(<DefinedTermFr>récifs d’éponges siliceuses</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-02-13" lims:fid="840947" lims:id="840947" generate-in-text="no"><Text><DefinedTermEn>Marine Protected Areas</DefinedTermEn> means the areas of the sea that are designated by section 2. (<DefinedTermFr>zones de protection marine</DefinedTermFr>)</Text></Definition></Subsection><Subsection lims:inforce-start-date="2017-02-13" lims:fid="840948" lims:id="840948"><MarginalNote lims:inforce-start-date="2017-02-13" lims:fid="840949" lims:id="840949">Geographical coordinates</MarginalNote><Label>(2)</Label><Text>In the Schedules, all geographical coordinates (latitude and longitude) are expressed in the North America Datum 1983 (NAD 83) reference system.</Text></Subsection></Section><Heading lims:inforce-start-date="2017-02-13" lims:fid="840950" lims:id="840950" level="1"><TitleText>Designation</TitleText></Heading><Section lims:inforce-start-date="2017-02-13" lims:lastAmendedDate="2017-02-13" lims:fid="840951" lims:id="840951"><MarginalNote lims:inforce-start-date="2017-02-13" lims:fid="840952" lims:id="840952">Marine Protected Areas</MarginalNote><Label>2</Label><Subsection lims:inforce-start-date="2017-02-13" lims:fid="840953" lims:id="840953"><Label>(1)</Label><Text>The following areas of the sea are designated as the Hecate Strait and Queen Charlotte Sound Glass Sponge Reefs Marine Protected Areas:</Text><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="840954" lims:id="840954"><Label>(a)</Label><Text>the Northern Reef Marine Protected Area, depicted in Schedule 1 and bounded by a series of rhumb lines drawn from points A to L, the coordinates of which are set out in that Schedule, and then back to point A;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="840955" lims:id="840955"><Label>(b)</Label><Text>the Central Reefs Marine Protected Area, depicted in Schedule 1 and bounded by a series of rhumb lines drawn from points M to Y, the coordinates of which are set out in that Schedule, and then back to point M; and</Text></Paragraph><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="840956" lims:id="840956"><Label>(c)</Label><Text>the Southern Reef Marine Protected Area, depicted in Schedule 1 and bounded by a series of rhumb lines drawn from points Z to EE, the coordinates of which are set out in that Schedule, and then back to point Z.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2017-02-13" lims:fid="840957" lims:id="840957"><MarginalNote lims:inforce-start-date="2017-02-13" lims:fid="840958" lims:id="840958">Seabed, subsoil and water column</MarginalNote><Label>(2)</Label><Text>Each Marine Protected Area consists of the seabed, the subsoil to a depth of 20 m and the water column above the seabed.</Text></Subsection></Section><Heading lims:inforce-start-date="2017-02-13" lims:fid="840959" lims:id="840959" level="1"><TitleText>Marine Protected Areas</TitleText></Heading><Heading lims:inforce-start-date="2017-02-13" lims:fid="840960" lims:id="840960" level="2"><TitleText>Northern Reef Marine Protected Area</TitleText></Heading><Section lims:inforce-start-date="2017-02-13" lims:lastAmendedDate="2017-02-13" lims:fid="840961" lims:id="840961"><MarginalNote lims:inforce-start-date="2017-02-13" lims:fid="840962" lims:id="840962">Northern Reef Marine Protected Area</MarginalNote><Label>3</Label><Subsection lims:inforce-start-date="2017-02-13" lims:fid="840963" lims:id="840963"><Label>(1)</Label><Text>The Northern Reef Marine Protected Area consists of a core protection zone, a vertical adaptive management zone and an adaptive management zone.</Text></Subsection><Subsection lims:inforce-start-date="2017-02-13" lims:fid="840964" lims:id="840964"><MarginalNote lims:inforce-start-date="2017-02-13" lims:fid="840965" lims:id="840965">Core protection zone</MarginalNote><Label>(2)</Label><Text>The core protection zone consists of the seabed, the subsoil to a depth of 20 m and the water column above the seabed to a depth of 100 m below the sea surface. The boundaries of the core protection zone are represented by a series of rhumb lines drawn from points 1 to 12, the coordinates of which are set out in Schedule 2, and then back to point 1.