satisfaction of the designated officer the operation of any machinery along or across any permanent or intermittent river or stream channel.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637121" lims:id="637121"><Label>(2)</Label><Text>Foothills shall not skid any logs along or across any unfrozen permanent river or stream channel or along any unfrozen intermittent stream channel.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637122" lims:id="637122"><Label>125</Label><Text>Foothills shall dispose of any debris resulting from the clearing of vegetation by Foothills in such manner as is satisfactory to the designated officer.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637123" lims:id="637123"><Label>126</Label><Text>Foothills shall not pile any debris resulting from the construction of the pipeline in a manner that creates a continuous barrier to big game animal movements.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="637124" lims:id="637124" level="2"><TitleText>Fuel and Other Hazardous Material</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637125" lims:id="637125"><Label>127</Label><Text>Foothills shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637126" lims:id="637126"><Label>(a)</Label><Text>establish procedures satisfactory to the designated officer to minimize the possibility of an accident occurring during the storage, handling and use of fuel or any other hazardous material;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637127" lims:id="637127"><Label>(b)</Label><Text>locate, in a manner satisfactory to the designated officer, storage and handling sites for fuel and hazardous material to minimize any contamination of any waterbody set out in the list referred to in section 94, any fish habitat set out in the list referred to in subsection 100(1) or any important fish harvesting area; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637128" lims:id="637128"><Label>(c)</Label><Text>establish procedures satisfactory to the designated officer to contain and clean up any fuel or other hazardous material spilled, misused or allowed to escape.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637129" lims:id="637129"><Label>128</Label><Text>Foothills shall not, in constructing the pipeline,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637130" lims:id="637130"><Label>(a)</Label><Text>use bladder tanks to store fuel; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637131" lims:id="637131"><Label>(b)</Label><Text>store fuel within 300 m of a waterbody unless it has obtained the approval of the designated officer.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637132" lims:id="637132"><Label>129</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637133" lims:id="637133"><Label>(1)</Label><Text>Where Foothills uses a fuel storage area containing any above-ground tank exceeding 5 000 <Emphasis style="italic">l</Emphasis> in capacity, Foothills shall surround that area by a dyke of reinforced concrete or a dyke of earth lined with plastic or other impervious material.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637134" lims:id="637134"><Label>(2)</Label><Text>Foothills shall, in constructing a dyke referred to in subsection (1), comply with any requirements established by the designated officer for the design and location of the dyke and of the area that it surrounds.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637135" lims:id="637135"><Label>130</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637136" lims:id="637136"><Label>(1)</Label><Text>Where Foothills stores more than 5 000 <Emphasis style="italic">l</Emphasis> of fuel in storage facilities at any place, it shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637137" lims:id="637137"><Label>(a)</Label><Text>establish procedures satisfactory to the designated officer to detect any loss of fuel from such storage facilities; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637138" lims:id="637138"><Label>(b)</Label><Text>record all fuel transfers to and from such facilities.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637139" lims:id="637139"><Label>(2)</Label><Text>Where Foothills determines that a loss of fuel has occurred from a storage facility referred to in subsection (1), it shall investigate the cause of such loss and take such measures as are satisfactory to the designated officer to prevent further loss.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637140" lims:id="637140"><Label>131</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637141" lims:id="637141"><Label>(1)</Label><Text>Foothills shall establish procedures satisfactory to the designated officer to detect any loss of hazardous material at any storage or handling facility used by Foothills.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637142" lims:id="637142"><Label>(2)</Label><Text>Where there is any loss of hazardous material referred to in subsection (1), Foothills shall investigate the cause of the loss and take such measures as are satisfactory to the designated officer to prevent further loss.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637143" lims:id="637143"><Label>132</Label><Text>Foothills shall not</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637144" lims:id="637144"><Label>(a)</Label><Text>use, transport or dispose of any radioactive materials, or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637145" lims:id="637145"><Label>(b)</Label><Text>use herbicides or pesticides except for domestic use</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="637146" lims:id="637146"><Text>unless such use, transportation or disposition, as the case may be, is approved by the designated officer.