9.13 (1) Subject to subsection (2), an employer may provide only one toilet for all employees if

• (a) the total number of employees normally employed at the work place at any one time does not exceed five; and

• (b) the door of the toilet room is fitted on the inside with a locking device.

(2) If the class of employment in the work place is the transaction of business or the rendering of professional or personal services, the employer may provide only one toilet for all employees if

• (a) the total number of employees normally employed at the work place at any one time does not exceed 10 or the area of the work place does not exceed 100 m²; and

• (b) the door of the toilet room is fitted on the inside with a locking device.
