Whereas, pursuant to section 5.5 of the Aeronautics Act, a copy of the proposed Zoning Regulations respecting Moncton Airport, substantially in the form set out in the schedule hereto, was published in two successive issues of the Canada Gazette Part I on March 17th and 24th, 1990, and in two successive issues of The Times-Transcript on March 14th and 15th, 1990, and in two successive issues of L’Acadie Nouvelle on March 13th and 14th, 1990, and a reasonable opportunity was thereby afforded to interested persons to make representations to the Minister of Transport with respect thereto;Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to section 5.4 of the Aeronautics Act, is pleased hereby to revoke the Moncton Airport Zoning Regulations, C.R.C., c. 94 and to make the annexed Regulations respecting zoning at Moncton Airport, in substitution therefor.Short Title
These Regulations may be cited as the Moncton Airport Zoning Regulations.
Interpretation
In these Regulations,airport means the Moncton Airport, in the Parish of Moncton, in the County of Westmorland, in the Province of New Brunswick; (aéroport)airport reference point means the point described in Part I of the schedule; (point de repère de l’aéroport)approach surface means an imaginary inclined plane that extends upward and outward from each end of a strip, which approach surface is more particularly described in Part II of the schedule; (surface d’approche)Minister means the Minister of Transport; (ministre)outer surface means an imaginary surface located above and in the immediate vicinity of the airport, which outer surface is more particularly described in Part III of the schedule; (surface extérieure)strip means the rectangular portion of the landing area of the airport, including the runway, prepared for the take-off and landing of aircraft in a particular direction, which strip is more particularly described in Part IV of the schedule; (bande)transitional surface means an imaginary inclined plane that extends upward and outward from the lateral limits of a strip and its approach surfaces, which transitional surface is more particularly described in Part V of the schedule. (surface de transition)For the purposes of these Regulations, the elevation of the airport reference point is 60 m above sea level.
Application
These Regulations apply to all the lands, including public road allowances, adjacent to or in the vicinity of the airport, which lands are more particularly described as follows:the lands within the outer limits of lands described in Part VI of the schedule; andthe lands directly under that portion of the approach surfaces that extend beyond the said outer limits.
General
No person shall erect or construct on any land to which these Regulations apply, any building, structure or object or any addition to any existing building, structure or object, the highest point of which will exceed in elevation at the location of that pointthe approach surfaces;the outer surface; orthe transitional surfaces.
Aeronautical Facilities
No owner or occupier of any land to which these Regulations apply shall permit such land or any part of it to be used or developed in a manner that causes interference with any signals or communications to and from any aircraft or to and from any facilities used to provide services relating to aeronautics.
Natural Growth
Where an object of natural growth on any land to which these Regulations apply exceeds in elevation any of the surfaces referred to in paragraphs 4(a) to (c), the Minister may require that the owner or occupier of the land on which that object is growing remove the excessive growth.
Disposal of Waste
No owner or occupier of any land to which these Regulations apply shall permit such land or any part of it to be used for the disposal of any waste that is edible by or attractive to birds.
(Sections 2 and 3)Description of Airport Reference PointThe airport reference point, shown on Moncton Airport Zoning Plan Numbers S-2021-3, S-2021-4, S-2021-9 and S-2021-10, dated March 12, 1988, is determined by measuring 655 m northerly along the centre line of runway 02-20 from the southerly end of runway 02 and thence measuring 183 m easterly at right angles from the said centre line.The said airport reference point has New Brunswick Double Stereographic Grid Co-ordinates of N 758513.10 m and E 440478.38 m.Description of the Approach SurfacesThe approach surfaces, shown on Moncton Airport Zoning Plan Numbers S-2021-0 to S-2021-12 inclusive, dated March 12, 1988, are surfaces abutting each end of the strips associated with runways designated 06-24, 11-29 and 02-20 and are described as follows:a surface abutting the end of the strip associated with runway approach 06 consisting of an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 15 000 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 2 400 m from the projected centre line; said imaginary horizontal line being 300 m measured vertically above the elevation at the end of the strip;a surface abutting the end of the strip associated with runway approach 24 consisting of an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 15 000 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 2 400 m from the projected centre line; said imaginary horizontal line being 300 m measured vertically above the elevation at the end of the strip;a surface abutting the end of the strip associated with runway approach 11 consisting of an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 15 000 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 2 400 m from the projected centre line; said imaginary horizontal line being 300 m measured vertically above the elevation at the end of the strip;a surface abutting the end of the strip associated with runway approach 29 consisting of an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 15 000 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 2 400 m from the projected centre line; said imaginary horizontal line being 300 m measured vertically above the elevation at the end of the strip;a surface abutting the end of the strip associated with runway approach 02 consisting of an inclined plane having a ratio of 1 m measured vertically to 30 m measured horizontally rising to an imaginary horizontal line drawn at its intersection with the outer surface; said imaginary horizontal line being at right angles to the projected centre line of the strip and distant 1 029 m measured horizontally from the end of the strip; the outer ends of the said imaginary horizontal line being 147.9 m from the projected centre line; anda surface abutting the end of the strip associated with runway approach 20 consisting of an inclined plane having a ratio of 1 m measured vertically to 30 m measured horizontally rising to an imaginary line drawn at its intersection with the outer surface; said imaginary horizontal line being at right angles to the projected centre line of the strip and distant 1 338 m measured horizontally from the end of the strip; the outer ends of the said imaginary horizontal line being 178.8 m from the projected centre line.Description of the Outer SurfaceThe outer surface, shown on Moncton Airport Zoning Plan Numbers S-2021-0, S-2021-2 to S-2021-5 inclusive and S-2021-8 to S-2021-11 inclusive, dated March 12, 1988, is an imaginary surface located at a common plane established at a constant elevation of 45 m above the elevation of the airport reference point, except that, where that common plane is less than 9 m above the surface of the ground, the outer surface is an imaginary surface located at 9 m above the surface of the ground.Description of the StripsThe strips shown on Moncton Airport Zoning Plan Numbers S-2021-3, S-2021-4, S-2021-9 and S-2021-10, dated March 12, 1988, are described as follows:the strip associated with runway 06-24 is 300 m in width, 150 m being on each side of the centre line of the runway, and 1 995.0 m in length;the strip associated with runway 11-29 is 300 m in width, 150 m being on each side of the centre line of the runway, and 2 559.0 m in length; andthe strip associated with runway 02-20 is 90 m in width, 45 m being on each side of the centre line of the runway, and 1 239.0 m in length.Description of Each Transitional SurfaceEach transitional surface, shown on Moncton Airport Zoning Plan Numbers S-2021-0, S-2021-3, S-2021-4, S-2021-9 and S-2021-10 dated March 12, 1988, is a surface consisting of an inclined plane rising at a ratio of 1 m measured vertically to 7 m measured horizontally at right angles to the centre line and projected centre line of the strip and extending upward and outward from the lateral limits of the strip and its approach surfaces to an intersection with the outer surface or another transitional surface of an adjoining strip.Description of the Outer LimitsThe boundary of the outer limits of the lands to which these Regulations apply, shown on Moncton Airport Zoning Plan Numbers S-2021-0, S-2021-2, S-2021-6, S-2021-8, S-2021-9 and S-2021-11, dated March 12, 1988, is a circular area with a radius of 4 000 m centred on the airport reference point.