</Text></ContinuedSectionSubsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="637147" lims:id="637147" level="2"><TitleText>Waste Management</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637148" lims:id="637148"><Label>133</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637149" lims:id="637149"><Label>(1)</Label><Text>Foothills shall collect any liquid or solid wastes produced as a consequence of the construction, operation or abandonment of the pipeline and, where required by the designated officer, treat them in a manner satisfactory to the designated officer.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637150" lims:id="637150"><Label>(2)</Label><Text>Foothills shall dispose of the liquid or solid wastes referred to in subsection (1) in a manner satisfactory to the designated officer.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637151" lims:id="637151"><Label>134</Label><Text>Foothills shall not use</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637152" lims:id="637152"><Label>(a)</Label><Text>a natural waterbody, swamp, marsh, bog or fen as a lagoon for the containment of any liquid or solid wastes referred to in subsection 133(1), or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637153" lims:id="637153"><Label>(b)</Label><Text>borrow pits as liquid or solid waste disposal sites</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="637154" lims:id="637154"><Text>unless such use is approved by the designated officer.</Text></ContinuedSectionSubsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637155" lims:id="637155"><Label>135</Label><Text>Foothills shall submit to the designated officer for approval any proposed location for a liquid waste lagoon or solid waste disposal site for use by Foothills during the construction of the pipeline.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637156" lims:id="637156"><Label>136</Label><Text>Foothills shall minimize to the satisfaction of the designated officer any contamination of any waterbody or groundwater by waste from solid waste disposal sites.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637157" lims:id="637157"><Label>137</Label><Text>Foothills shall establish procedures satisfactory to the designated officer for the handling and disposal of any waste containing a hazardous material.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637158" lims:id="637158"><Label>138</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637159" lims:id="637159"><Label>(1)</Label><Text>Foothills shall meet any standards of composition as may be specified by the designated officer for the effluent from a liquid waste treatment system used by Foothills.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637160" lims:id="637160"><Label>(2)</Label><Text>Foothills shall discharge the effluent referred to in subsection (1) at times and under such conditions as are satisfactory to the designated officer.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637161" lims:id="637161"><Label>139</Label><Text>Foothills shall establish procedures satisfactory to the designated officer to prevent access by carnivorous mammals and bears to waste disposal sites, incinerator sites or other waste storage or treatment sites and to minimize the attractiveness of such sites to such mammals and bears.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637162" lims:id="637162"><Label>140</Label><Text>Foothills shall dispose of waste soil, rock, stumps, vegetation and other materials resulting from pipeline construction in such a manner as is satisfactory to the designated officer.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637163" lims:id="637163"><Label>141</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637164" lims:id="637164"><Label>(1)</Label><Text>Foothills shall, in such a manner as is satisfactory to the designated officer,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637165" lims:id="637165"><Label>(a)</Label><Text>monitor the operation of its liquid waste treatment facilities and the quantity and composition of effluent discharges therefrom, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637166" lims:id="637166"><Label>(b)</Label><Text>monitor the effectiveness of its solid waste management procedures</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="637167" lims:id="637167"><Text>at such times as directed by the designated officer.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637168" lims:id="637168"><Label>(2)</Label><Text>Foothills shall forthwith report the results of the monitoring referred to in subsection (1) to the designated officer.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637169" lims:id="637169"><Label>(3)</Label><Text>Foothills shall take such remedial measures as directed by the designated officer in respect of solid waste management and liquid waste treatment.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="637170" lims:id="637170" level="2"><TitleText>Granular Materials, Borrow Pits and Quarries</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637171" lims:id="637171"><Label>142</Label><Text>Where Foothills uses a borrow pit or quarry, Foothills shall minimize to the satisfaction of the designated officer</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637172" lims:id="637172"><Label>(a)</Label><Text>the disturbance of the environment in the vicinity of the borrow pit or quarry;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637173" lims:id="637173"><Label>(b)</Label><Text>the amount of land used for the borrow pit or quarry; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637174" lims:id="637174"><Label>(c)</Label><Text>the amount of materials extracted from the borrow pit or quarry.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637175" lims:id="637175"><Label>143</Label><Text>Foothills shall, where possible, use existing roads, trails or cutlines for access to borrow pits or quarries.