of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>, hereby makes the annexed <XRefExternal reference-type="regulation">Military Police Professional Code of lims:inforce-start-date="2006-03-22" lims:fid="655971" lims:id="655971"><Heading lims:inforce-start-date="2006-03-22" lims:fid="655972" lims:id="655972" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="655973" lims:id="655973"><Label>1</Label><Text>In this Code, <DefinedTermEn>Act</DefinedTermEn> means the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="655974" lims:id="655974"><Label>2</Label><Text>The provisions of this Code shall be interpreted as being in addition to, and not in derogation of, any power, jurisdiction or authority that may be exercised under the Act or any other Act of Parliament.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="655975" lims:id="655975" level="1"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="655976" lims:id="655976"><Label>3</Label><Text>This Code applies to officers and non-commissioned members who are appointed as military police under regulations for the purposes of section 156 of the Act.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="655977" lims:id="655977" level="1"><TitleText>Prohibitions</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="655978" lims:id="655978"><Label>4</Label><Text>No member of the military police shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="655979" lims:id="655979"><Label>(a)</Label><Text>knowingly, without good cause, supervise or carry out an arrest, a detention, a search or surveillance that is unlawful;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="655980" lims:id="655980"><Label>(b)</Label><Text>knowingly, without good cause, fail to report an arrest, a detention, a search or surveillance that is, or can reasonably be considered, unlawful;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="655981" lims:id="655981"><Label>(c)</Label><Text>knowingly use, or permit or direct the use of, excessive force on any person;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="655982" lims:id="655982"><Label>(d)</Label><Text>while carrying out their duties, act in a discriminatory or discourteous manner towards any person;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="655983" lims:id="655983"><Label>(e)</Label><Text>intimidate, or retaliate against, any person who makes a report or complaint about the conduct of a member of the military police;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="655984" lims:id="655984"><Label>(f)</Label><Text>unlawfully discharge a weapon;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="655985" lims:id="655985"><Label>(g)</Label><Text>use a weapon in a dangerous or negligent manner;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="655986" lims:id="655986"><Label>(h)</Label><Text>knowingly suppress, misrepresent or falsify information in a report or statement;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="655987" lims:id="655987"><Label>(i)</Label><Text>knowingly and improperly interfere with the conduct of any investigation;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="655988" lims:id="655988"><Label>(j)</Label><Text>use military police information, military police resources or their status as a member of the military police for a private or another unauthorized purpose;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="655989" lims:id="655989"><Label>(k)</Label><Text>disclose military police information unless authorized; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="655990" lims:id="655990"><Label>(l)</Label><Text>engage in conduct that is likely to discredit the military police or that calls into question the member’s ability to carry out their duties in a faithful and impartial manner.</Text></Paragraph></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="655991" lims:id="655991" level="1"><TitleText>Presumed Discredit</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="655992" lims:id="655992"><Label>5</Label><Text>A member of the military police is presumed to discredit the military police if the member is convicted of</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="655993" lims:id="655993"><Label>(a)</Label><Text>an offence under the Act, other than an offence tried at a summary trial for which a minor punishment or a fine of not more than 25% of basic monthly pay has been imposed; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="655994" lims:id="655994"><Label>(b)</Label><Text>an indictable offence, or an offence punishable on summary conviction, under any other Act of Parliament or the legislature of a province.</Text></Paragraph></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="655995" lims:id="655995" level="1"><TitleText>Duty to Report</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="655996" lims:id="655996"><Label>6</Label><Text>A member of the military police shall report to their superior in the military police chain of command any incident for which they have been charged with an offence under the Act or any other Act of Parliament or the legislature of a province.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="655997" lims:id="655997"><Label>7</Label><Text>A member of the military police who believes, or is aware of an allegation, that another member of the military police has breached this Code shall report the belief or allegation, as the case may be, to</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="655998" lims:id="655998"><Label>(a)</Label><Text>their superior in the military police chain of command; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="655999" lims:id="655999"><Label>(b)</Label><Text>the next superior in the military police chain of command, if the superior referred to in paragraph (a) is the subject of the belief or allegation.</Text></Paragraph></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="656000" lims:id="656000" level="1"><TitleText>Duty to Cooperate</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="656001" lims:id="656001"><Label>8</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="656002" lims:id="656002"><Label>(1)</Label><Text>No member of the military police is excused from responding to any question relating to an investigation into a breach of this Code, unless the member is</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="656003" lims:id="656003"><Label>(a)</Label><Text>the subject of the investigation; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="656004" lims:id="656004"><Label>(b)</Label><Text>the assisting officer for another member of the military police who is the subject of the investigation.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="656005" lims:id="656005"><Label>(2)</Label><Text>A response given by a member of the military police under subsection (1) shall not be used against the interests of the member by the Military Police Credentials Review Board established under Chapter 22 of the <XRefExternal reference-type="regulation">Queen’s Regulations and Orders for the Canadian Forces</XRefExternal>.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="656006" lims:id="656006" level="1"><TitleText>Coming into Force</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="656007" lims:id="656007" type="transitional"><Label>9</Label><Text>This Code comes into force on the day on which they are registered.</Text></Section></Body></Regulation>
