Banking Industry Commission-paid Salespeople Hours of Work Regulations

Whereas, pursuant to subsection 248(1) of the Canada Labour Code, the Minister of Labour on February 10, 2004 appointed a Commissioner to make an inquiry into and concerning the employment of the class of employees known as commission-paid salespeople who are employed in the banking industry in Canada and to report to the Minister as to whether the general hours of work provisions of that Act can reasonably be applied to that class of employees without adversely affecting the banks and the employees;

Whereas the Commissioner reported to the Minister of Labour that the hours of work provided for in the Canada Labour Code are not suitable for that class of employees and that the class should be exempted from the application of sections 169Footnote a, 171 and 174 of that Act;

And whereas the Governor in Council is satisfied that sections 169a, 171 and 174 of the Canada Labour Code cannot reasonably be applied to that class of employees;

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Labour, pursuant to paragraph 175(1)(b) of the Canada Labour Code, hereby makes the annexed Banking Industry Commission-paid Salespeople Hours of Work Regulations.

Exemption

 The class of employees known as commission-paid salespeople who are employed in the banking industry in Canada are exempt from the application of sections 169, 171 and 174 of the Canada Labour Code.

Coming into Force

 These Regulations come into force on the day on which they are registered.