</Text></Subsection><Subsection lims:inforce-start-date="2017-02-13" lims:fid="840966" lims:id="840966"><MarginalNote lims:inforce-start-date="2017-02-13" lims:fid="840967" lims:id="840967">Vertical adaptive management zone</MarginalNote><Label>(3)</Label><Text>The vertical adaptive management zone consists of the water column that extends above the core protection zone to the sea surface.</Text></Subsection><Subsection lims:inforce-start-date="2017-02-13" lims:fid="840968" lims:id="840968"><MarginalNote lims:inforce-start-date="2017-02-13" lims:fid="840969" lims:id="840969">Adaptive management zone</MarginalNote><Label>(4)</Label><Text>The adaptive management zone consists of the seabed, subsoil and waters of the Northern Reef Marine Protected Area that are not part of the core protection zone or the vertical adaptive management zone.</Text></Subsection></Section><Heading lims:inforce-start-date="2017-02-13" lims:fid="840970" lims:id="840970" level="2"><TitleText>Central Reefs Marine Protected Area</TitleText></Heading><Section lims:inforce-start-date="2017-02-13" lims:lastAmendedDate="2017-02-13" lims:fid="840971" lims:id="840971"><MarginalNote lims:inforce-start-date="2017-02-13" lims:fid="840972" lims:id="840972">Central Reefs Marine Protected Area</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2017-02-13" lims:fid="840973" lims:id="840973"><Label>(1)</Label><Text>The Central Reefs Marine Protected Area is composed of two core protection zones (Zone A and Zone B), two vertical adaptive management zones and an adaptive management zone.</Text></Subsection><Subsection lims:inforce-start-date="2017-02-13" lims:fid="840974" lims:id="840974"><MarginalNote lims:inforce-start-date="2017-02-13" lims:fid="840975" lims:id="840975">Core protection zone (Zone A)</MarginalNote><Label>(2)</Label><Text>Zone A consists of the seabed, the subsoil to a depth of 20 m and the water column above the seabed to a depth of 120 m below the sea surface. The boundaries of Zone A are represented by a series of rhumb lines drawn from points 13 to 23, the coordinates of which are set out in Schedule 3, and then back to point 13.</Text></Subsection><Subsection lims:inforce-start-date="2017-02-13" lims:fid="840976" lims:id="840976"><MarginalNote lims:inforce-start-date="2017-02-13" lims:fid="840977" lims:id="840977">Core protection zone (Zone B)</MarginalNote><Label>(3)</Label><Text>Zone B consists of the seabed, the subsoil to a depth of 20 m and the water column above the seabed to a depth of 120 m below the sea surface. The boundaries of Zone B are represented by a series of rhumb lines drawn from points 24 to 32, the coordinates of which are set out in Schedule 3, and then back to point 24.</Text></Subsection><Subsection lims:inforce-start-date="2017-02-13" lims:fid="840978" lims:id="840978"><MarginalNote lims:inforce-start-date="2017-02-13" lims:fid="840979" lims:id="840979">Vertical adaptive management zones</MarginalNote><Label>(4)</Label><Text>The vertical adaptive management zones consist of the water columns that extend above Zone A and Zone B to the sea surface.</Text></Subsection><Subsection lims:inforce-start-date="2017-02-13" lims:fid="840980" lims:id="840980"><MarginalNote lims:inforce-start-date="2017-02-13" lims:fid="840981" lims:id="840981">Adaptive management zone</MarginalNote><Label>(5)</Label><Text>The adaptive management zone consists of the seabed, subsoil and waters of the Central Reefs Marine Protected Area that are not part of the core protection zones or the vertical adaptive management zones.</Text></Subsection></Section><Heading lims:inforce-start-date="2017-02-13" lims:fid="840982" lims:id="840982" level="2"><TitleText>Southern Reef Marine Protected Area</TitleText></Heading><Section lims:inforce-start-date="2017-02-13" lims:lastAmendedDate="2017-02-13" lims:fid="840983" lims:id="840983"><MarginalNote lims:inforce-start-date="2017-02-13" lims:fid="840984" lims:id="840984">Southern Reef Marine Protected Area</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2017-02-13" lims:fid="840985" lims:id="840985"><Label>(1)</Label><Text>The Southern Reef Marine Protected Area is composed of a core protection zone, a vertical adaptive management zone and an adaptive management zone.</Text></Subsection><Subsection lims:inforce-start-date="2017-02-13" lims:fid="840986" lims:id="840986"><MarginalNote lims:inforce-start-date="2017-02-13" lims:fid="840987" lims:id="840987">Core protection zone</MarginalNote><Label>(2)</Label><Text>The core protection zone consists of the seabed, the subsoil to a depth of 20 m and the water column above the seabed to a depth of 146 m below the sea surface. The boundaries of the core protection zone are represented by a series of rhumb lines drawn from points 33 to 39, the coordinates of which are set out in Schedule 4, and then back to point 33.