(<DefinedTermFr>aéroport</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="931223" lims:id="931223" generate-in-text="no"><Text><DefinedTermEn>airport reference point</DefinedTermEn> means the point described in Part I of the schedule; (<DefinedTermFr>point de repère de l’aéroport</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="931224" lims:id="931224" generate-in-text="no"><Text><DefinedTermEn>approach surface</DefinedTermEn> means an imaginary inclined plane that extends upward and outward from each end of a strip, which approach surface is more particularly described in Part II of the schedule; (<DefinedTermFr>surface d’approche</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="931225" lims:id="931225" generate-in-text="no"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Transport; (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="931226" lims:id="931226" generate-in-text="no"><Text><DefinedTermEn>outer surface</DefinedTermEn> means an imaginary surface located above and in the immediate vicinity of the airport, which outer surface is more particularly described in Part III of the schedule; (<DefinedTermFr>surface extérieure</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="931227" lims:id="931227" generate-in-text="no"><Text><DefinedTermEn>strip</DefinedTermEn> means the rectangular portion of the landing area of the airport, including the runway, prepared for the take-off and landing of aircraft in a particular direction, which strip is more particularly described in Part IV of the schedule; (<DefinedTermFr>bande</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="931228" lims:id="931228" generate-in-text="no"><Text><DefinedTermEn>transitional surface</DefinedTermEn> means an imaginary inclined plane that extends upward and outward from the lateral limits of a strip and its approach surfaces, which transitional surface is more particularly described in Part V of the schedule. (<DefinedTermFr>surface de transition</DefinedTermFr>)</Text></Definition></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="931229" lims:id="931229"><Label>(2)</Label><Text>For the purposes of these Regulations, the elevation of the airport reference point is 60 m above sea level.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="931230" lims:id="931230" level="1"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="931231" lims:id="931231"><Label>3</Label><Text>These Regulations apply to all the lands, including public road allowances, adjacent to or in the vicinity of the airport, which lands are more particularly described as follows:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="931232" lims:id="931232"><Label>(a)</Label><Text>the lands within the outer limits of lands described in Part VI of the schedule; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="931233" lims:id="931233"><Label>(b)</Label><Text>the lands directly under that portion of the approach surfaces that extend beyond the said outer limits.</Text></Paragraph></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="931234" lims:id="931234" level="1"><TitleText>General</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="931235" lims:id="931235"><Label>4</Label><Text>No person shall erect or construct on any land to which these Regulations apply, any building, structure or object or any addition to any existing building, structure or object, the highest point of which will exceed in elevation at the location of that point</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="931236" lims:id="931236"><Label>(a)</Label><Text>the approach surfaces;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="931237" lims:id="931237"><Label>(b)</Label><Text>the outer surface; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="931238" lims:id="931238"><Label>(c)</Label><Text>the transitional surfaces.</Text></Paragraph></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="931239" lims:id="931239" level="1"><TitleText>Aeronautical Facilities</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="931240" lims:id="931240"><Label>5</Label><Text>No owner or occupier of any land to which these Regulations apply shall permit such land or any part of it to be used or developed in a manner that causes interference with any signals or communications to and from any aircraft or to and from any facilities used to provide services relating to aeronautics.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="931241" lims:id="931241" level="1"><TitleText>Natural Growth</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="931242" lims:id="931242"><Label>6</Label><Text>Where an object of natural growth on any land to which these Regulations apply exceeds in elevation any of the surfaces referred to in paragraphs 4(a) to (c), the Minister may require that the owner or occupier of the land on which that object is growing remove the excessive growth.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="931243" lims:id="931243" level="1"><TitleText>Disposal of Waste</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="931244" lims:id="931244"><Label>7</Label><Text>No owner or occupier of any land to which these Regulations apply shall permit such land or any part of it to be used for the disposal of any waste that is edible by or attractive to birds.</Text></Section></Body><Schedule lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="931245" lims:id="931245" bilingual="no" spanlanguages="no"><ScheduleFormHeading lims:inforce-start-date="2006-03-22" lims:fid="931246" lims:id="931246"><Label>SCHEDULE</Label><OriginatingRef>(Sections 2 and 3)</OriginatingRef></ScheduleFormHeading><Heading lims:inforce-start-date="2006-03-22" lims:fid="931247" lims:id="931247" level="1"><Label>PART I</Label><TitleText>Description of Airport Reference Point</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="931248" lims:id="931248" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>The airport reference point, shown on Moncton Airport Zoning Plan Numbers S-2021-3, S-2021-4, S-2021-9 and S-2021-10, dated March 12, 1988, is determined by measuring 655 m northerly along the centre line of runway 02-20 from the southerly end of runway 02 and thence measuring 183 m easterly at right angles from the said centre line.</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="931249" lims:id="931249" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>The said airport reference point has New Brunswick Double Stereographic Grid Co-ordinates of N 758513.10 m and E 440478.38 m.