Tariff of Costs

His Excellency the Governor General in Council, on the recommendation of the Minister of Public Works and Government Services and the Treasury Board, pursuant to subsection 10(9) of the Expropriation Act, hereby

  • (a) repeals Order in Council P.C. 1980-3/2414 of September 5, 1980; and

  • (b) prescribes the annexed Tariff of Costs.

Amounts

 For the purpose of subsection 10(9) of the Expropriation Act, the following maximum amounts are prescribed:

  • (a) for each day that counsel, representing the objector, is reasonably required to attend the hearing, $600;

  • (b) for the reasonable accommodation and travelling expenses of the objector for each day that he or she is reasonably required to attend the hearing, $140; and

  • (c) for the actual and reasonable costs of written or prepared materials, if any, used by the objector or his or her counsel in the assertion of the objection at the hearing, $200.

Coming into Force

 This Tariff comes into force on the day on which it is registered.
