Order Granting Authority to Regulate the Marketing in Interprovincial and Export Trade of Vegetables Produced in Manitoba

Her Excellency the Governor General in Council, on the recommendation of the Minister of Agriculture, pursuant to section 2 of the Agricultural Products Marketing Act, is pleased hereby to revoke the Manitoba Root Crop Order, made by Order in Council P.C. 1978-984 of 6th April, 1978Footnote *, and the Manitoba Vegetable Order, C.R.C., c. 161, and to make the annexed Order granting authority to regulate the marketing in interprovincial and export trade of vegetables produced in Manitoba, in substitution therefor.

Short Title
1 This Order may be cited as the Manitoba Vegetable Order.
Interpretation
2 In this Order,
- Act
Act means The Natural Products Marketing Act of Manitoba; (Loi)
- Commodity Board
Commodity Board means the Manitoba Vegetable Producers’ Marketing Board established pursuant to the Act; (Office)
- Plan
Plan means any plan for the marketing of vegetables established pursuant to the Act; (plan)
- vegetables
vegetables means any variety, class, grade or size of potatoes, parsnips, onions, carrots or rutabagas produced in the Province of Manitoba. (légumes)
Interprovincial and Export Trade
3 The Commodity Board is authorized to regulate the marketing of vegetables in interprovincial and export trade and for such purposes may, by order, with respect to persons and property situated within the Province of Manitoba, exercise all or any powers like the powers exercisable by it in relation to the marketing of vegetables locally within that Province under the Act and the Plan.
Levies
4 The Commodity Board may, in relation to the powers granted to it by section 3 with respect to the marketing of vegetables in interprovincial and export trade, by order, fix levies or charges and impose them on and collect them from persons described in section 3 who are engaged in the production or marketing of vegetables and for such purposes classify such persons into groups and fix the levies or charges payable by the members of the different groups in different amounts and the Commodity Board may use such levies or charges for its purposes, including the creation of reserves, the payment of expenses and losses resulting from the sale or disposal of vegetables and the equalization or adjustment among producers of vegetables of moneys realized from the sale thereof during such period or periods of time as it may determine.