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637176" lims:id="637176"><Label>144</Label><Text>Foothills shall leave buffer strips of undisturbed vegetation between any borrow pit or quarry that it opens and any adjacent road.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637177" lims:id="637177"><Label>145</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637178" lims:id="637178"><Label>(1)</Label><Text>Foothills shall not, without the approval of the designated officer, use a borrow pit or quarry adjacent to or within a waterbody, swamp, marsh, bog or fen.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637179" lims:id="637179"><Label>(2)</Label><Text>Where the use of a borrow pit or quarry referred to in subsection (1) has been approved by the designated officer, Foothills shall take such measures as are satisfactory to the designated officer to minimize siltation in that waterbody, swamp, marsh, bog or fen, as the case may be.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637180" lims:id="637180"><Label>146</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637181" lims:id="637181"><Label>(1)</Label><Text>When directed by the designated officer, Foothills shall close and rehabilitate, in a manner satisfactory to the designated officer, any borrow pit or quarry that it uses.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637182" lims:id="637182"><Label>(2)</Label><Text>Where Foothills is required to rehabilitate a borrow pit or quarry pursuant to subsection (1), it shall, to the satisfaction of the designated officer,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637183" lims:id="637183"><Label>(a)</Label><Text>stabilize the ground surface; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637184" lims:id="637184"><Label>(b)</Label><Text>re-establish vegetation on such ground surface.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637185" lims:id="637185"><Label>147</Label><Text>Where Foothills uses any granular materials for the construction of the pipeline, it shall use such granular materials in a manner satisfactory to the designated officer and compatible with any other use of such materials by persons residing in that portion of the Province through which the pipeline passes.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="637186" lims:id="637186" level="2"><TitleText>Blasting</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637187" lims:id="637187"><Label>148</Label><Text>Foothills shall establish blasting procedures satisfactory to the designated officer to minimize</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637188" lims:id="637188"><Label>(a)</Label><Text>any adverse effects on bird, fish or mammal populations, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637189" lims:id="637189"><Label>(b)</Label><Text>any interference with the fishing, hunting, guiding or trapping</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="637190" lims:id="637190"><Text>in the area through which the pipeline passes.</Text></ContinuedSectionSubsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637191" lims:id="637191"><Label>149</Label><Text>Foothills shall not blast within 20 m of any waterbody, swamp or marsh without the approval of the designated officer.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637192" lims:id="637192"><Label>150</Label><Text>Where Foothills intends to blast, it shall advise persons living in the vicinity of its intention and of the time of the intended blasting.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="637193" lims:id="637193" level="2"><TitleText>Water Crossings</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637194" lims:id="637194"><Label>151</Label><Text>Foothills shall, when requested by the designated officer, submit to him site-specific data satisfactory to him on the hydrological or geotechnical conditions at any place where the pipeline crosses any waterbody.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637195" lims:id="637195"><Label>152</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637196" lims:id="637196"><Label>(1)</Label><Text>Foothills shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637197" lims:id="637197"><Label>(a)</Label><Text>inspect every pipeline water crossing for evidence of deterioration in bank stability and stream bed condition, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637198" lims:id="637198"><Label>(b)</Label><Text>when directed by the designated officer, monitor the consequences of any pipeline water crossing</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="637199" lims:id="637199"><Text>in such manner as is satisfactory to the designated officer.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637200" lims:id="637200"><Label>(2)</Label><Text>Foothills shall report to the designated officer, within a reasonable period of time, the results of the inspection referred to in paragraph (1)(a) and, when required by the designated officer, the results of the monitoring referred to in paragraph (1)(b).</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637201" lims:id="637201"><Label>153</Label><Text>Where the designated officer is of the opinion that remedial measures are necessary at a pipeline water crossing, Foothills shall take such remedial measures as are satisfactory to the designated officer.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637202" lims:id="637202"><Label>154</Label><Text>Foothills shall,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637203" lims:id="637203"><Label>(a)</Label><Text>in respect of every waterbody referred to in the list required to be submitted pursuant to section 94 in respect of the threatened existence of wildlife, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637204" lims:id="637204"><Label>(b)</Label><Text>in respect of every waterbody containing a fish habitat area referred to in the list required to be submitted pursuant to subsection 100(1),</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="637205" lims:id="637205"><Text>in which groundwater contributes significantly to winterflow in or under the bed of that waterbody, take such measures as are satisfactory to the designated officer to maintain adequate winter groundwater and channel flow in such waterbody.