Regulations Respecting Zoning at Smithers Airport

P.C. 1981-3181 1981-11-05

His Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to section 6 of the Aeronautics Act, is pleased hereby to approve the annexed Regulations respecting zoning at Smithers Airport made by the Minister of Transport.

Short Title

 These Regulations may be cited as the Smithers Airport Zoning Regulations.

Interpretation

  •  (1) In these Regulations,

    airport

    airport means the Smithers Airport, near the town of Smithers, in the Province of British Columbia; (aéroport)

    airport reference point

    airport reference point means the point described in Part I of the schedule; (point de repère de l’aéroport)

    approach surface

    approach surface means an imaginary inclined plane that extends upward and outward from each end of a strip, which approach surface is more particularly described in Part III of the schedule; (surface d’approche)

    Minister

    Minister means the Minister of Transport; (ministre)

    outer surface

    outer surface means an imaginary surface located above and in the immediate vicinity of the airport, which outer surface is more particularly described in Part IV of the schedule; (surface extérieure)

    strip

    strip means the rectangular portion of the landing area of the airport including the runway prepared for the take-off and landing of aircraft in a particular direction, which strip is more particularly described in Part V of the schedule; (bande)

    transitional surface

    transitional surface means an imaginary inclined plane that extends upward and outward from the lateral limits of a strip and its approach surfaces, which transitional surface is more particularly described in Part VI of the schedule. (surface de transition)

  • (2) For the purposes of these Regulations, the assigned elevation of the airport reference point is 519 m above sea level.

Application

 These Regulations apply to all the lands, including public road allowances, adjacent to or in the vicinity of the airport, that consist of

  • (a) the lands within, and

  • (b) the lands directly under that portion of an approach surface that extends beyond

the outer limits described in Part II of the schedule.

General

 No person shall erect or construct on any land to which these Regulations apply, any building, structure or object or any addition to any existing building, structure or object, the highest point of which will exceed in elevation at the location of that point any

  • (a) approach surface;

  • (b) outer surface; or

  • (c) transitional surface.

Natural Growth

 Where an object of natural growth on any land to which these Regulations apply exceeds in elevation any of the surfaces referred to in section 4, the Minister may make a direction that the owner or occupier of the land on which that object is growing remove the excessive growth.

Disposal of Waste

 No owner or occupier of any land to which these Regulations apply shall permit that land or any part of it to be used for the disposal of any waste edible by or attractive to birds.

PART IDescription of the Airport Reference Point

The airport reference point is a punch mark on the down bolt at the North East Corner of the Rotating Beacon, and having U.T.M. co-ordinates of 6,076,470.969 North, 616,611.411 East.

PART IIDescription of the Outer Limits of Lands

The following described boundaries are the outer limits of lands:

Commencing at the intersection of the centre line of the approach surface for approach 14 with the northerly boundary of the Southeast 1/4 of Section 26, Township 1A; THENCE, on an azimuth of 79°09′56″ and perpendicular to the aforesaid centre line to an intersection with the easterly limit of the approach surface for approach 14; THENCE, eastwardly in a straight line, to the northeast corner of the Southwest 1/4 of Section 25, Township 1A; THENCE, southeastwardly, in a straight line, to the northwest corner of District Lot 1185; THENCE, eastwardly, and following the northerly boundary of District Lot 1185, aforesaid, to its intersection with the westerly boundary of District Lot 860; THENCE, southeastwardly, and in a straight line, to the southeast corner of District Lot 860, aforesaid; THENCE, southwardly and following portions of the easterly boundaries of District Lots 1185 and 1181 to the northwest corner of District Lot 854; THENCE, southeastwardly, in a straight line, to the southeast corner of District Lot 854; THENCE, northwardly, and following the easterly boundary of the Southeast 1/4 of Section 27, Township 1A to the northeast corner of Lot 7, Plan 6771, of the Southeast 1/4 of Section 27, Township 1A; THENCE, northeastwardly, and in a straight line, to a point on the westerly limit of the approach surface of approach 14, said point being the intersection of a line on an azimuth of 259°02′56″ from the point of commencement, with the said westerly limit of the approach surface of approach 14; THENCE, on an azimuth of 79°02′56″, to the point of commencement, which outer surface is shown outlined in yellow on Department of Transport Plan No. B.C. 1384 dated January 31, 1980.

PART IIIDescription of the Approach Surfaces

The approach surfaces, shown on Department of Transport Smithers Airport Zoning Plan No. B.C. 1384, are surfaces abutting each end of the strip associated with the runway designated 14-32 and are described as follows:

  • (a) a surface abutting the end of the strip associated with runway approach 14 consisting of an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally rising to an intersection with the outer surface; THENCE such approach surface shall be horizontal and contiguous to said outer surface to an intersection with an imaginary horizontal line drawn at right angles to the projected centre line of the strip at its intersection with the northerly boundary of the South East 1/4 of Section 26, Township 1A, Range 5, Coast District; THENCE said approach surface shall slope upward at the above specified slope of 1 m measured vertically to 50 m measured horizontally to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 15 000 m measured horizontally from the end of the strip, the outer ends of the imaginary horizontal line being 2 400 m from the projected centre line and 804.3 m, measured vertically, above the assigned elevation of the airport reference point; and

  • (b) a surface abutting the end of the strip associated with runway approach 32 consisting of an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally rising to an intersection with the outer surface; THENCE such approach surface shall be horizontal and contiguous to said outer surface to an intersection with an imaginary horizontal line drawn at right angles to the projected centre line of the strip at its intersection with the southerly boundary of Lot U, Plan 6127 of District Lot 865, Range 5, Coast District; THENCE said approach surface shall slope upward at the above specified slope of 1 m measured vertically to 50 m measured horizontally to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 15 000 m measured horizontally from the end of the strip, the outer ends of the imaginary horizontal line being 2 400 m from the projected centre line and 799.7 m, measured vertically, above the assigned elevation of the airport reference point.

PART IVDescription of the Outer Surface

The outer surface, shown on Department of Transport Smithers Airport Zoning Plan dated January 31, 1980, is an imaginary surface located at a common plane established at a constant elevation of 45 m above the assigned elevation of the airport reference point except where that common plane is less than 9 m above the surface of the ground, the imaginary surface is located 9 m above the surface of the ground.

PART VDescription of the Strip

The strip, shown on Department of Transport Smithers Airport Zoning Plan dated January 31, 1980, is described as a strip associated with runway 14-32 being 300 m in width, 150 m being on each side of the centre line of the runway, and 1 948.8 m in length.

PART VIDescription of Each Transitional Surface

Each transitional surface, shown on Department of Transport Smithers Airport Zoning Plan dated January 31, 1980, is a surface consisting of an inclined plane having a ratio of 1 m measured vertically to 7 m measured horizontally at right angles to the centre line and centre line produced of the strip and extending upward and outward from the lateral limits of the strip and its approach surfaces to an intersection with the outer surface.