</Text></Subsection><Subsection lims:inforce-start-date="2017-02-13" lims:fid="840988" lims:id="840988"><MarginalNote lims:inforce-start-date="2017-02-13" lims:fid="840989" lims:id="840989">Vertical adaptive management zone</MarginalNote><Label>(3)</Label><Text>The vertical adaptive management zone consists of the water column that extends above the core protection zone to the sea surface.</Text></Subsection><Subsection lims:inforce-start-date="2017-02-13" lims:fid="840990" lims:id="840990"><MarginalNote lims:inforce-start-date="2017-02-13" lims:fid="840991" lims:id="840991">Adaptive management zone</MarginalNote><Label>(4)</Label><Text>The adaptive management zone consists of the seabed, subsoil and waters of the Southern Reef Marine Protected Area that are not part of the core protection zone or the vertical adaptive management zone.</Text></Subsection></Section><Heading lims:inforce-start-date="2017-02-13" lims:fid="840992" lims:id="840992" level="1"><TitleText>Prohibited Activities</TitleText></Heading><Section lims:inforce-start-date="2017-02-13" lims:lastAmendedDate="2017-02-13" lims:fid="840993" lims:id="840993"><MarginalNote lims:inforce-start-date="2017-02-13" lims:fid="840994" lims:id="840994">Prohibition</MarginalNote><Label>6</Label><Text>It is prohibited in the Marine Protected Areas to</Text><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="840995" lims:id="840995"><Label>(a)</Label><Text>carry out any activity that disturbs, damages, destroys or removes any living marine organism or any part of its habitat or is likely to do so; or</Text></Paragraph><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="840996" lims:id="840996"><Label>(b)</Label><Text>carry out any scientific research or monitoring, or any educational activity, unless it is part of an activity plan that has been approved by the Minister.</Text></Paragraph></Section><Heading lims:inforce-start-date="2017-02-13" lims:fid="840997" lims:id="840997" level="1"><TitleText>Exceptions</TitleText></Heading><Section lims:inforce-start-date="2017-02-13" lims:lastAmendedDate="2017-02-13" lims:fid="840998" lims:id="840998"><MarginalNote lims:inforce-start-date="2017-02-13" lims:fid="840999" lims:id="840999">Permitted activities</MarginalNote><Label>7</Label><Text>Despite paragraph 6(a), the following activities may be carried out in the Marine Protected Areas:</Text><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="841000" lims:id="841000"><Label>(a)</Label><Text>fishing in the adaptive management and vertical adaptive management zones if</Text><Subparagraph lims:inforce-start-date="2017-02-13" lims:fid="841001" lims:id="841001"><Label>(i)</Label><Text>the fishing is not likely to result in the damage, destruction or removal of any part of the glass sponge reefs,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-02-13" lims:fid="841002" lims:id="841002"><Label>(ii)</Label><Text>the fishing is carried out in accordance with the <XRefExternal reference-type="act" link="F-14">Fisheries Act</XRefExternal> and its regulations,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-02-13" lims:fid="841003" lims:id="841003"><Label>(iii)</Label><Text>the fishing is carried out in accordance with the <XRefExternal reference-type="act" link="C-33">Coastal Fisheries Protection Act</XRefExternal> and its regulations,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-02-13" lims:fid="841004" lims:id="841004"><Label>(iv)</Label><Text>in the case of commercial fishing in a vertical adaptive management zone, the fishing is carried out by means of midwater trawl, midwater hook and line, troll, seine or gillnet and the gear does not enter a core protection zone, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-02-13" lims:fid="841005" lims:id="841005"><Label>(v)</Label><Text>in the case of recreational fishing in a vertical adaptive management zone, the fishing is carried out by means of midwater hook and line and the gear does not enter a core protection zone;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="841006" lims:id="841006"><Label>(b)</Label><Text>navigation