</Text></ContinuedSectionSubsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637206" lims:id="637206"><Label>155</Label><Text>When constructing the pipeline across a stream, Foothills shall trench, lay pipe and backfill the banks of the stream as expeditiously as possible.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637207" lims:id="637207"><Label>156</Label><Text>Where the natural action of a stream will not restore the bed of such stream to its original shape and extent after the completion of construction, Foothills shall, unless otherwise directed by the designated officer, take measures to restore the stream to its original shape and extent by using the original material of the stream bed or other material of equivalent stability.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="637208" lims:id="637208" level="2"><TitleText>Water Withdrawal, Water Discharge and Hydrostatic Testing</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637209" lims:id="637209"><Label>157</Label><Text>Where Foothills withdraws water from or discharges water into a waterbody, it shall withdraw or discharge the water in a manner satisfactory to the designated officer and in a manner that will not have an unreasonably adverse effect on</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637210" lims:id="637210"><Label>(a)</Label><Text>the level or rate of flow of water in the waterbody or well from which the water withdrawal is made or into which the discharge is made;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637211" lims:id="637211"><Label>(b)</Label><Text>the existing use of the waterbody from which the water withdrawal is made or into which the discharge is made;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637212" lims:id="637212"><Label>(c)</Label><Text>the transportation on or access to the waterbody from which the water withdrawal is made or into which the discharge is made;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637213" lims:id="637213"><Label>(d)</Label><Text>the trapping or fishing by persons residing in the vicinity of the pipeline;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637214" lims:id="637214"><Label>(e)</Label><Text>the fish populations in or dependent on the waterbody from which the water withdrawal is made or into which the discharge is made; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637215" lims:id="637215"><Label>(f)</Label><Text>any waterfowl or mammal populations using any waterbody or its margins from which the water withdrawal is made or into which the discharge is made.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637216" lims:id="637216"><Label>158</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637217" lims:id="637217"><Label>(1)</Label><Text>Subject to subsection (2), Foothills shall not allow, during any withdrawal of water from a waterbody for hydrostatic testing, the rate of flow or depth of water in that waterbody to fall below such minimum as is specified by the designated officer.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637218" lims:id="637218"><Label>(2)</Label><Text>Foothills may withdraw water referred to in subsection (1) where the rate of flow and depth of water in the waterbody is below the minimum specified pursuant to that subsection if such withdrawal is approved by the designated officer.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637219" lims:id="637219"><Label>159</Label><Text>Foothills shall, when designing or operating a camp water system, compressor station water system, granular material washing system or any other water-related system, design or operate, as the case may be, that system in a manner that will minimize the use of water.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637220" lims:id="637220"><Label>160</Label><Text>Foothills shall, when carrying out hydrostatic testing of the pipeline, carry out such tests in a manner that will minimize the use of water.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637221" lims:id="637221"><Label>161</Label><Text>Foothills shall appoint a qualified person to supervise the withdrawal and discharge of water for the construction or testing of the pipeline.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637222" lims:id="637222"><Label>162</Label><Text>Where Foothills withdraws water for the construction or testing of the pipeline, it shall install screens satisfactory to the designated officer on all water intakes.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637223" lims:id="637223"><Label>163</Label><Text>Foothills shall, in a manner satisfactory to the officer, furnish him with the details in respect of each water withdrawal or discharge used for testing the pipeline.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637224" lims:id="637224"><Label>164</Label><Text>Foothills shall take such measures as are satisfactory to the designated officer</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637225" lims:id="637225"><Label>(a)</Label><Text>to avoid spilling any test fluid other than as a result of the failure of the pipe when being tested; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637226" lims:id="637226"><Label>(b)</Label><Text>to clean up the effect of any hydrostatic fluid that has been spilled.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637227" lims:id="637227"><Label>165</Label><Text>Foothills shall not discharge any hydrostatic test fluid unless the fluid meets such standards of composition for such test fluid as are satisfactory to the designated officer.