or</Text></Paragraph><Paragraph lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-06" lims:fid="1544587" lims:id="1544587"><Label>(c)</Label><Text>both a licence referred to in paragraph (b) and its related membership, if both are required under an Act of Parliament to practise the occupation.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2025-11-06" lims:enacted-date="2025-11-06" lims:fid="1544588" lims:id="1544588" level="1"><TitleText>Goods and Services</TitleText></Heading><Section lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-06" lims:lastAmendedDate="2026-01-01" lims:fid="1544589" lims:id="1544589"><MarginalNote lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-06" lims:fid="1544590" lims:id="1544590">Requirements — same aspect or element</MarginalNote><Label>2</Label><Subsection lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-06" lims:fid="1544591" lims:id="1544591"><Label>(1)</Label><Text>For the purposes of paragraphs 8(2)(a) and 9(2)(a) of the Act, a provincial or territorial requirement and a federal requirement are in respect of the same aspect or element of a good or service if</Text><Paragraph lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-06" lims:fid="1544592" lims:id="1544592"><Label>(a)</Label><Text>in the case of a good, the requirements are in respect of</Text><Subparagraph lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-06" lims:fid="1544593" lims:id="1544593"><Label>(i)</Label><Text>the same regulated person or entity, such as the producer or distributor of the good, or the same stage in the life cycle of the good, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-06" lims:fid="1544594" lims:id="1544594"><Label>(ii)</Label><Text>the same feature, characteristic or function of the good or the same activity or process that pertains to the good; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-06" lims:fid="1544595" lims:id="1544595"><Label>(b)</Label><Text>in the case of a service, the requirements are in respect of</Text><Subparagraph lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-06" lims:fid="1544596" lims:id="1544596"><Label>(i)</Label><Text>the same service provider, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-06" lims:fid="1544597" lims:id="1544597"><Label>(ii)</Label><Text>the same feature, characteristic or function of the service or the same activity or process that pertains to the service.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-06" lims:fid="1544598" lims:id="1544598"><MarginalNote lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-06" lims:fid="1544599" lims:id="1544599">For greater certainty — same aspect or element</MarginalNote><Label>(2)</Label><Text>For greater certainty, the fact that the provincial or territorial requirement is in respect of the distribution of the good or provision of the service within the province or territory and the federal requirement is in respect of the distribution of the good or provision of the service between provinces and territories is not relevant to determining whether the provincial or territorial requirement and the federal requirement are in respect of the same aspect or element of the good or service.</Text></Subsection><Subsection lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-06" lims:fid="1544600" lims:id="1544600"><MarginalNote lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-06" lims:fid="1544601" lims:id="1544601">For greater certainty — same aspect or element</MarginalNote><Label>(3)</Label><Text>For greater certainty, a provincial or territorial requirement and a federal requirement to hold a licence, registration or other type of permit in order to conduct an activity are not in respect of the same aspect or element of the good or service.</Text></Subsection><Subsection lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-06" lims:fid="1544602" lims:id="1544602"><MarginalNote lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-06" lims:fid="1544603" lims:id="1544603">Requirements — achieve a similar objective</MarginalNote><Label>(4)</Label><Text>For the purposes of paragraphs 8(2)(b) and 9(2)(b) of the Act, a provincial or territorial requirement is intended to achieve a similar objective as a federal requirement if it seeks to advance the same public interest as the federal requirement, such as</Text><Paragraph lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-06" lims:fid="1544604" lims:id="1544604"><Label>(a)</Label><Text>the health, safety or security of Canadians;</Text></Paragraph><Paragraph lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-06" lims:fid="1544605" lims:id="1544605"><Label>(b)</Label><Text>environmental or consumer protection; or</Text></Paragraph><Paragraph lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-06" lims:fid="1544606" lims:id="1544606"><Label>(c)</Label><Text>economic efficiency or market fairness.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-06" lims:lastAmendedDate="2026-01-01" lims:fid="1544607" lims:id="1544607"><MarginalNote lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-06" lims:fid="1544608" lims:id="1544608">Exceptions respecting goods</MarginalNote><Label>3</Label><Text>Subsection 8(1) of the Act does not apply in respect of a federal requirement under the <XRefExternal reference-level="federal" reference-type="act" link="A-6">Agricultural Products Marketing Act</XRefExternal>, the <XRefExternal reference-level="federal" reference-type="act" link="C-15">Canadian Dairy Commission Act</XRefExternal>, the <XRefExternal reference-level="federal" reference-type="act" link="F-4">Farm Products Agencies Act</XRefExternal>, the <XRefExternal reference-level="federal" reference-type="act" link="S-1.1">Safe Food for Canadians Act</XRefExternal> or section B.01.042 or B.01.043 of the <XRefExternal reference-level="federal" reference-type="regulation" link="C.R.C.,_c._870">Food and Drug Regulations</XRefExternal>.