of vessels in the adaptive management and vertical adaptive management zones that is carried out</Text><Subparagraph lims:inforce-start-date="2017-02-13" lims:fid="841007" lims:id="841007"><Label>(i)</Label><Text>in accordance with the <XRefExternal reference-type="act" link="C-10.15">Canada Shipping Act, 2001</XRefExternal> and its regulations, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-02-13" lims:fid="841008" lims:id="841008"><Label>(ii)</Label><Text>without any anchor entering a core protection zone;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="841009" lims:id="841009"><Label>(c)</Label><Text>the laying, maintenance or repair of cables in the adaptive management zones if the laying, maintenance or repair is not likely to result in the damage, destruction or removal of any part of the glass sponge reefs;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="841010" lims:id="841010"><Label>(d)</Label><Text>any activity that is carried out for the purpose of public safety, national defence, national security, law enforcement or responding to an emergency; and</Text></Paragraph><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="841011" lims:id="841011"><Label>(e)</Label><Text>any activity that is part of an activity plan that has been approved by the Minister.</Text></Paragraph></Section><Heading lims:inforce-start-date="2017-02-13" lims:fid="841012" lims:id="841012" level="1"><TitleText>Activity Plan</TitleText></Heading><Section lims:inforce-start-date="2017-02-13" lims:lastAmendedDate="2017-02-13" lims:fid="841013" lims:id="841013"><MarginalNote lims:inforce-start-date="2017-02-13" lims:fid="841014" lims:id="841014">Submission of activity plan</MarginalNote><Label>8</Label><Subsection lims:inforce-start-date="2017-02-13" lims:fid="841015" lims:id="841015"><Label>(1)</Label><Text>Any person may submit to the Minister an activity plan for the carrying out of scientific research or monitoring, or educational activities, in the Marine Protected Areas.</Text></Subsection><Subsection lims:inforce-start-date="2017-02-13" lims:fid="841016" lims:id="841016"><MarginalNote lims:inforce-start-date="2017-02-13" lims:fid="841017" lims:id="841017">Activity plan</MarginalNote><Label>(2)</Label><Text>The activity plan must contain</Text><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="841018" lims:id="841018"><Label>(a)</Label><Text>the person’s name, address, telephone number and email address;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="841019" lims:id="841019"><Label>(b)</Label><Text>if the plan is submitted by an institution or organization, the name of the individual who will be responsible for the proposed activity and their title, address, telephone number and email address;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="841020" lims:id="841020"><Label>(c)</Label><Text>the name of each vessel that the person proposes to use to carry out the activity, its state of registration and registration number, its radio call sign and the name and address of its owner, master and any operator;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="841021" lims:id="841021"><Label>(d)</Label><Text>the proposed dates of the vessel’s first entry into and final exit from the Marine Protected Areas, and any proposed alternative dates;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="841022" lims:id="841022"><Label>(e)</Label><Text>the geographic coordinates of the site of the proposed activity and a map that shows the location of the activity within the boundaries of the Marine Protected Areas;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="841023" lims:id="841023"><Label>(f)</Label><Text>a list of any substances that may be deposited during the proposed activity in the Marine Protected Areas — other than substances that are authorized by the <XRefExternal reference-type="act" link="C-10.15">Canada Shipping Act, 2001</XRefExternal> and its regulations to be deposited in the navigation of a vessel — and the quantity and concentration of each substance;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="841024" lims:id="841024"><Label>(g)</Label><Text>a detailed description of the proposed activity and its purpose;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="841025" lims:id="841025"><Label>(h)</Label><Text>a general description of any