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637228" lims:id="637228"><Label>166</Label><Text>Foothills shall conduct all hydrostatic tests of the pipeline in the presence of the designated officer or his authorized representative.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="637229" lims:id="637229" level="2"><TitleText>Roads and Other Facilities</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637230" lims:id="637230"><Label>167</Label><Text>Where Foothills is required to submit to the designated officer for approval the design and location of any permanent access road or pipeline facility, other than a road or facility on the pipeline right-of-way, and the procedures to be used in the constructing, operating or abandonment of the road or facility, Foothills shall take into account the local and regional environment including the following:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637231" lims:id="637231"><Label>(a)</Label><Text>hydrological characteristics;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637232" lims:id="637232"><Label>(b)</Label><Text>terrain conditions;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637233" lims:id="637233"><Label>(c)</Label><Text>ground thermal regime;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637234" lims:id="637234"><Label>(d)</Label><Text>wildlife and fish populations;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637235" lims:id="637235"><Label>(e)</Label><Text>land and water use for purposes other than for the pipeline;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637236" lims:id="637236"><Label>(f)</Label><Text>archaeological sites; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637237" lims:id="637237"><Label>(g)</Label><Text>aesthetic value of the landscape and waterbodies.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637238" lims:id="637238"><Label>168</Label><Text>Foothills shall maintain every road surface in such a manner that cross drainage is both efficient and effective without causing accelerated erosion or ponding.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637239" lims:id="637239"><Label>169</Label><Text>Unless otherwise directed by the designated officer, Foothills shall install a bridge or culvert at every place where a road crosses a permanent or intermittent river or stream.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637240" lims:id="637240"><Label>170</Label><Text>Foothills shall, where required by the designated officer, render any access road built or rehabilitated by it, other than a road to be used by Foothills in the maintenance of the pipeline, impassable and take such measures as are satisfactory to the designated officer to control erosion of such road.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637241" lims:id="637241"><Label>171</Label><Text>Foothills shall not construct or use a bridge over a waterbody that consists of logs on top of which earth has been placed.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637242" lims:id="637242"><Label>172</Label><Text>Where Foothills builds any snow access road it shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637243" lims:id="637243"><Label>(a)</Label><Text>locate such road in a manner that minimizes disturbance to vegetation; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637244" lims:id="637244"><Label>(b)</Label><Text>breach such road, where necessary, in preparation for spring run-off.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637245" lims:id="637245"><Label>173</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637246" lims:id="637246"><Label>(1)</Label><Text>Where Foothills builds any ice bridge it shall locate such ice bridge in a manner that minimizes approach grades and cuts in the river or stream over which the bridge is built.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637247" lims:id="637247"><Label>(2)</Label><Text>Foothills shall not use debris or fill in the construction of an ice bridge referred to in subsection (1).</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="637248" lims:id="637248" level="2"><TitleText>Machinery, Transportation and Construction Equipment</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637249" lims:id="637249"><Label>174</Label><Text>Foothills shall take such measures as are satisfactory to the designated officer to minimize the use by Foothills of machinery, transportation and construction equipment in any area other than public and access roads and the pipeline right-of-way.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637250" lims:id="637250"><Label>175</Label><Text>Where Foothills operates machinery, transportation or construction equipment within any waterbody, such operation shall take place during such time and in such manner as is satisfactory to the designated officer.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637251" lims:id="637251"><Label>176</Label><Text>Foothills shall equip and maintain all machinery and transportation and construction equipment with factory standard emission and noise control devices.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="637252" lims:id="637252" level="2"><TitleText>Inspection and Monitoring</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637253" lims:id="637253"><Label>177</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637254" lims:id="637254"><Label>(1)</Label><Text>Foothills shall, in a manner satisfactory to the designated officer, inspect the pipeline and the land and water disturbed by the pipeline, evaluate the results of the inspection and, when directed by the designated officer, monitor the environmental impact of the pipeline.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637255" lims:id="637255"><Label>(2)</Label><Text>When requested by the designated officer, Foothills shall, within a reasonable period of time, report the results of the inspection, evaluation and monitoring referred to in subsection (1) to the designated officer.