</Text></Provision><Heading lims:inforce-start-date="2006-03-22" lims:fid="931250" lims:id="931250" level="1"><Label>PART II</Label><TitleText>Description of the Approach Surfaces</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="931251" lims:id="931251" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>The approach surfaces, shown on Moncton Airport Zoning Plan Numbers S-2021-0 to S-2021-12 inclusive, dated March 12, 1988, are surfaces abutting each end of the strips associated with runways designated 06-24, 11-29 and 02-20 and are described as follows:</Text><Provision lims:inforce-start-date="2006-03-22" lims:fid="931252" lims:id="931252" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(a)</Label><Text>a surface abutting the end of the strip associated with runway approach 06 consisting of an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 15 000 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 2 400 m from the projected centre line; said imaginary horizontal line being 300 m measured vertically above the elevation at the end of the strip;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="931253" lims:id="931253" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(b)</Label><Text>a surface abutting the end of the strip associated with runway approach 24 consisting of an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 15 000 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 2 400 m from the projected centre line; said imaginary horizontal line being 300 m measured vertically above the elevation at the end of the strip;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="931254" lims:id="931254" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(c)</Label><Text>a surface abutting the end of the strip associated with runway approach 11 consisting of an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 15 000 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 2 400 m from the projected centre line; said imaginary horizontal line being 300 m measured vertically above the elevation at the end of the strip;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="931255" lims:id="931255" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(d)</Label><Text>a surface abutting the end of the strip associated with runway approach 29 consisting of an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 15 000 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 2 400 m from the projected centre line; said imaginary horizontal line being 300 m measured vertically above the elevation at the end of the strip;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="931256" lims:id="931256" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(e)</Label><Text>a surface abutting the end of the strip associated with runway approach 02 consisting of an inclined plane having a ratio of 1 m measured vertically to 30 m measured horizontally rising to an imaginary horizontal line drawn at its intersection with the outer surface; said imaginary horizontal line being at right angles to the projected centre line of the strip and distant 1 029 m measured horizontally from the end of the strip; the outer ends of the said imaginary horizontal line being 147.9 m from the projected centre line; and</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="931257" lims:id="931257" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(f)</Label><Text>a surface abutting the end of the strip associated with runway approach 20 consisting of an inclined plane having a ratio of 1 m measured vertically to 30 m measured horizontally rising to an imaginary line drawn at its intersection with the outer surface; said imaginary horizontal line being at right angles to the projected centre line of the strip and distant 1 338 m measured horizontally from the end of the strip; the outer ends of the said imaginary horizontal line being 178.8 m from the projected centre line.</Text></Provision></Provision><Heading lims:inforce-start-date="2006-03-22" lims:fid="931258" lims:id="931258" level="1"><Label>PART III</Label><TitleText>Description of the Outer Surface</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="931259" lims:id="931259" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>The outer surface, shown on Moncton Airport Zoning Plan Numbers S-2021-0, S-2021-2 to S-2021-5 inclusive and S-2021-8 to S-2021-11 inclusive, dated March 12, 1988, is an imaginary surface located at a common plane established at a constant elevation of 45 m above the elevation of the airport reference point, except that, where that common plane is less than 9 m above the surface of the ground, the outer surface is an imaginary surface located at 9 m above the surface of the ground.</Text></Provision><Heading lims:inforce-start-date="2006-03-22" lims:fid="931260" lims:id="931260" level="1"><Label>PART IV</Label><TitleText>Description of the Strips</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="931261" lims:id="931261" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>The strips shown on Moncton Airport Zoning Plan Numbers S-2021-3, S-2021-4, S-2021-9 and S-2021-10, dated March 12, 1988, are described as follows:</Text><Provision lims:inforce-start-date="2006-03-22" lims:fid="931262" lims:id="931262" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(a)</Label><Text>the strip associated with runway 06-24 is 300 m in width, 150 m being on each side of the centre line of the runway, and 1 995.0 m in length;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="931263" lims:id="931263" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(b)</Label><Text>the strip associated with runway 11-29 is 300 m in width, 150 m being on each side of the centre line of the runway, and 2 559.0 m in length; and</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="931264" lims:id="931264" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(c)</Label><Text>the strip associated with runway 02-20 is 90 m in width, 45 m being on each side of the centre line of the runway, and 1 239.0 m in length.</Text></Provision></Provision><Heading lims:inforce-start-date="2006-03-22" lims:fid="931265" lims:id="931265" level="1"><Label>PART V</Label><TitleText>Description of Each Transitional Surface</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="931266" lims:id="931266" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Each transitional surface, shown on Moncton Airport Zoning Plan Numbers S-2021-0, S-2021-3, S-2021-4, S-2021-9 and S-2021-10 dated March 12, 1988, is a surface consisting of an inclined plane rising at a ratio of 1 m measured vertically to 7 m measured horizontally at right angles to the centre line and projected centre line of the strip and extending upward and outward from the lateral limits of the strip and its approach surfaces to an intersection with the outer surface or another transitional surface of an adjoining strip.</Text></Provision><Heading lims:inforce-start-date="2006-03-22" lims:fid="931267" lims:id="931267" level="1"><Label>PART VI</Label><TitleText>Description of the Outer Limits</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="931268" lims:id="931268" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>The boundary of the outer limits of the lands to which these Regulations apply, shown on Moncton Airport Zoning Plan Numbers S-2021-0, S-2021-2, S-2021-6, S-2021-8, S-2021-9 and S-2021-11, dated March 12, 1988, is a circular area with a radius of 4 000 m centred on the airport reference point.</Text></Provision></Schedule></Regulation>
