AERONAUTICS ACT

Regulations Respecting Zoning at St. Johns (Quebec) Airport

Short Title

 These Regulations may be cited as the St. Johns (Quebec) Airport Zoning Regulations.

Interpretation

 In these Regulations,

airport

airport means St. Johns Airport, in the town of St-Jean, in the parish of St-Jean, County of St-Jean, in the Province of Quebec; (aéroport)

airport reference point

airport reference point means the point described in Part I of the schedule; (point de repère de l’aéroport)

approach surface

approach surface means an imaginary inclined plane extending upward and outward from each end of a strip along and at right angles to the projected centre line thereof, which approach surface is more particularly described in Part III of the schedule; (surface d’approche)

horizontal surface

horizontal surface means an imaginary surface located above and in the immediate vicinity of the airport, which horizontal surface is more particularly described in Part IV of the schedule; (surface horizontale)

Minister

strip

strip means a rectangular portion of the landing area of the airport including the runway prepared for the take-off and landing of aircraft in a particular direction, which strip is more particularly described in Part V of the schedule; (bande)

transitional surface

transitional surface means an imaginary inclined plane extending upward from the lateral limits of a strip and its approach surfaces, which transitional surface is more particularly described in Part VI of the schedule. (surface de transition)

 For the purposes of these Regulations, the airport reference point is deemed to be 126 feet above sea level.

Application

  •  (1) Subject to subsection (2), these Regulations apply to all the lands adjacent to or in the vicinity of the airport, including public road allowances and part of the Richelieu River, the outer limits of which are described in Part II of the schedule.

  • (2) These Regulations do not apply to such of those lands, the outer limits of which are described in item 1 of Part II of the schedule, as form part of the airport from time to time.

General

 No person shall erect or construct, on any land or any land under water to which these Regulations apply, any building, structure or object or any addition to any existing building, structure or object, the highest point of which will exceed in elevation at that point any of the surfaces hereinafter set out that project immediately over and above the surface of the land at that location, namely,

  • (a) the approach surfaces;

  • (b) the horizontal surface; or

  • (c) the transitional surfaces.

SCHEDULE(Sections 2 and 4)

PART IAirport Reference Point

Premising that the bearings hereinafter mentioned are astronomical and are referred to the centre line of strip 11-29, St. Johns Airport, St-Jean, Province of Quebec, as South 89°48′ E.

BEGINNING at the intersection of the centre line of strip 11-29 with the centre line of strip 06-24; THENCE, South 89°48′ East along the centre line of strip 11-29, a distance of nine hundred and fifty (950) feet to a point; THENCE, at right angle in a general Northerly direction, a distance of five hundred (500) feet to the airport reference point, said airport reference point being also two thousand nine hundred sixty-five feet and seven tenths (2,965.7) measured along a line having bearing of North 54°44′ East from a point at the intersection of the lot line between lots 117 and 118, Parish of St-Jean, and the Easterly boundary of a public road (Chemin du Grand Bernier).

PART IIDescription of Outer Limits of Lands

  • 1 ALL AND SINGULAR those certain parcels or tracts of land and premises comprising all of the town of St-Jean and part of the Parishes of Ste-Marguerite de Blairfindie, St-Jean and St-Luc, Registration Division of St-Jean, County of St-Jean, Province of Quebec and being more particularly described as follows:

    COMMENCING at the intersection of the waters’ edge of Richelieu River with the lot line between lots 42 and 43, Parish of St-Jean; THENCE, following the lot line between lots 42 and 43, Parish of St-Jean, passing through Highway No. 9b and a railroad being part of lot 235, Parish of St-Jean, in a general Westerly direction to its intersection with the Easterly boundary of lot 136, Parish of St-Jean; THENCE following the last-mentioned boundary, in a general Southerly direction to its intersection with the lot line between lots 136 and 137, Parish of St-Jean; THENCE, following the last-mentioned lot line, passing through a public road (Chemin du Grand Bernier), in a general Westerly direction to the Southeasterly corner of lot 188, Parish of St-Jean; THENCE, following the Easterly boundary of lot 188, Parish of St-Jean, in a general Northerly direction, to its intersection with the lot line between lots 188 and 189, Parish of St-Jean; THENCE, following the last-mentioned lot line, in a general Westerly direction to its intersection with the Easterly boundary of a public road; THENCE, following the last-mentioned boundary, in a general Northerly direction to its intersection with the lot line between lots 190 and 191, Parish of St-Jean; THENCE, following the last-mentioned lot line, passing through a public road, in a general Westerly direction to its intersection with the Parish line between the Parishes of St-Jean and Ste-Marguerite de Blairfindie; THENCE, following the last-mentioned parish line, in a general Northerly direction to its intersection with the lot line between lots 118 and 119, Parish of Ste-Marguerite de Blairfindie; THENCE, following the last-mentioned lot line, in a general Westerly direction to its intersection with the Easterly boundary of a public road; THENCE, following the last-mentioned boundary, in a general Northeasterly direction, to its intersection with the lot line between lots 120 and 121, Parish of Ste-Marguerite de Blairfindie; THENCE, following the last-mentioned lot line, in a general Westerly direction to its intersection with the Easterly boundary of lot 289; THENCE, following the last-mentioned boundary and the Easterly boundary of lots 288, 287, 284, 283, Parish of Ste-Marguerite de Blairfindie, to its intersection with the lot line between lots 282 and 283, Parish of Ste-Marguerite de Blairfindie; THENCE, following the lot line between lots 282 and 283, Parish of Ste-Marguerite de Blairfindie, in a general Northwesterly direction, to the Southwesterly corner of lot 282, Parish of Ste-Marguerite de Blairfindie; THENCE, following the lot line between lots 281 and 282, Parish of Ste-Marguerite de Blairfindie, in a general Northeasterly direction to its intersection with a line running N. 00°12′ E., being at ten thousand (10,000) feet measured along the Westerly production of the centre line of strip 11 from the end of the said strip; THENCE N. 00°12′ E., following the last described line and its production to its intersection with the lot line between lots 274 and 275, Parish of Ste-Marguerite de Blairfindie; THENCE, following the last-mentioned lot line, in a general Easterly direction, to the Southeasterly corner of lot 274, Parish of Ste-Marguerite de Blairfindie; THENCE, following the last-mentioned lot line and its production, passing through a railroad being lot 419, Parish of Ste-Marguerite de Blairfindie, in a general Easterly direction to its intersection with the parish line between the Parishes of St-Luc and Ste-Marguerite de Blairfindie; THENCE, following the last-mentioned parish line, in a general Northwesterly direction to its intersection with the lot line between lots 120 and 121, Parish of St-Luc; THENCE, following the last-mentioned lot line, passing through a public road (Chemin du Grand Bernier), in a general Easterly direction to its intersection with the parish line between the Parishes of St-Luc and St-Jean; THENCE, following the last-mentioned parish line, in a general Northerly direction, to its intersection with the lot line between lots 81 and 82, Parish of St-Jean; THENCE, following the last-mentioned lot line and its production, passing through a public road and Chambly Canal (lot 236, Parish of St-Jean), in a general Easterly direction, to its intersection with the centre line of Richelieu River being also the county line between the counties of St-Jean and Iberville; THENCE, following the last-mentioned county line, in a general Southerly direction, to its intersection with the production of the lot line between lots 47 and 46-150, Parish of St-Jean; THENCE, following the last-mentioned production, in a general Westerly direction, to its intersection with the waters’ edge of Richelieu River; THENCE, following the last-mentioned waters’ edge, in a general Southerly direction, to the Point of Commencement, which lands and part of Richelieu River are shown on Department of Transport Plan No. M-3710, dated September 20, 1971.

  • 1 Being a surface abutting each end of each strip associated with runway 11-29, consisting of an inclined plane having a ratio of one (1) foot measured vertically to fifty (50) feet measured horizontally, rising to an imaginary horizontal line drawn at right angles to the projected centre line of each strip two hundred (200) feet measured vertically above the elevation at the end of each strip and ten thousand (10,000) feet measured horizontally from the end of each strip, the outer ends of each imaginary horizontal line being two thousand (2,000) feet from each projected centre line, which surface is shown on Department of Transport Plan No. M-3710, dated September 20, 1971.

  • 2 Being a surface abutting each end of each strip associated with runways 02-20 and 06-24, consisting of an inclined plane having a ratio of one (1) foot measured vertically to forty (40) feet measured horizontally, rising to an imaginary horizontal line drawn at right angles to the projected centre line of each strip one hundred fifty (150) feet measured vertically above the elevation at the end of each strip and six thousand (6,000) feet measured horizontally from the end of each strip, the outer ends of each imaginary horizontal line being nine hundred (900) feet from each projected centre line, which surface is shown on Department of Transport Plan No. M-3710, dated September 20, 1971.

Being a surface consisting of a plane located one hundred and fifty (150) feet above the assigned elevation of the airport reference point, which surface is shown on Department of Transport Plan No. M-3710 dated September 20, 1971.

PART VDescription of Each Strip

The strip associated with runway 11-29 is one thousand (1,000) feet in width, five hundred (500) feet being on each side of the centre line of the runway, and six thousand four hundred (6,400) feet in length, the strip associated with runway 02-20 is six hundred (600) feet in width, three hundred (300) feet being on each side of the centre line of the runway, and two thousand eight hundred and seventy-four and seven tenths (2,874.7) feet in length and the strip associated with runway 06-24 is six hundred (600) feet in width, three hundred (300) feet being on each side of the centre line of the runway, and three thousand one hundred and sixty-five (3,165) feet in length, which strips are shown on Department of Transport Plan No. M-3710, dated September 20, 1971.

PART VIDescription of Each Transitional Surface

Being a surface consisting of an inclined plane rising at a ratio of one (1) foot measured vertically to seven (7) feet measured horizontally at right angles to the centre line and centre line produced of each strip, and extending upward from the lateral limits of each strip and its approach surfaces to an intersection with the horizontal surface or another transitional surface of an adjoining strip, all as shown on Department of Transport Plan No. M-3710, dated September 20, 1971.