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637256" lims:id="637256"><Label>178</Label><Text>Where the designated officer is of the opinion that the construction or operation of the pipeline has caused or is likely to cause a significant adverse environmental impact, Foothills shall take such measures as are satisfactory to the designated officer to mitigate or remedy the environmental impact and to prevent its recurrence.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="637257" lims:id="637257" level="2"><TitleText>Submission and Implementation of Environmental Plans</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637258" lims:id="637258"><Label>179</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637259" lims:id="637259"><Label>(1)</Label><Text>Foothills shall submit to the designated officer for approval one or more plans or manuals that set out the procedures and measures by which Foothills intends to</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637260" lims:id="637260"><Label>(a)</Label><Text>comply with this Part;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637261" lims:id="637261"><Label>(b)</Label><Text>carry out any environmental requirements imposed by law; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637262" lims:id="637262"><Label>(c)</Label><Text>carry out the protection of the environment other than by measures required by this Part.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637263" lims:id="637263"><Label>(2)</Label><Text>Foothills shall, by such date as may be fixed by the designated officer, submit to the designated officer a plan schedule for his approval that sets out the date each plan or manual referred to in subsection (1) is to be submitted to the designated officer.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637264" lims:id="637264"><Label>(3)</Label><Text>The plan schedule referred to in subsection (2), when approved by the designated officer, constitutes Foothills’ plan schedule and Foothills shall comply therewith.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637265" lims:id="637265"><Label>180</Label><Text>Where the designated officer approves a procedure or measure set out in a plan or manual submitted by Foothills pursuant to subsection 179(1), Foothills shall thereupon carry out such procedure or measure.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637266" lims:id="637266"><Label>181</Label><Text>Where, subsequent to the approval by the designated officer of any of the measures or procedures referred to in subsection 179(1), Foothills obtains any additional information of environmental significance relating thereto, Foothills shall forthwith report such information to the designated officer.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637267" lims:id="637267"><Label>182</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637268" lims:id="637268"><Label>(1)</Label><Text>Foothills shall submit to the designated officer, in accordance with a schedule approved by him,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637269" lims:id="637269"><Label>(a)</Label><Text>the environmental information used by it in preparing the plans or manuals referred to in subsection 179(1);</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637270" lims:id="637270"><Label>(b)</Label><Text>construction scheduling and engineering design information necessary for a review and evaluation of the plans or manuals referred to in subsection 179(1);</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637271" lims:id="637271"><Label>(c)</Label><Text>environmental information necessary to evaluate potential environmental impacts; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637272" lims:id="637272"><Label>(d)</Label><Text>information in respect of the environment in the vicinity of the pipeline prior to the commencement of the construction of the pipeline necessary to measure any environmental impact.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637273" lims:id="637273"><Label>(2)</Label><Text>When requested by the designated officer Foothills shall submit to him</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637274" lims:id="637274"><Label>(a)</Label><Text>information in respect of those areas where thaw settlement may require measures to be taken to comply with section 73; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637275" lims:id="637275"><Label>(b)</Label><Text>any studies, reports, analyses or other material on which the information submitted pursuant to sections 94 and 100 are based.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="637276" lims:id="637276"><Label>(3)</Label><Text>Where Foothills conducts studies or gathers data or information when considering the effect, if any, of the construction or operation of the pipeline on the existing or potential use of any land or waterbody through which the pipeline passes for the purpose of taking into account such effect pursuant to section 72, such studies, data or information shall be submitted by Foothills to the designated officer when requested by him.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="637277" lims:id="637277"><Label>183</Label><Text>When requested by the designated officer and in a manner satisfactory to him, Foothills shall submit to him,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637278" lims:id="637278"><Label>(a)</Label><Text>environmental and other information necessary for the determination of the pipeline location;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="637279" lims:id="637279"><Label>(b)</Label><Text>any procedures or measures proposed by Foothills as alternatives to the procedures or measures referred to in subsection