study, report or other work that is anticipated to result from the proposed activity, and its anticipated date of completion;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="841026" lims:id="841026"><Label>(i)</Label><Text>a description of any scientific research or monitoring, or educational activities, that the person has previously carried out in the Marine Protected Areas or anticipates carrying out in those areas in the future; and</Text></Paragraph><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="841027" lims:id="841027"><Label>(j)</Label><Text>a description of any measures to be taken to monitor, avoid, minimize or mitigate any environmental effects of the proposed activity.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2017-02-13" lims:lastAmendedDate="2017-02-13" lims:fid="841028" lims:id="841028"><MarginalNote lims:inforce-start-date="2017-02-13" lims:fid="841029" lims:id="841029">Approval of activity plans</MarginalNote><Label>9</Label><Subsection lims:inforce-start-date="2017-02-13" lims:fid="841030" lims:id="841030"><Label>(1)</Label><Text>The Minister must approve an activity plan if</Text><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="841031" lims:id="841031"><Label>(a)</Label><Text>the scientific research or monitoring activities set out in the plan are not likely to adversely impact the biological, chemical or oceanographic processes that maintain or enhance the biodiversity, structural habitat or ecosystem function of the glass sponge reefs and will serve to</Text><Subparagraph lims:inforce-start-date="2017-02-13" lims:fid="841032" lims:id="841032"><Label>(i)</Label><Text>increase knowledge of the biodiversity, structural habitat or ecosystem function of the Marine Protected Areas,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-02-13" lims:fid="841033" lims:id="841033"><Label>(ii)</Label><Text>assist in the management of the Marine Protected Areas, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-02-13" lims:fid="841034" lims:id="841034"><Label>(iii)</Label><Text>assist in the evaluation of the effectiveness of any measures taken to conserve and protect the Marine Protected Areas; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="841035" lims:id="841035"><Label>(b)</Label><Text>the educational activities set out in the plan are not likely to result in the damage, destruction or removal of any part of the glass sponge reefs and will serve to increase public awareness of the Marine Protected Areas.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2017-02-13" lims:fid="841036" lims:id="841036"><MarginalNote lims:inforce-start-date="2017-02-13" lims:fid="841037" lims:id="841037">Approval prohibited</MarginalNote><Label>(2)</Label><Text>Despite subsection (1), the Minister must not approve an activity plan if</Text><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="841038" lims:id="841038"><Label>(a)</Label><Text>any substance that may be deposited during the proposed activity is a <DefinitionRef>deleterious substance</DefinitionRef> as defined in subsection 34(1) of the <XRefExternal reference-type="act" link="F-14">Fisheries Act</XRefExternal>, unless the deposit of the substance is authorized under subsection 36(4) of that Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="841039" lims:id="841039"><Label>(b)</Label><Text>the cumulative environmental effects of the proposed activity, in combination with any other past and current activities carried out in the Marine Protected Areas, are likely to adversely impact the biological, chemical or oceanographic processes that maintain or enhance the biodiversity, structural habitat or ecosystem function of the glass sponge reefs; or</Text></Paragraph><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="841040" lims:id="841040"><Label>(c)</Label><Text>any educational activity within a core protection zone is proposed.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2017-02-13" lims:fid="841041" lims:id="841041"><MarginalNote lims:inforce-start-date="2017-02-13" lims:fid="841042" lims:id="841042">Timeline for approval</MarginalNote><Label>(3)</Label><Text>The Minister’s decision in respect of an activity plan must be made within</Text><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="841043" lims:id="841043"><Label>(a)</Label><Text>60 days after the day on which the activity plan is received;