</Text></Section><Section lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-06" lims:lastAmendedDate="2026-01-01" lims:fid="1544609" lims:id="1544609"><MarginalNote lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-06" lims:fid="1544610" lims:id="1544610">Restriction respecting goods</MarginalNote><Label>4</Label><Text>The application of subsection 8(1) of the Act is restricted to goods other than those that are defined as or considered to be hazardous waste, or hazardous recyclable material, in the <XRefExternal reference-level="federal" reference-type="regulation">Cross-border Movement of Hazardous Waste and Hazardous Recyclable Material Regulations</XRefExternal>, for the purposes of the <XRefExternal reference-level="federal" reference-type="act" link="C-15.31">Canadian Environmental Protection Act, 1999</XRefExternal> and those Regulations.</Text></Section><Section lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-06" lims:lastAmendedDate="2026-01-01" lims:fid="1544611" lims:id="1544611"><MarginalNote lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-06" lims:fid="1544612" lims:id="1544612">Condition respecting goods</MarginalNote><Label>5</Label><Text>For the purposes of paragraph 8(2)(c) of the Act, the provincial or territorial requirement must be a requirement under a law of a province or territory in which the activities of the producer or distributor of the good are governed or regulated.</Text></Section><Heading lims:inforce-start-date="2025-11-06" lims:enacted-date="2025-11-06" lims:fid="1544613" lims:id="1544613" level="1"><TitleText>Labour Mobility</TitleText></Heading><Section lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-06" lims:lastAmendedDate="2026-01-01" lims:fid="1544614" lims:id="1544614"><MarginalNote lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-06" lims:fid="1544615" lims:id="1544615">Conditions respecting authorizations</MarginalNote><Label>6</Label><Text>For the purposes of section 10 of the Act, a federal regulatory body must not recognize or issue an authorization unless</Text><Paragraph lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-06" lims:fid="1544616" lims:id="1544616"><Label>(a)</Label><Text>the holder of the provincial or territorial authorization is in good standing with the provincial or territorial regulatory body that issued the authorization; and</Text></Paragraph><Paragraph lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-06" lims:fid="1544617" lims:id="1544617"><Label>(b)</Label><Text>the holder of the provincial or territorial authorization has</Text><Subparagraph lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-06" lims:fid="1544618" lims:id="1544618"><Label>(i)</Label><Text>paid to the federal regulatory body any applicable fee related to the issuance of the federal authorization, including any one-time fee, as well as any fees or dues for a membership to an association that is required under an Act of Parliament to practise an occupation,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-06" lims:fid="1544619" lims:id="1544619"><Label>(ii)</Label><Text>taken any applicable oath or solemn affirmation related to the issuance of the federal authorization, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-06" lims:fid="1544620" lims:id="1544620"><Label>(iii)</Label><Text>in the case of an authorization issued under the <XRefExternal reference-level="federal" reference-type="regulation" link="SOR-87-150">Railway Employee Qualification Standards Regulations</XRefExternal>, successfully completed any applicable examination and assessment required under those Regulations that ensure that the holder is competent to perform their required duties.</Text></Subparagraph></Paragraph></Section><Heading lims:inforce-start-date="2025-11-06" lims:enacted-date="2025-11-06" lims:fid="1544621" lims:id="1544621" level="1"><TitleText>Coming into Force</TitleText></Heading><Section lims:inforce-start-date="2025-11-06" lims:enacted-date="2025-11-06" lims:lastAmendedDate="2025-11-06" lims:fid="1544622" lims:id="1544622" type="CIFnobold"><MarginalNote lims:inforce-start-date="2025-11-06" lims:enacted-date="2025-11-06" lims:fid="1544623" lims:id="1544623">S.C. 2025, c. 2, s. 2</MarginalNote><Label><FootnoteRef idref="fn_SOR-2025-225_e_transform_hq_1763564201">*</FootnoteRef>7</Label><Text>These Regulations come into force on the day on which the <XRefExternal reference-level="federal" reference-type="act" link="F-31.55">Free Trade and Labour Mobility in Canada Act</XRefExternal>, as enacted by section 2 of chapter 2 of the Statutes of Canada, 2025, comes into force, but if they are registered after that day, they come into force on the day on which they are registered.</Text><Footnote id="fn_SOR-2025-225_e_transform_hq_1763564201" placement="section" status="editorial"><Label>*</Label><Text>[Note: Regulations in force January 1, 2026, <Emphasis style="italic">see</Emphasis> SI/2025-107.]</Text></Footnote></Section></Body></Regulation>
